Convoy organizers try to quash $300 million lawsuit

Defendants also file for change of venue

The people facing a $300 million class-action lawsuit for organizing the 2022 convoy protests in Ottawa are attempting to have the case quashed altogether, or moved out of Canada's capital.

Lawyers representing convoy organizers Tamara Lich, Chris Barber and 10 other parties are preparing to argue the lawsuit should be dismissed because the legal action against them unduly limits their freedom of expression in a matter of public interest.

The lawyer representing Pat King, another convoy organizer, in the proceedings is intending on supporting the motion to have the case tossed. 

Known as an anti-Slapp motion, the matter is expected to be debated during a court hearing in October.

"What happened in Ottawa was a matter of expression, we had a lot of people who were obviously very upset with what was going on in 2022 and they were taking to the streets expressing themselves," said James Manson, the lawyer representing Lich, Barber and the others. 

"The lawsuit that was launched against my clients and everybody else does relate to expression, and it does relate to a matter of public interest of course, it was the COVID vaccine mandates and all of the government response to COVID," he said. 

Another motion will be argued after that: Lawyers representing other defendants, most of whom were heavily involved in managing and collecting donations during the convoy, say the court case should be moved out of Ottawa. 

It's not yet clear if they will support the other defendants' effort to have the matter thrown out altogether. 

The U.S.-based GiveSendGo, an online platform used to collect more than $12 million during the protests, its founder Jacob Wells and others who managed donations argue a fair trial can't be had in Ottawa. 

Their argument focuses on whether the number of Ottawa residents who may be included in the lawsuit or be potential witnesses in it is too many to hold a fair trial in the capital city. 

They intend on proposing the matter should be moved to Toronto and heard by a Superior Court of Justice there.

Paul Champ, the lawyer behind the proposed class-action suit, said he doubted either of the motions would be successful.

"The defendants, for whatever reasons, still don't seem to be taking it seriously," he said. "They're trying to do everything they can to slow it down."

Manson denies this being the case. 

"There is a huge backlog in our court system and I would never do anything to increase that backlog — I am not interested in creating delay for the sake of creating delay," he said, adding his duty to his clients is to ensure justice is done and if his motion is successful, the case would likely be tossed. 

The manoeuvres by the defendants delayed the process of the court deciding whether the class-action lawsuit will be certified and move forward.

Champ successfully defeated a proposed motion from the defendants earlier this year to have the matter dismissed altogether. 

He said the named plaintiffs on the lawsuit, including downtown Ottawa resident Zexi Li and Happy Goat Coffee Co., continue to push the case forward. 

In March, Champ added new defendants and expanded the geographic border to include more plaintiffs. 

Around 15,000 people are estimated to now be included in the action against the group facing the lawsuit. 

"We continue to be very committed to getting proper accountability for what happened here in Ottawa and as much as possible getting compensation for the people of Ottawa for all they suffered during the three weeks," he said.

Most of the $25 million raised during the convoy protests was either returned to donors or put into an escrow account that is being managed until the civil proceedings determine where the money should go. 

Approximately $18 million was refunded to donors. Most of the $6.3 million sitting in escrow came from online fundraising led by Lich or cryptocurrency donations. 

The Public Order Emergency Commission, the public inquiry tasked with looking into the federal government's use of the Emergencies Act during the protests, found only about $1 million was spent by convoy organizers. 

Criminal trials to come

Lich and Barber are scheduled for trial in September on criminal charges related to the protests that gridlocked downtown Ottawa for several weeks during the winter of 2022. 

The pair are co-accused of mischief, obstructing police, and counselling others to commit mischief and intimidation.

King's trial is scheduled for November and he is charged with mischief, counselling to commit mischief, counselling to disobey a court order and counselling to obstruct police. 

During his bail hearing he was charged with perjury and obstruction of justice and held in jail for five months before being released on bail. He's also requesting his criminal trial be moved out of Ottawa, saying he feels an Ottawa judge and jury would be too biased to offer a fair hearing.

Albertans are a generous and patriotic people, but the exploitive
nature of Canada’s fiscal federalism is turning many away from an
unquestioning salute of the maple leaf.

Since Canada’s centennial year in 1967, Alberta has contributed a net
$600 billion more to the rest of Canada than it has received back in
transfers and spending, despite our relatively small size.

Albertans make a net contribution of $15-27 billion in an average
year, over $3 billion of which goes toward the $20 billion
equalization program. Albertans pay another$3 billion (net) in the
Canada Health Transfer and Canada Social Transfer more than is
returned back to the province.

All in, the average family of four in Alberta pays $20,000 a year in
extra taxes that are sent directly to Quebec and other recipient
provinces, after being laundered in Ottawa.

Many Albertans may not have minded this kind of charity in good times,
but in tough times, Canada has not been there for Alberta beyond token
trinkets. When Alberta needs to build pipelines to tidewater in order
to keep producing the wealth that gets sent to others, many of those
others stand in the way.

Quebec – which receives more than $12 billion a year – has rejected
the construction of pipelines that would transport what its premier
calls “dirty oil” across her territory. The federal government – which
is supposed to be the guarantor of the free movement of goods,
services, and capital across all of Canada – has barely lifted a
finger. In fact, the Liberal, Conservative, NDP, and Bloc Quebecois
leaders have all promised voters in Quebec that no pipeline would be
constructed there without their support.

And what constitutes support? In British Columbia, the clear majority
of people support pipeline construction, but governments have kowtowed
to a vocal, radical minority.

This is because Alberta simply doesn’t matter politically. Our economy
is big enough to pay the bills, but our population is too small to
decide elections.

Alberta is underrepresented in the House of Commons and wildly
discriminated against in the Senate, where we hold almost half the
seats of tiny New Brunswick, but have twice the population of all four
Atlantic provinces combined. When we try to elect our own senators,
the federal government more often-than-not ignores the democratic will
of Albertans.

It’s time to fight back. The first big step in this is voting ‘yes’ to
remove equalization from the Canadian constitution on October 18. To
be clear, this will not actually result in the removal of equalization
from the constitution on October 19. What it will do, however, is
trigger a constitutional obligation on the part of the federal and
other provincial governments to negotiate the issue, as the Supreme
Court ruled in the Quebec Secession Reference case of 1998.

In that case, the court ruled that if a clear majority of Quebecers
voted ‘yes’ on a clear question of independence, then the rest of
Canada would be constitutionally obliged to negotiate in good faith.
Unspoken however, was the threat that in the event that the rest of
Canada did not negotiate in good faith, that Quebec could make a
unilateral declaration of independence; something that could only be
circumvented by a military invasion of the province and the forceful
deposition of its government; a prospect laughable in its
improbability.

Alberta is not voting on independence however. It is voting on
removing a confiscatory policy principle from the constitution. But
what unspoken threat does Alberta have if the rest of Canada fails to
negotiate in good faith? As yet, there is none. The Alberta government
has pre-emptively taken more dramatic options off the table. This is a
mistake.

There are several organizations across Alberta that have done
excellent work making the case for abolition, reform, and
alternatives, including Fairness Alberta, the Alberta Institute,
Project Confederation, the Canadian Taxpayers Federation,
FightEqualization.ca, and others.

Missing in the campaign was Alberta Premier Jason Kenney. He has
wisely decided to keep a low profile, knowing that his unpopularity
could jeopardize a successful ‘yes’ vote. While some Albertans may
wish to send the premier a message by voting ‘no’ to what they
perceive as his pet project, this would be a grievous error. It would
be cutting off our nose to spite our face.

The project of an equalization referendum goes back well before Kenney
even considered going into provincial politics, to a report from the
old Wildrose Party’s Equalization Fairness Panel in 2016.

There are positive signs that Albertans are putting the fight for a
fair deal above partisan politics. A Mainstreet Research poll
conducted for the Western Standard found that a 66% majority of
Albertans intend to vote ‘yes’ on October 18. That poll saw that a
majority in every region of Alberta – Edmonton, Calgary, rural north,
and rural south – all intend to cast a ballot for change to the status
quo. And while a majority of NDP voters intend to vote for the status
quo, a sizeable minority of them intend to break ranks and vote with
the rest of Alberta.

A big ‘yes’ vote to kill equalization will not end those payments
overnight, and frankly, they are unlikely to yield any reform
whatsoever without a clear “or else” option for Ottawa and Quebec to
ponder; but without it, we are endorsing the status quo of an
exploitative federal system that is unworthy of Canada’s history.

On October 18, we encourage Albertans to send Ottawa a message. On
October 19, we encourage Albertans to make sure that our provincial
government doesn’t let Ottawa forget it.

In addition to the new, sleeker layout, it includes a significantly
more advanced and secure membership/subscriptions system. Of course,
this requires us to transition your membership, and that transition
can have some hiccups. But to ensure we make this as painless as
possible, we've hired extra staff in our Membership Services
Department to help you.

In order to keep your information safe and secure, we do not store
your password, so in order to activate your membership on the new
website, you need to reset your password. Renewing your membership on
the new website has no extra cost, and will automatically cancel your
old one.

Return of the Alberta Report & other new WS publications

Now to the fun stuff. The new Western Standard website has several
sub-sections for our new publications. These new publications are all
hosted at the new Western Standard website, but each one will focus on
your own province. And don't worry, your Western Standard membership
gives you unlimited access to all of them.

The most anticipated of these is the return of the legendary Alberta
Report. The Alberta Report was far and away the most influential news
and opinion magazine in Alberta from its beginnings in the 1970s until
it finally closed in 2003, after which it was replaced by the original
Western Standard's print magazine. And just as we brought the old
Western Standard magazine back to life as a digital publication, we
are proud to return the Alberta Report to you online.

But we are the "Western" Standard, not just the Alberta Standard.
That's why we've also launched the West Coast Standard for British
Columbians, the Saskatchewan Standard, the Manitoba Standard, and even
(dare I say) the Ontario Standard. This will provide a homegrown
source of independent media with a focus on your province that won't
clutter your news feed with local city hall news from places you may
not care much about.

We have radically expanded the size of our staff, bringing full-time
reporters to new bureaus across Canada.

In Edmonton, we have hired Rachel Emmanuel as our new Alberta
Legislative Bureau Chief. In Ottawa, we hired Matthew Horwood as our
new Parliamentary Bureau Chief. In Regina, we brought on Christopher
Oldcorn as our Saskatchewan Reporter. Also joining the team are

In our Opinion and Broadcast Division we have also upped our game. We
have brought on David Krayden as our new senior parliamentary
columnist.

The prosecution agrees to provide evidence and a witness list after
Lich brings a motion for particulars.

TORONTO: Tamara Lich's lawyer appeared before the Ontario Court of
Justice Tuesday seeking particulars of the alleged crimes committed by
his client during the Freedom Convoy protests. The motion concluded
with the prosecution agreeing to provide a full list of witnesses and
evidence by August 1, 2023.

The concept of particulars is similar to but distinct from disclosure.
TDF's litigation director, Alan Honner, explains: "The prosecution has
a duty to fully disclose all relevant evidence to the accused, but
particulars need only be disclosed if a judge is satisfied that it is
necessary for a fair trial." According to Honner, particulars might be
ordered where a crime can be committed in different ways, where
disclosure is broad, or where there are multiple co-accused.

Tamara's defence is being crowd-funded by The Democracy Fund. She has
retained Lawrence Greenspon, who is one of the best-respected lawyers
in Ottawa. Her trial is expected to last three weeks and is scheduled
to begin in Ottawa on September 5, 2023.

As Emergencies Act report tabled, key witnesses have moved on

As the Public Order Emergency Commission (POEC) prepares to release
its highly anticipated report into last winter's convoy protests, many
of the witnesses from the City of Ottawa and the Ottawa Police Service
who testified last fall have either left or moved to new roles.

On Thursday, the commission announced it would make its final report
public later today after tabling it in Parliament.

The Canadian Press reported the commission had requested, and been
granted, an extension to the original Feb. 6 deadline for submitting
its final report to the government.

The deadline for tabling the report in Parliament — Feb. 20 — remained
intact, however. That meant the commission's findings and
recommendations had to be made public no later than Monday, the Family
Day statutory holiday in Ontario.

(The timeline set out by the Emergencies Act requires that the report
be submitted to Parliament and released to the public within 360 days
of the emergency declaration being revoked, which occurred on Feb. 23,
2022.)

Mayor, councillors gone

The commission heard from 76 witnesses over six weeks of public
testimony, from Oct. 14 until the prime minister's appearance on Nov.
25. Of those, seven were either elected officials or senior
bureaucrats with the City of Ottawa, and five more were senior members
of the Ottawa Police Service (OPS).

None of the elected officials from the city who testified — former
mayor Jim Watson, former councillor and police services board chair
Diane Deans, and former councillors Mathieu Fleury and Catherine
McKenney — remains in office. Of those, only McKenney ran for
re-election last fall, but failed in their bid to become mayor.

Of the other city officials who testified, only Kim Ayotte, Ottawa's
general manager of emergency and protective services, remains in the
same job.

Former city manager Steve Kanellakos, who testified about his efforts
to broker a deal between police and the protesters, resigned amid
controversy on Nov. 28, just two days before the release of a damning
report on Ottawa's troubled LRT project.

All 5 OPS witnesses remain

All five senior members of the Ottawa Police Service who testified
before the commission last fall remain, though most have changed jobs.
(This doesn't include former chief Peter Sloly, who resigned during
the occupation of Ottawa by convoy protesters, and who had been out of
policing for more than eight months by the time he testified before
the commission in late October.)

Steve Bell, who was named interim chief after Sloly's resignation, and
who oversaw the eventual dispersal of the protest in Ottawa, is now a
deputy chief and chief administrative officer of the OPS. At the time
of the convoy's arrival in Ottawa, Bell was in charge of intelligence,
information and investigation for the force.

Patricia Ferguson, who testified to the deep "dysfunction" at the top
of the OPS, and said the force was left "floundering" when protesters
failed to leave the capital after the first weekend, remains acting
deputy chief.

Russell Lucas, an inspector with the police service's special events
section during the protests, is currently an acting superintendent,
according to an update provided by the OPS on Thursday.

Supt. Robert Bernier, an inspector within the force's communications
branch who was appointed event commander during the occupation, is
also listed by the OPS as an acting superintendent.

Supt. Robert Drummond, who was tasked with overseeing the police
liaison team that negotiated with protest leaders and the public order
unit that eventually helped end the occupation, also maintains that
rank. (Drummond was in an acting role at the time of his testimony
last fall.)

'Multiple points of failure'

In an email to CBC, Paul Champ, a lawyer who represented downtown
residents and businesses during the Emergencies Act inquiry, noted the
commission heard "extensive evidence of multiple points of failure" by
both government officials and police.

"Even though many of those responsible have left the stage, the POEC
report will memorialize those mistakes and serve as a guide for public
officials going forward. I would also like to see some apologies by
the police, the city and the province, but that's probably asking too
much," Champ wrote.

He said he also hopes to see the report provide some guidance "about
the oversight and direction the Ottawa Police Services Board can have
over the Ottawa Police Service."

Journalists covering the inquiry will be allowed to peruse an
embargoed version of the report starting at 10 a.m. ET. The embargo
will be lifted once the report is tabled in Parliament.

Commissioner Paul Rouleau will also read a prepared statement, which
will be streamed live on the commission's website, where the full
report will be made available to the public.
