RE The publication of Federal Court decisions ROUND ONE

Mr Baumberg should not deny that I did him the courtesy of calling him
and leaving a voicemail with this simple question before sending this
email.

I was not allowed to talk to Marc Giroux yesterday by the very same
woman who would not identify herself but felt free to continue to
argue the rules and mandates with me just as she did when she acted as
Bill Brooks' gatekeeper months ago.

Thus I have deemed it best to ask you both my question in writing..

It is as follows:

This past weekend I noticed something strange while reseaching.certain
decisions such as the two found below in order to source certain
wording to quote as authorities within a memorandum of fact and law I
must file in the Federal Court of Appeal shortly.

http://decisions.fct-cf.gc.ca/fc-cf/decisions/en/item/99688/index.do

http://decisions.fca-caf.gc.ca/fca-caf/decisions/en/item/135341/index.do?r=AAAAAQALTG91aXMgQnJvd24B

For the same reasons I queried the Federal Court's website to source
wording from the decisions of Justices Bell, Southcott, Trudel and
Stratas in my matter (Federal Court File no T-1557-15 Federal Court of
Appeal File no A-48-16) . However I could find nothing recorded by the
court at all.

My obvious question is Why?

Trust that for obvious reasons I saved digital snapshots of my queries

Good afternoon Mr. Amos

In response to your recent e-mail, please note:

·         I called you on Tuesday morning because you called and left
a voice mail for me on Monday. (I did not call you back right away on
Monday because I was at home helping to look after my daughter, who
came down with chickenpox over the week-end.)

·         I am not aware of anyone checking your work on the internet
last Friday.

·         I do not know who sent you an anonymous e-mail on Friday.

·         I have not contacted the RCMP in this regard.

·         I admit that I did not read your email and all its
attachments closely.

·         I “presumed” that you “wanted to talk about electronic
filing” during our call yesterday because (a) that is what you
indicated in your voice mail on Monday that you wanted to talk about
(in your voice-mail message of Monday, March 21, you say: “I want to
discuss what I have been researching about electronic filing, and I
see your name in these documents”), and (b) that is what you were
actually talking about on the call yesterday.

·         I do not deny my knowledge of your assertion that there is
evidence of your possession of police surveillance wiretap tapes filed
in the Public Record of Federal Court.

Best regards, Andrew

Clearly our conversation did not go well. Trust that my conversation
with the office of the Commissioner for Federal Judicial Affairs was
even worse. Need I say I was not impressed with the delay in your
response after noticing that the Federal Court was checking my work on
the Internet last Friday?

My questions are simple. Who sent me the anonymous email on Friday and
has anyone contacted the RCMP yet?

I will expand further for the benefit of other people who will receive
this email.

I was abrupt in closing with you today because I saw no need to debate
who does what within Federal Court after you admitted receiving my
emails. As I said answer my questions in writing. You were attempting
to defer me to the lawyer who speaks for the Federal Court of
Appeallwithout hearing first hearing my questions. I knew was
attempting to talk to the correct lawyer about the contents of the
docket in Federal Court because Lise Henrie's email informed me of
that fact last week. It appears to me that you opted to return my
calls only after receiving my first email today. You admitted that you
did not study it closely or you would have seen what I was saying
about the mandate of  the Commissioner for Federal Judicial Affairs
was true..

You presumed that I wanted to talk about electonic filing but I had
already resolved my concerns about that and they will be stated within
the motion I am creating right now. As I said within my prior email
today I am sending emails and printing them in order to attach them as
exhibits to support a motion. I must do so because nobody representing
the CROWN will respond to me in writing since l filed my statement of
claim and ran for a seat in Parliament again. This is another email
that I will attach as an exhibit to my upcoming motion to be filed in
the public record of the Federal Court of Appeal. I have edited
several emails from last Thurday and Friday down to the minimum amount
that I have deemed to be important. If anyone wishes to dispute this
email now is the time.

My question today is about all the Officers of the Court who are
licenced to practice law for a fee. From my understanding of the law
you are obliged to uphold the law and if you are aware of wrongdoing
you are to report your knowledge of it to the proper law enforcement
authorities ASAP. Well what of the two judges in Federal Court and the
Crown Attorneys that I have encountered thus far or all the lawyers
who work for Federal Court? They cannot deny their knowledge of the
evidence of my possesion of police surveilance wiretap tapes filed in
the Public Record of Federal Court. Correct?

Throughout my statement of claim I do mention that I have many
American wiretap tapes of the mob and the CROWN has never denied that
fact.

Furthermore David Gordeau the former Commissioner for Federal Judicial
Affairs cannot deny that I discussed the American wiretap tapes with
him personally  in 2005 when the Liberal Party held the federal
goverment mandate. My attachments earlier easily proves that nobody
can deny the fact that the former clerk of Federal Court in
Fredericton bounced my documents back to me as soon as Harper became
Prime Minister.I though things were bad enough under the Liberals in
2002 however when Harper took control of our govenment most Canadians
agree that matters got a lot worse. Anyway this is David Gourdeau's
work. His words can explain what William Brooks should have done when
I first contacted him last fall.

https://www.tbs-sct.gc.ca/rpp/2006-2007/fja-cmf/fja-cmf-eng.pdf

The Attorney General of Canada cannot deny that in December I filed a
true copy of wiretap tape 139 as an exhibit to support an Motion to
Appeal an improper court order and discussed the wiretap tapes on the
record with two judges of the Federal Court thus far or the fact that
I just Tweeted a link to an uploaded copy one wiretap tape to Donald
Trump, Hillary Clinton, Senator Bernie Sanders, the Counsel Of
Canadians and the CROWN Corp commonly known as the CBC.

Mr Baumberg when you and I talked on Feb, 8th I told you of my blog
containing my documents correct? Well the following can be found
within the links I offer below.

http://davidraymondamos3.blogspot.ca/2015/12/appeal-of-order-of-mr-prothonotary.html

AFFIDAVIT OF THE PLAINTIFF, DAVID RAYMOND AMOS

"I, David Raymond Amos of Apohaqui, New Brunswick MAKE OATH AND SAY:

Hereto attached to this document as Exhibit A is a CD which is a
true copy of an American police surveillance wiretap tape entitled
139."

NOTICE OF OPPOSITION OF THE MOTION TO DISMISS

Within Paragragh 32 the following is clearly stated

32    The Plaintiff states that it is not plain and obvious that his
claim cannot succeed. It is only the Deputy Attorney General’s stated
opinion without revealing all the facts to Federal Court. For instance
while the Plaintiff was running in the election of the 42nd Parliament
he sent many emails to many people containing a true copy of this
Statement of his Claim. The CROWN should not deny that Peter MacKay
the outgoing Attorney General, his Deputy Minister William Pentney and
the local Justice Dept lawyer David Hansen received the emails found
below during the time of the election of the 42nd Parliament. The
entire text of the September 23rd, 2015 email (with some minor
spelling errors corrected) is as follows:

Forthe past 5 months the CROWN's lawyers have not created a valid motionthat meets the Rules of Federal Court. In fact the court and the CROWNtries hard deny this very simple rule in the Federal Courts ActSection 17 (1) Except as otherwise provided in this Act or any otherAct of Parliament, the Federal Court has concurrent originaljurisdiction in all cases in which relief is claimed against theCrown. Inside and outside of the court the Crown's attornies have proven tome on the record that they do not understand the Rules of FederalCourt. How can I argue such people when they don't know the rules butkeep on insulting me. The court has witnessed it all yet is more thanwilling to overlook the CROWN's so called errs and tries hard todismiss a complaint that the defence has failed to answer properlyduring the past five months of delay tactics. Hence I am now beforethe Federal Court of Appeal and dealing with its rules as i prepare tofile a few more lawsuits against the one very rich fancy lady whon weall must continue pay homage to for no reason that I will everunderstand.Pursusnat to the aforesaid Rules of Federal Court recently I informedthe Registry Office of the Federal Court of Appeal that I was planningto employ Section 345(2)(b). It was in order to comply with theFederal Court Rules in the creation of an appeal book the courtrequires rather than spend a lot of money that I do not have in makingseven paper copies of  a very unnecessary document that are the sizeof the phone book in Toronto. The rule is very simple and it is as follows..345(2)(b) if the appeal is brought in the Federal Court of Appeal, anelectronic copy of or five paper copies of the book. That said I was informed that the court could uphold that rule becausethe government had not provided the funding for it to uphold the law?Why is it that a poor man can create such a document on an old secondhand laptop yet the Federal Court of Canada does not have thecapabilty to receive and record it?Yet at the same point in time I read that the government needs 1.6millions dollars to update Justin Trudeau's FaceBook and Twitteraccounts etc. I have all such things and i can post and Tweet a greatdeal easily in my spare time when i am not busy arguing cops, lawyers, newsmen, bureaucrats and polticians in several countries who are alltrying hard to play dumb before the worldwide economy crashes bigtimethis this timeSurely out of all the well paid people doing next to nothing withinthe PCO office one person could handle the Prime Minister's socialmedia without any further expense to the Canadian taxpayer whatsoever. In my humble opinion before Canadians spend one more dime promotingthe Prime Minister our government should find the money to uphold thelaws it created for the benefit of us all. Big feeling Stevey boyHarper should have taugh the liberals one hard lesson ideed. It is notthe Trudeau government it is OUR government and it is run with OURmoney not Trudeau's. He is well paid and well kept in the job hecampaigned hard to get. He should learn to economize or at least getby on a million dollars to run his website until times get much betterN'esy Pas?Veritas VincitDavid Raymond Amos902 800 0369http://cas-cdc-www02.cas-satj.gc.ca/portal/page/portal/fca-caf_eng/directions_eng/direction13Practice Direction - Electronic ServiceFebruary 12, 2015The Federal Courts Rules have now been amended to allow for electronicservice, electronic filing, and the use of electronic documents in theFederal Courts. The intent behind these amendments was to eliminateimpediments to the eventual migration from paper records to electronicrecords in the Federal Courts and allow electronic processing of thoserecords. The amendments to the Rules were not intended to set the deadline bywhich that migration was to occur. The migration to electronic recordsis dependent upon the Courts Administrative Service's technologicalinfrastructure. While the Service has the ability to accommodate alimited form of electronic filing at this time, it requires asignificant infusion of funds in order to give full effect to themodifications contained in the amendments to the Rules. The Service isactively pursuing this additional funding. As a result, the amendments to the Rules dealing with electronicfiling and electronic records should be read as enabling, in the sensethat they allow electronic filing and the use of electronic records bythe parties as and when the Service acquires the capacity to give fulleffect to those amendments. That is not presently the case. Untilfurther notice, proceedings in the Federal Court of Appeal willcontinue to be based on a paper record which is to be prepared andfiled in the manner provided for such records.Accordingly, the options relating to the electronic filing andelectronic records found in 71(1)(4) and (5), 71.1(2), 72.2, 72.3,309(1.1)(b), 310(1.1)(b), 345(2)(b), 348(1)(b), 353, 354, 355, 364(1),365(1) are not available to the parties. The rules relating to electronic service, which are dependent upon theparties' technology as opposed to the Service's, are available to theprofession as of the coming into force of the amended Rules.«Marc Noël»Chief JusticeFederal Court of Appealhttp://cas-cdc-www02.cas-satj.gc.ca/portal/page/portal/fca-caf_eng/media_engGuidelines on Public and MediaThe Open Court PrincipleThe general rule in Canada is that court hearings are open to thepublic. The public is not allowed to remainstanding during a proceeding.Use of Electronic Devices in the CourtroomThe use of electronic devices in the courtroom is permitted, providedthe devices are used in “silent” or ‘vibration” mode so as not toaffect the decorum, the good order and the course of the proceedings.Accredited members of the media may record proceedings to verify theirnotes of what was said and done in Court, but not for broadcast. Mediaaccreditation should be prominently displayed. It is not permitted to make or receive phone calls in the courtroom. It is not permitted to broadcast or to send text messages, observations, information, notes, photos, or audio and video recordingfrom the courtroom to the outside.Media Coverage of Court ProceedingsMedia coverage of proceedings with audio-visual equipment is onlypermitted in accordance with the following guidelines:a.  A media request to cover a specific proceeding must be madesufficiently in advance to allow for necessary permissions to beobtained.b.  A decision as to whether to allow media coverage will be made by theChief Justice, after consultation with the panel of judges hearing theparticular case, as well as with the parties.c.  The Chief Justice or panel of judges hearing the proceeding maylimit or terminate media coverage to protect the rights of theparties; to assure the orderly conduct of the proceedings; or for anyother reason considered necessary or appropriate in the interest ofthe administration of justice.d.  Nothing in these guidelines shall prevent the Chief Justice fromplacing additional restrictions, or prohibiting altogether, mediaaccess to the Court's facilities.e.  Only equipment which does not produce distracting sound or lightshall be employed to cover proceedings.f.  The Chief Justice or his designate may limit or circumscribe theplacement or movement of the media personnel and their equipment.Media ContactFor more information or to make a request for media coverage of courtproceedings, please contact:Chantal CarbonneauExecutive Director and General CounselFederal Court of Appeal and the Court Martial Appeal Court of Canada(613) 995-5063Chantal.Carbonneau@cas-satj.gc.caThis contact information is for media enquiries only. For information with respect to Federal Court of Appeal practice, procedure and forms, please contact the Registry Office.http://www.thestar.com/news/canada/2016/03/05/privy-council-office-wants-600000-more-to-update-trudeaus-website.htmlPrivy Council Office wants $600,000 more to update Trudeau’s websiteThe Privy Council is asking for an extra $600,000 annually to“modernize” the prime minister’s “digital presence.”Prime Minister Justin Trudeau’s staff regularly update his Facebookpage, post messages on Twitter, and publish photos on Instagram, above.Prime Minister Justin Trudeau’s staff regularly update his Facebookpage, post messages on Twitter, and publish photos on Instagram, above.By: Alex Boutilier Ottawa Bureau Reporter, Published on Sat Mar 05 2016OTTAWA—Public servants running the prime minister’s website want anadditional $600,000 to “modernize (his) digital presence,” documentsreleased by the government show. The funding requested by the Privy Council Office (PCO), whichprovides non-partisan support to the prime minister and cabinet, wouldbring the price tag of operating the pm.gc.ca website to $1.6 millionthis year. The website currently offers a photo gallery, background documents forpolicy issues, and news releases. Prime Minister Justin Trudeau’sstaff regularly update his Facebook page, post messages on Twitter, and publish photos on Instagram. But according to the Privy Council the additional funding is needed toensure the official site is keeping up in an increasingly digitalworld.“As Canadians are increasingly receiving and sharing information indigital formats, the requirements associated with pm.gc.ca have grownand become more numerous and complex with the addition of new contentsuch as video, live streaming and social media,” Raymond Rivet, aspokesperson for the office, told the Star in a statement.“The use of new technology platforms and the increasing volume andcomplexity of requirements associated with these publishing demands onthe PM’s website represent a significant shift and rising pressure forPCO web operations and associated IT support.”Rivet pointed to live-streaming services as a driver to the costs, andnoted PCO commits the equivalent of four full-time staffers tomaintaining and updating the prime minister’s website. If the fundingis granted through this month’s federal budget, the team dedicated topm.gc.ca would grow to six.But web development companies and marketing experts question the$1.6-million price tag.“Sometimes it’s hard to see what’s behind the scenes, but I just can’timagine anything there that would require that kind of operatingbudget,” said Rick Silver, CEO of Toronto-based web developmentcompany WebPro.ca.“If somebody said how much to build something similar to this? Itwould be a stretch to say in the tens of thousands. Probably for$10,000 to $20,000 I could replicate this pretty easily.”Ian Capstick, owner of Ottawa’s MediaStyle and a former federal NDPadviser, said that the costs could include other services provided bythe Privy Council’s communications branch. But Capstick said if his company had $1.6 million to play around with,pm.gc.ca would offer a lot more than press releases and pictures.“It should be cooler than it is, right? It should be more interactivethan it is. It should do something as opposed to just give me pressreleases and pretty, shiny photos,” he said.Trudeau spokesperson Cameron Ahmad defended the price tag, saying itwas necessary to ensure the prime minister’s website was “adequatelyfunded” as the government moves to new platforms to get its messageacross.“The shift begins with ensuring that the prime minister’s website isadequately funded and operational to be compatible with the realitiesof the digital age,” Ahmed wrote in a statement.
