Broader review of SPCA Act also on government's 'radar,' minister responsible for animal protection says
New Brunswick will look into making the licensing of horses a requirement, in the wake of 14 dead horses being found at a farm in the greater Stanley area over the holiday weekend, says the minister responsible for animal protection.
A broader review of the New Brunswick Society for the Prevention of Cruelty to Animals Act is also on the government's radar, said Daniel Allain, minister of Local Government and Local Governance Reform.
He made the comments in the legislature Wednesday during the standing committee on estimates, amid questions by Liberal critic Jacques LeBlanc, the MLA for Shediac-Beaubassin-Cap-Pelé.
LeBlanc described the case as heartbreaking.
It's the largest number of dead horses in the province's history, according to the New Brunswick SPCA's chief animal protection officer.
An additional five adult horses in poor health were also discovered roaming loose on the property, and are in foster care.
"It seems that livestock for agricultural purpose is tracked, but not livestock used for recreational purposes," said LeBlanc.
He asked if the province would consider making horse licensing mandatory.

Allain called the suggestion great and said he will consult with the Department of Agriculture, Fisheries and Aquaculture and the NBSPCA.

Animal protection 'very hot right now'
LeBlanc noted the act has not undergone a "significant review for some time," and asked whether the minister would commit to one.
Allain said he "100 per cent" agrees a review is needed, given the last one was around 2010.
"At this juncture, we're still not there yet," he said, citing resources stretched by reforms.
A review is, however, one of his department's priorities, he assured.
The animal protection file is "very hot right now," said Allain.
$400K increase to SPCA as cruelty cases rise
New Brunswick has seen a steady increase in the number of animal cruelty investigations in the past few years, he said, particularly during the COVID-19 pandemic.
As a result, the government has increased the SPCA's funding to $500,000, from $100,000, he said.
That's on top of about $343,000 the government provided in November.

The extra money is needed to ensure the SPCA's "long-term stability and effectiveness as the enforcement agency," said Allain.
"We just want to make sure that we're there to help the different organizations who advocate on behalf of animals and try to prevent animal cruelty in our province."
More protection officers, MOU expected
Allain anticipates some of the money will be used to increase the number of animal protection officers to help with enforcement, which he described as a "key component of animal protection."
The SPCA currently has 16 animals protection officers, he said.
The additional positions are part of ongoing negotiations with the SPCA, said Allain, with a memorandum of understanding to ensure accountability expected to be signed by next week and announced in Woodstock.
SPCA executive director Lesley Rogers did not respond Thursday to a request for an interview.
But earlier this week she told CBC the SPCA responded to more than 2,000 complaints last year, and took into care and rehomed more than 500 animals.
"So we act when we need to, and we have to work through the court process as you can appreciate," she said.
Allain said he gets regular updates from the SPCA, usually about 10 emails a month, closer to 20 in recent weeks.
"It's not easy sometimes to divulge all the information on a certain file," due to privacy reasons, he said. "But I can attest to you … the NBSPCA is definitely doing their job."
Safety of animals is priority
LeBlanc asked specifically what actions animal protection officers can take if standards of care for animals, such as shelter requirements and teetering are not being followed.
Allain said they have several tools. Among them, they can issue orders, seize animals, and lay charges through the Department of Justice and Public Safety.
They have discretion, depending on the severity of the situation, he said, but usually start by having a conversation with the owner to ensure compliance.

The New Brunswick SPCA is investigating the largest number of dead horses in the province's history, according to the chief animal protection officer.
Fourteen dead horses were discovered at a farm in the greater Stanley area over the holiday weekend, the SPCA announced on social media last Friday.
"It's one thing to have one deceased animal, but when you have several, it's a major concern for us, because we haven't come across this situation — fortunately, we haven't come across it — in the past in this province that we found so many dead ones all in one spot," Tony Porter told CBC in an interview Monday.
An additional five adult horses in poor health were also discovered loose on the property. They are in foster care and receiving medical care after being assessed by a veterinarian.
Porter declined to disclose many details, including the address of the property in question, citing privacy and the ongoing investigation, but did say this was the first time the SPCA received a report concerning animal welfare at that location.
"I do realize it's frustrating to the public … but unfortunately it's the same as any police investigation. There's only so much you can release."
No cause of death yet
He described the investigation as "very complex" and expects it will take "a few weeks" to complete.
"We have to make sure we get all the details right, so we don't rush anything."
It's too soon to say if charges are anticipated, said Porter, noting the causes of death have not yet been confirmed.
There are "a lot of details here that we have to get to the bottom of in order to pursue this in an effective manner," he said
"We're doing everything we can to ensure this investigation, at the end of it, is completed and done in an effective way so this will not happen again."
Dog and 'a few' cats healthy
Other pets found at the location include at least one dog and "a few" cats, said Porter. They're all healthy and being cared for daily, he said.
Asked whether the SPCA or the owner arranged that care, Porter said it was already in place before officers arrived.
Those animals are not the subject of the investigation, said executive director Lesley Rogers.
Owners urged to seek help with care
She encourages anyone who is unable to care for their animals to reach out to their veterinarian, family members or others for help. There are many options, she said.
For domestic animals, they can contact their local shelter, said Rogers. "Often they have program to help support pet owners, such as kibble banks, can facilitate private adoptions or will accept surrendered pets to be re-homed."
They can also contact specific breed or species associations to ask for support or assistance, said Rogers. "Many associations or pet owner groups are able to help in times of difficulty or emergencies."
In addition, the NBSPCA can help them reach organizations appropriate to their specific situation, Rogers said.

Animal welfare case involves largest number of dead horses in the province's history, protection officer says
A woman from the greater Stanley area is facing three criminal charges in connection with the discovery of 14 dead horses at a farm in April, says the New Brunswick SPCA.
It was the largest number of dead horses in the province's history, the SPCA's chief animal protection officer, Tony Porter, told CBC at the time.
An additional five adult horses in poor health were also discovered loose on the property and required medical care.
The woman is scheduled to appear in Fredericton provincial court "early next month," according to a news release issued by the organization Thursday.
The three charges she faces all relate to animal welfare, said Porter. They include injuring or endangering animals, cruelty to animals by causing unnecessary suffering, and causing damage or injury, he said.
Possible penalties range from a fine to prison
Under the Criminal Code, anyone who, "wilfully and without lawful excuse, kills, maims, wounds, poisons or injures dogs, birds or animals that are kept for a lawful purpose" commits an offence.
Anyone who "wilfully causes or, being the owner, wilfully permits to be caused unnecessary pain, suffering or injury to an animal or a bird" also commits an offence.
And any owner or person who has custody or control of a domestic animal or a bird or an animal or a bird wild by nature that is in captivity, and "abandons it in distress or wilfully neglects or fails to provide suitable and adequate food, water, shelter and care for it" commits an offence.
Possible penalties for each charge range from a fine of $10,000 to up to five years in prison, depending whether the prosecution proceeds by way of more serious indictable offences, or less serious summary ones, according to the code.
Porter declined further comment.
He previously described the investigation as very complex and expected it to take a few weeks.
This was the first time the SPCA received a report concerning animal welfare at the undisclosed location, he had said.
The causes of the horse deaths have not been released.
The five ailing horses were put into foster care at the time.
Other pets found on the property included at least one dog and a few cats, all healthy and being cared for daily, Porter had said.
