Stephane Dion made ambassador to Germany, but only 'special envoy' to EU

Dual ambassador role wasn't well received by European Union, so Trudeau adjusts appointment

When Prime Minister Justin Trudeau shuffled Stéphane Dion out of his cabinet earlier this year, the former foreign affairs minister and Liberal leader was named ambassador to both Germany and the European Union. Prime Minister Justin Trudeau says former Liberal leader Stephane Dion will be Canadian ambassador to Germany — but not to the European Union and Europe, where he will now serve instead as a "special envoy."

The announcement comes three months after the prime minister put forward Dion's name to serve as ambassador to both the EU as well as Germany, an unsual dual posting that reportedly rankled in some diplomatic circles.

The Prime Minister's Office says making Dion a special envoy followed consultations with European partners, in which "it was agreed that this appointment will best deliver" on Canada's commitment to stronger ties.
Recent media reports by the website iPolitics suggest the notion of a dual ambassador didn't go over well with the EU, which never formally extended a diplomatic invitation to Dion.

Dion, who had been foreign affairs minister until he was shuffled out of cabinet earlier this year, is to take up his new positions later this month.

The PMO statement says Dion will work with the existing mission to the EU and the current ambassador, Daniel Costello.

Trudeau said in a statement that Dion has a keen understanding of how the transatlantic relationship can help to advance shared values and interests.

"As my special envoy and Canada's senior diplomatic voice in Europe, I know he will proudly represent Canada with courage and conviction in this next important chapter for him, for Canada and for the whole of Europe."

Appearing before committee this morning


Dion will face questions from MPs Tuesday when he appears before the House of Commons foreign affairs committee.

He will be joined by his former cabinet colleague, John McCallum, the ex-immigration minister who was made Canada's ambassador to China. McCallum was moved in the same January cabinet shuffle.

Unlike Dion, who took weeks to decide whether to accept a new diplomatic role, McCallum has embraced his new role and is already on the job in Beijing.

McCallum hosted two senior ministers in Beijing last week, Trade Minister Francois-Philippe Champagne and Finance Minister Bill Morneau, both of whom took part in a new senior economic dialogue with China's vice premier.

UPDATE: Following his trip to Peru, Prime Minister Justin Trudeau will stop in Canada for a meeting on Sunday with the premiers of B.C. and Alberta, before departing for Europe.
Prime Minister Justin Trudeau has not even left the country for his latest international trip — a three-country, nine-day tour which begins Thursday — and he is already under fire for this travel.


As he jets towards his first stop in Lima, Peru, Trudeau leaves behind Alberta and Saskatchewan all but at war with British Columbia over the Kinder Morgan pipeline while the clock ticks towards a May 31 deadline set by Kinder Morgan to cancel the multi-billion project.

“For him to leave in the middle of an emergency like this, I think shows — at least to critics of Trudeau — that he’s not taking this seriously,” said Duane Bratt, the chair of the political science department at Mount Royal University in Calgary.

Ironically, his first event in Lima, on Friday morning, is to address a group of CEOs and international business leaders where he will lay out the case that Canada is a great place for new business investment.

“This is a crisis which requires the prime minister,” NDP Leader Jagmeet Singh told reporters on Parliament Hill Wednesday. “The mess is created by the prime minister. The prime minister absolutely has a responsibility to be here.”

In an interview from his riding office in Thornhill, Ont., Conservative MP Peter Kent agreed.

“The prime minister should stay at home and deal with this Kinder Morgan crisis and demonstrate a little leadership.”

Cameron Ahmad, the prime minister’s deputy director of communications, defended the travel, arguing that the trip provides valuable opportunities to advance Canada’s interests abroad and seek new opportunities for Canadian businesses.

The current tour is Trudeau’s first international travel since he took his family to India in February,  a trip widely panned by Canadian and international observers for featuring too many changes of clothing, not enough business, and one unwanted guest in the form of Jaspal Atwal, the Surrey, B.C. man once convicted of trying to murder an Indian politician.

“The Indian trip was a disaster because the expectations were … around trade and investment. That’s what that trip was supposed to be about. Instead, Indian-Canadian relations are at their worst levels since the 1970s. That is not good,” said Bratt.
This trip should be more buttoned-down, an all-business summit of heads of government from the Americas in Lima followed by a visit to Paris where Trudeau will become the first Canadian prime minister to speak to the French national assembly and, finally, a stop in London to participate in the bi-annual Commonwealth summit.

And to some international observers, Trudeau continues to have strong international cachet that, used properly, could help advance Canadian interests abroad.

“I don’t think his shine has worn off,” said Susan Schadler, a Boston-based senior fellow with the Waterloo, Ont., think tank, the Centre for International Governance Innovation. “You’ve got this modern prime minister who is a breath of fresh air in the current environment when we have a lot of horrible reactionaries around so I don’t think interest in him has worn off, not at all.

A week ago, it looked as if the summit in Peru might be a key moment in the ongoing NAFTA negotiations. Trudeau, U.S. President Donald Trump and Mexican President Enrique Pena Nieto were all expected to attend and some had speculated that the three leaders might announce a NAFTA deal-in-principle.

The  NAFTA negotiations, though, are not advanced enough for that to happen and, in any event, this week, Trump cancelled his visit to Lima — he’ll dispatch vice-president Mike Pence — in order to deal with latest bombings in Syria.

Without Trump, the Lima summit might have seemed less of a “must-attend” for the Canadian prime minister, particularly given events at home.

“I would argue that the Kinder Morgan issue is a bigger story, a bigger challenge in Canada than Syria is in the United States,” Bratt said.

Even though Trump will not attend, Trudeau is expected to meet with Mexico’s Nieto.

Next week, Trudeau will head to Europe where nationalist politicians in Hungary, Poland, Austria and elsewhere are seeking to build literal and metaphoric walls. Trudeau will have a rare platform for a Canadian politician — a speech in France’s Assemblée nationale — to speak about the value of liberal democracies and a global multilateral approach to solving problems like climate change.

“If you’re somebody like Trudeau, you could potentially be thinking, is there anything a country like Canada and a person like Trudeau could do to lend support to Europe finding its way,” said Schadler, who had a long career in Europe working as an economist for the International Monetary Fund.

“I think Europe is fundamentally in a lot of trouble right now. And that’s bad, certainly, for the North Atlantic partnership — the U.S., Canada and Europe.”

Paul Kritzer, a lawyer in private practice, was for 24 years vice

Dear Mr. Amos:

Thank you for your various correspondence about abusive tax schemes,
and for your understanding regarding the delay of this response.

This is an opportunity for me to address your concerns about the way
the Canada Revenue Agency (CRA) deals with aggressive tax planning,
tax avoidance, and tax evasion by targeting individuals and groups
that promote schemes intended to avoid payment of tax. It is also an
opportunity for me to present the Government of Canada’s main
strategies for ensuring fairness for all taxpayers.

The CRA’s mission is to preserve the integrity of Canada’s tax system,
and it is taking concrete and effective action to deal with abusive
tax schemes. Through federal budget funding in 2016 and 2017, the
government has committed close to $1 billion in cracking down on tax
evasion and combatting tax avoidance at home and through the use of
offshore transactions. This additional funding is expected to generate
federal revenues of $2.6 billion over five years for Budget 2016, and
$2.5 billion over five years for Budget 2017.

More precisely, the CRA is cracking down on tax cheats by hiring more
auditors, maintaining its underground economy specialist teams,
increasing coverage of aggressive goods and service tax/harmonized
sales tax planning, increasing coverage of multinational corporations
and wealthy individuals, and taking targeted actions aimed at
promoters of abusive tax schemes.

On the offshore front, the CRA continues to develop tools to improve
its focus on high‑risk taxpayers. It is also considering changes to
its Voluntary Disclosures Program following the first set of program
recommendations received from an independent Offshore Compliance
Advisory Committee. In addition, the CRA is leading international
projects to address the base erosion and profit shifting initiative of
the G20 and the Organisation for Economic Co-operation and
Development, and is collaborating with treaty partners to address the
Panama Papers leaks.

These actions are evidence of the government’s commitment to
protecting tax fairness. The CRA has strengthened its intelligence and
technical capacities for the early detection of abusive tax
arrangements and deterrence of those who participate in them. To
ensure compliance, it has increased the number of actions aimed at
promoters who use illegal schemes. These measures include increased
audits of such promoters, improved information gathering, criminal
investigations where warranted, and better communication with
taxpayers.

To deter potential taxpayer involvement in these schemes, the CRA is
increasing notifications and warnings through its communications
products. It also seeks partnerships with tax preparers, accountants,
and community groups so that they can become informed observers who
can educate their clients.

The CRA will assess penalties against promoters and other
representatives who make false statements involving illegal tax
schemes. The promotion of tax schemes to defraud the government can
lead to criminal investigations, fingerprinting, criminal prosecution,
court fines, and jail time.

Between April 1, 2011, and March 31, 2016, the CRA’s criminal
investigations resulted in the conviction of 42 Canadian taxpayers for
tax evasion with links to money and assets held offshore. In total,
the $34 million in evaded taxes resulted in court fines of $12 million
and 734 months of jail time.

When deciding to pursue compliance actions through the courts, the CRA
consults the Department of Justice Canada to choose an appropriate
solution. Complex tax-related litigation is costly and time consuming,
and the outcome may be unsuccessful. All options to recover amounts
owed are considered.

More specifically, in relation to the KPMG Isle of Man tax avoidance
scheme, publicly available court records show that it is through the
CRA’s efforts that the scheme was discovered. The CRA identified many
of the participants and continues to actively pursue the matter. The
CRA has also identified at least 10 additional tax structures on the
Isle of Man, and is auditing taxpayers in relation to these
structures.

To ensure tax fairness, the CRA commissioned an independent review in
March 2016 to determine if it had acted appropriately concerning KPMG
and its clients. In her review, Ms. Kimberley Brooks, Associate
Professor and former Dean of the Schulich School of Law at Dalhousie
University, examined the CRA’s operational processes and decisions in
relation to the KPMG offshore tax structure and its efforts to obtain
the names of all taxpayers participating in the scheme. Following this
review, the report, released on May 5, 2016, concluded that the CRA
had acted appropriately in its management of the KPMG Isle of Man
file. The report found that the series of compliance measures the CRA
took were in accordance with its policies and procedures. It was
concluded that the procedural actions taken on the KPMG file were
appropriate given the facts of this particular case and were
consistent with the treatment of taxpayers in similar situations. The
report concluded that actions by CRA employees were in accordance with
the CRA’s Code of Integrity and Professional Conduct. There was no
evidence of inappropriate interaction between KPMG and the CRA
employees involved in the case.

Under the CRA’s Code of Integrity and Professional Conduct, all CRA
employees are responsible for real, apparent, or potential conflicts
of interests between their current duties and any subsequent
employment outside of the CRA or the Public Service of Canada.
Consequences and corrective measures play an important role in
protecting the CRA’s integrity.

The CRA takes misconduct very seriously. The consequences of
misconduct depend on the gravity of the incident and its repercussions
on trust both within and outside of the CRA. Misconduct can result in
disciplinary measures up to dismissal.

All forms of tax evasion are illegal. The CRA manages the Informant
Leads Program, which handles leads received from the public regarding
cases of tax evasion across the country. This program, which
coordinates all the leads the CRA receives from informants, determines
whether there has been any non-compliance with tax law and ensures
that the information is examined and conveyed, if applicable, so that
compliance measures are taken. This program does not offer any reward
for tips received.

The new Offshore Tax Informant Program (OTIP) has also been put in
place. The OTIP offers financial compensation to individuals who
provide information related to major cases of offshore tax evasion
that lead to the collection of tax owing. As of December 31, 2016, the
OTIP had received 963 calls and 407 written submissions from possible
informants. Over 218 taxpayers are currently under audit based on
information the CRA received through the OTIP.

With a focus on the highest-risk sectors nationally and
internationally and an increased ability to gather information, the
CRA has the means to target taxpayers who try to hide their income.
For example, since January 2015, the CRA has been collecting
information on all international electronic funds transfers (EFTs) of
$10,000 or more ending or originating in Canada. It is also adopting a
proactive approach by focusing each year on four jurisdictions that
raise suspicion. For the Isle of Man, the CRA audited 3,000 EFTs
totalling $860 million over 12 months and involving approximately 800
taxpayers. Based on these audits, the CRA communicated with
approximately 350 individuals and 400 corporations and performed 60
audits.

In January 2017, I reaffirmed Canada’s important role as a leader for
tax authorities around the world in detecting the structures used for
aggressive tax planning and tax evasion. This is why Canada works
daily with the Joint International Tax Shelter Information Centre
(JITSIC), a network of tax administrations in over 35 countries. The
CRA participates in two expert groups within the JITSIC and leads the
working group on intermediaries and proponents. This ongoing
collaboration is a key component of the CRA’s work to develop strong
relationships with the international community, which will help it
refine the world-class tax system that benefits all Canadians.

The CRA is increasing its efforts and is seeing early signs of
success. Last year, the CRA recovered just under $13 billion as a
result of its audit activities on the domestic and offshore fronts.
Two-thirds of these recoveries are the result of its audit efforts
relating to large businesses and multinational companies.

But there is still much to do, and additional improvements and
investments are underway.

Tax cheats are having a harder and harder time hiding. Taxpayers who
choose to promote or participate in malicious and illegal tax
strategies must face the consequences of their actions. Canadians

Federal Finance Minister Bill Morneau will visit Fredericton this
weekend to discuss his government's proposed tax reforms with business
leaders from across the country during the Canadian Chamber of
Commerce's annual general meeting.

Krista Ross, CEO of the Fredericton chamber, said Morneau is expected
to make a presentation, then field questions from the room as part of
a question-and-answer session.

In a news conference to be held afterwards, she said, five local
business professionals will share their concerns about how the
proposed changes - which the government insists are designed to make
the taxation model more "fair" - could affect their operations.

She said she's grateful Morneau will attend the meeting to hear
directly from the Canadian business community.

"We're hopeful that he will be receptive to our comments," she said.

"So far, we haven't seen a lot of movement. We've been told that he's
looking at making some tweaks [to the proposed changes]. But we think
that, first of all, we need some more time to have a better
consultation."

Perrin Beatty, president and CEO of the Canadian Chamber of Commerce,
said it'll be an important opportunity to further debate these
potential changes.

 “We are grateful to Minister Morneau for taking time to speak to our
network about these proposed changes. In my 10 years at the chamber, I
have never seen an issue that generated greater concern among our
members,” he said in a news release.

Morneau has said the government is currently in "listening mode,"
hoping to gather feedback about the changes they've proposed.

He's said the proposal has been supported by a number of national
organizations, including the Canadian Labour Congress, the Canadian
Nurses Association, Canadians for Tax Fairness, the Canadian
Association of Social Workers, the Canadian Centre for Policy
Alternatives and the Broadbent Institute.

The current tax system allows someone earning $300,000 to use a
private corporation “to save about as much as the average Canadian
earns in a year,” Morneau wrote in a letter he sent to three National
Democratic Party MPs who had criticized the changes.

“This leads to situations where an incorporated doctor can be taxed at
a lower rate than a nurse practitioner or police officer.”

OTTAWA – Bill Morneau is scrambling to calm the fears of nervous
Liberal backbenchers who’ve been inundated with complaints about the
finance minister’s plan eliminate loopholes that give some wealthy
small business owners an unfair tax advantage.

The finance minister hosted an hour-long conference call Thursday with
Liberal MPs, aimed at listening to their concerns, giving them the
tools to counter what he considers rampant misinformation about his
plan and reassuring them that the government is open to adjusting the
proposals to avoid any unintended consequences.

That’s in addition to dozens of one-on-one calls Morneau and his staff
have been making in recent weeks to quell anxiety among government
caucus members.

The conference call came as Liberal MPs prepared to air their concerns
and push for changes to the proposals during a caucus retreat next
week in Kelowna, B.C.

And it came as opposition to the proposals intensified.

Some 35 organizations across the country representing doctors,
lawyers, farmers, financial planners, homebuilders, shop owners and
other incorporated small businesses came together Thursday to create
the Coalition for Small Business Tax Fairness – billed as “a unified
voice to oppose” the proposed tax changes.

“These proposals, while intended to target the wealthy, will hurt
middle-class business owners from every sector of the economy,” said
Dan Kelly, president of the Canadian Federation of Independent
Business, a member of the coalition.

“In ten years at the Canadian chamber, I’ve never seen an issue that
has generated greater concern among our members,” added Perrin Beatty,
president of the Canadian Chamber of Commerce, another coalition
member.

Amid that rhetoric, Morneau spokesman Daniel Lauzon confirmed that the
minister spent more than an hour Thursday on a conference call with
Liberal backbenchers.

“The purpose of the call was really for the minister to listen to his
colleagues, to dispel some myths and clearly state why the notion of
tax fairness and our promise to the middle class are really at the
heart of what we’re proposing here,” said Lauzon.

“And that was an important conversation to have, and an important
conversation to have ahead of Kelowna.”

The backlash has been building since mid-July, when Morneau released a
controversial, three-pronged plan aimed at closing tax loopholes used
by a growing number of small businesses, creating what he called an
“unfair playing field.”

One change would restrict the ability of business owners to lower
their tax rate by sprinkling income to family members in lower tax
brackets, even if those family members do no work for the business.
Another would limit the use of private corporations to make passive
investments in things like stocks or real estate.

The third change would limit the ability to convert a corporation’s
regular income into capital gains that are typically taxed at a lower
rate.

Among the myths Morneau is trying to dispel is the coalition’s
contention that his proposals will impact all small business owners,
two thirds of whom are middle-class Canadians earning less than
$73,000 per year.

Morneau contends the proposed change to passive investment income will
have negligible impact on anyone making less than $150,000 per year.

“Under this amount there is very little benefit from the loophole
because you could simply max out your RRSP and TFSA (tax free savings
account),” said Lauzon.

“But the more you make, the more you stand to benefit from these
loopholes, which effectively provide a tax sheltered account over and
above what is available to you, me and everyone else.”

Finance officials argue that closing the loophole will affect only
those small business owners who still have money to shelter from taxes
after they’ve maxed out their RRSPs and TFSAs each year – something
only three per cent of Canadians can afford to do.

That’s consistent, they maintain, with the Liberal government’s core
principle of making the wealthiest one per cent of Canadians pay more
so that taxes for the middle class can be reduced and services
increased.

Other “myths” include the argument – made by the coalition in a letter
Thursday to Morneau – that corporations use passive investments as
insurance against emergencies and unforeseen costs. Finance officials
say any money set aside for business purposes won’t be impacted by the
changes, which will apply only to investments made for personal
benefit by the business owner.

The coalition argues that the so-called loopholes are intended to
recognize the greater risks small business owners face, including
using their family homes as collateral against business loans and
having no access to unemployment insurance.

But Finance officials counter that those risks are recognized by a
host of other preferential tax measures afforded to small businesses,
including the lowest small business tax rate among G7 countries. The
intent, they say, was never to create an unlimited tax shelter for the
wealthy who incorporate their businesses.

Over the past 15 years, officials say the number of
Canadian-controlled private corporations has increased by 600,000, to
1.8 million, with many small business owners – particularly
professionals such as doctors – incorporating to take advantage of the
tax loopholes.

Finance Minister Bill Morneau is in Halifax today for his "listening
tour" about Ottawa's controversial tax proposals, drawing criticism
from some small business owners and concerns from Nova Scotia's
Liberal premier.

Morneau met with local small business owners at a library in downtown
Halifax, and said afterwards he heard concerns about the changes, but
also an understanding that a system is needed that is fair for all
Canadians.

He met later with Premier Stephen McNeil, who told reporters Friday
that he was concerned about the impact the tax changes could have on
health-care recruitment in a province already dealing with a family
doctor shortage.

"I've raised the issues that I've heard from Nova Scotians and I've
raised my concerns that I have with them as well around the impact I
believe it will have on our province," McNeil said at the Nova Scotia
Legislature.

financial one for the province. There's a much greater risk in my view
— looking at what will this do around health-care recruitment, doctors
and health-care providers."
Level playing field

Morneau's proposal has drawn complaints from doctors, lawyers, tax
planners and other small business owners who have used incorporation
to reduce their income tax burden.

But Morneau said the changes are meant to end tax advantages that some
wealthy business owners have unfairly exploited and to ensure all
Canadians have a level playing field.

McNeil said the status quo allows doctors to plan for their retirement
and is also an important tool for small business owners that allows
them to reinvest in their businesses or to weather a change in the
economy.

"It's an important tool that entrepreneurs need to have to be able to
do that, otherwise there's only one other avenue for them: to go try
to find leverage somewhere else from a lending institution and we
believe the mechanism in place has worked well for the province," said
McNeil.
'Could be catastrophic'

Doctors Nova Scotia, the association that represents all physicians in
the province, said the organization is "absolutely concerned" about
the changes and a meeting is being held in Halifax on Saturday with
about 300 doctors to discuss the issue.

Kevin Chapman, the association's director of partnerships and finance,
said the province gave doctors the right to incorporate in the
mid-1990s as a way of retaining and recruiting physicians "at a time
they were leaving the province in fairly significant numbers."

"The irony is not lost on us that what incorporation was intended to
do back in 1995, it will have the opposite effect if these changes go
through. It could be catastrophic," said Chapman, adding that 75 per
cent of the province's doctors are incorporated.

"Physicians can't raise the rates. They are bound by contract in terms
of what they can charge.… So they have no way to offset the reductions
they might feel from these tax changes. We're running the risk that
physicians will naturally migrate to other jurisdictions where they
can make up that lost earning — or they'll retire."
Restrictions on income sprinkling

Morneau first released the three-part tax plan in mid-July.

The tax proposals include restrictions on the ability of business
owners to reduce their tax rate by sprinkling their income to family
members in lower tax brackets, even if those family members do not
contribute to the company.

Morneau also proposed limits on the use of private corporations to
make passive investments that are unrelated to the company. Another
change would limit business owners' ability to convert regular income
of a corporation into capital gains, which are typically taxed at a
lower rate.

Morneau has said there is a lot of misinformation circulating about
the impacts of the proposals and Ottawa has been trying to bring
clarity to the debate.

The government launched a 75-day public consultation period in July,
which ends Oct. 2. Morneau has said he's listening to feedback about
the proposals and he's open to making changes, if necessary.
Is it a done deal?

Matthew MacKenzie was one of a handful of small business owners
invited to Friday's closed-door meeting in Halifax. He and his wife
own two companies: MacKenzie Atlantic Tool & Die and MacKenzie
Healthcare Technologies.

He said that while he agrees that it is unfair for business owners to
sprinkle income among their kids and parents, he does not agree that
it is unfair to split it with a spouse, given the added risk that
comes along with business ownership.

"The minister was quite clear that this is still a proposed
legislation, nothing is in stone and they are consulting. I don't know
if it truly felt like that today to me or to anybody else in that
room," said MacKenzie.

"I feel pretty strongly by the tone in the room and the tone by Mr.
Morneau that there are a lot of decisions that they've made that
they're going to stick to regardless of what concerns are made by the
general public or by business owners. Specifically, in relation to
income splitting."

Morneau takes his consultation tour to Fredericton on Saturday to the
Canadian Chamber of Commerce's annual general meeting.
