Pat King’s courtroom drama differs from Tamara Lich and Chris Barber’s

The three of them once stood side-by-side as road captains of a historic protest.

Now, more than two years after thousands of honking vehicles rolled through Ottawa in what became known as the Freedom Convoy, two narratives are emerging in court — potentially splitting the fates of Pat King, Tamara Lich and Chris Barber.

Factually, they are separate cases. King is being tried alone, whereas Lich and Barber are co-accused in their trial.

And while the two trials share many similarities, including the nature of the charges and some of the fundamental legal arguments being mounted, they've also played out in markedly different ways.

Whereas the joint trial of Lich and Barber drags on, punctuated by starts and stops that have forced the duo to make multiple trips back to Ottawa, the case involving King is more or less running smoothly and on schedule.

Key to both trials is less about what Lich, Barber and King did. The evidence, particularly the statements they made in early 2022, were well-documented on social media and are largely self-explanatory.

At issue instead is the legality of each of their actions. And in both trials, the Crown argues they crossed the line.

But how prosecutors go about making that argument — and how they've been countered by the defence teams — has varied between the two trials.

Underpinning those differences is the fact that one case is better funded, more closely scrutinized and arguably more symbolic than the other. 

For many convoy supporters, the case against Lich and Barber is about ideas — that the government, in their view, is trying to persecute an entire movement after already trampling the constitutional rights of Canadians when it invoked the Emergencies Act and arrested more than 200 people.

It's why Lich and Barber's defence has the backing of two high-profile civil liberties groups: The Democracy Fund (TDF) and the Justice Centre for Constitutional Freedoms (JFFC).

Meanwhile King, a more polarizing figure, is largely left to fight his own battle. 

His following on social media, some 334,000 strong, is nothing to sneeze at. But among sympathizers, his case is generally seen more as the plight of a single individual. 

As such, it's playing out more like the countless other misdemeanor-type trials unfolding in courtrooms across the country.

Prosecutor recused himself

Lich and Barber are pleading not guilty to charges of mischief, intimidation and offences related to counselling others to break the law during the massive protests that engulfed downtown streets for more than three weeks in 2022.

One month before the trial was set to begin in August 2023, the lead Crown prosecutor assigned to the case, Moiz Karimjee, recused himself.

According to materials filed in court, Karimjee did so after reading Lich's memoir for trial preparation, which contained "60 references to Moiz Karimjee by name, some of them defamatory."

If Karimjee prosecuted the case, it could have presented a conflict down the line were he to pursue any legal action against Lich.

Tim Radcliffe and his co-counsel were then handed the file, with a little less than a month to prepare for what would be a highly-publicized trial. 

And they would have to face off against two of Ottawa's most formidable defence attorneys.

Lawrence Greenspon and Diane Magas — each with at least one additional lawyer accompanying them in court — are both veterans of Ontario courts with extensive experience across the justice spectrum.

They've been supported by fundraisers and donations, much of which continue to be funnelled through TDF and JCCF, entities with deep ties to libertarian and right-wing causes.

Lich, Barber trial slowed by delays

It's been apparent throughout the trial that there would be delays and multiple hiccups for the Crown to overcome.

The trial has extended far beyond the 16 days initially allotted, requiring Lich and Barber to travel back to Ottawa at least four times from Medicine Hat, Alta., and Swift Current, Sask., respectively since the fall.

In opening statements, prosecutors argued Barber and Lich had committed crimes, trying to establish the two as leaders who used their control and influence over supporters to break the law. 

But this hinged on the premise that the protests were not at all peaceful – an assertion which prosecutors spent the early days trying to establish through videos, social media posts, police and witness testimonies. 

Highlights include Lich's use of the infamous "hold the line" catchphrase, and Barber's exhortations to his audience to "grab that horn switch" and "let it roll as long as possible" if police tried to dislodge them.

Objections became regular occurrences, however, as lawyers for Barber and Lich tried to poke holes in the Crown's case at every turn — even picking apart choices like using the word "occupation" to describe what happened.

They attempted to show another side of the convoy: a downtown core filled with peace, love and unity — bouncy castles, pig roasts, street hockey and all.

Still, the trial soon became less about the arguments inside the courtroom and more about the stops-and-starts of the process itself.

The defence would file applications to block witnesses, to access additional disclosure, to prevent specific social media evidence from being used and to access third-party records. They found success in some instances. Other efforts were abandoned.

All of it took up valuable court time, gumming up the Crown's efforts to make a clear and concise argument against Barber and Lich.

Through it all, Justice Heather Perkins-McVey has shown a willingness to take great strides to ensure the proceedings are fair. She's been amenable to at least hearing out anything the defence brings up, including the early spectre of the whole case being tossed for delays.

It's likely being done to leave little room for future appeals.

And still, one of the most contentious aspects of this trial remains to be settled. It concerns whether Lich and Barber acted as "co-conspirators," a complicating factor that makes the trial of Pat King seem simple by comparison.

King trial on track

King, from Red Deer, Alta., is facing charges of mischief, intimidation, obstructing police, disobeying a court order and other offences for his role in the protest. He has pleaded not guilty to all nine charges.

To pay for his defence, King held a motorcycle rally and sought permission from court prior to his trial to host online fundraisers.

Unlike Lich and Barber, he is not bankrolled by any well-mobilized organization and does not have the resources to afford a long, drawn-out court case.

Nevertheless, he's found an experienced lead counsel in Natasha Calvinho, a familiar face around the Ottawa Courthouse with a reputation for being a strong orator.

Calvinho sought more time last November to review the disclosure she had received from the Crown, which pushed King's trial to May of this year and made him opt for a judge-alone trial to move it along. It was a sign that, with fewer resources available, she would be hard-pressed at times.

On several occasions, she has turned to X, the online platform formerly known as Twitter, to solicit evidence from the public, seemingly reacting to the Crown's case on the fly.

The lead prosecutor in King's trial is none other than Karimjee, the lawyer who recused himself from Lich and Barber's trial.

Within the first two weeks, Karimjee and his co-counsel walked the court through nearly 40 videos of King, marking a significant change in speed at which this case would go.

Like in the Lich-Barber trial, the Crown is trying to establish King as a leader of the protests who used his control and influence to commit many of the crimes he is accused of. 

Videos seen in the judge-alone trial include declarations by King he had no intention of leaving the city, even after the federal government called in the RCMP.

"We'll leave when we get the mandates lifted," King said in one such video.

Several Ottawa residents have also testified, with few interruptions. That's allowed the Crown to build a cogent argument that King had intentionally rounded up trucks to clog up downtown and encouraged drivers to honk their horns and disobey police orders to leave. 

The defence has pushed back with a different narrative of King's character and actions, but Calvinho never once filed any application to block evidence or alter court proceedings. 

All of this means the Crown was able to wrap up its case within nine days, about a third of the time it took prosecutors in Lich and Barber's trial.

Trials diverging further

The two convoy trials are now technically in the same stage, with the Crown having completed their turn calling witnesses.

However, while testimony is expected to continue in one trial, the other is slated to go straight to closing arguments.

Lich and Barber's lawyers are forgoing their turn to call evidence and witnesses. After devoting considerable energy to objecting the Crown's argument at every turn, the defence team seemed confident in deciding to skip ahead to the final round.

"We've reviewed the evidence that's been tendered by the Crown. It's been all subject to cross-examination," Greenspon said in March. 

"We're of the view that there's nothing that really needs to be added or that should be added by the defence to the body of evidence that the Crown has presented."

By contrast, King's lawyer is expected to call a few witnesses, including at least two controversial convoy participants whose testimonies will undoubtedly fall under scrutiny during cross-examinations.

The potential outcomes of the two trials might also look quite different. 

In King's case, the Crown has been more outspoken in asserting it wants a roughly five-year sentence for the 46-year-old.

Originally co-accused alongside Tyson "Freedom George" Billings, King went to trial while Billings took a plea deal. Signage around the courthouse still reads "Kings/Billings", but King's co-accused pled out, had charges withdrawn and got time served after being jailed for four months.

When it comes to Lich and Barber, prosecutors have stayed mum, leaving the door open for a reduced sentence for time served in the event of a conviction.

Looming over Lich and Barber's case, too, is another technicality that could derail the entire thing. 

Under what's known as a Jordan application, trials must be heard within an established timeline from when charges are laid.

The spectre of the Lich-Barber case being tossed altogether because of court delays is unlikely, but a real one.

Regardless of what happens, Lich and Barber will have more capacity — some might even call luxury — to continue their fight. After all, they're perceived by their financial and moral backers as victims of constitutional rights abuses.

Whereas King's case could potentially wrap ahead of summer, final submissions for the Lich-Barber trial are scheduled for mid-August.

The prosecution agrees to provide evidence and a witness list after
Lich brings a motion for particulars.

TORONTO: Tamara Lich's lawyer appeared before the Ontario Court of
Justice Tuesday seeking particulars of the alleged crimes committed by
his client during the Freedom Convoy protests. The motion concluded
with the prosecution agreeing to provide a full list of witnesses and
evidence by August 1, 2023.

The concept of particulars is similar to but distinct from disclosure.
TDF's litigation director, Alan Honner, explains: "The prosecution has
a duty to fully disclose all relevant evidence to the accused, but
particulars need only be disclosed if a judge is satisfied that it is
necessary for a fair trial." According to Honner, particulars might be
ordered where a crime can be committed in different ways, where
disclosure is broad, or where there are multiple co-accused.

Tamara's defence is being crowd-funded by The Democracy Fund. She has
retained Lawrence Greenspon, who is one of the best-respected lawyers
in Ottawa. Her trial is expected to last three weeks and is scheduled
to begin in Ottawa on September 5, 2023.

An Ottawa police officer responsible for engaging with protesters attending what became the 2022 Freedom Convoy described crowds that were at times "hostile" and "confrontational" during the criminal trial of one of the protest's key figures, Pat King.

But the officer told the court he didn't know what the Ottawa Police Service's "end game" was until protesters were entrenched — and only a few days before law enforcement started moving to arrest supporters of the convoy in a major police action on Feb.18, 2022.

King pleaded not guilty to mischief, intimidation and seven other charges in relation to his role in the protests that gridlocked large swaths of the nation's capital. 

During the second week of trial, acting Sgt. Jordan Blonde said a team of police liaison officers acting as a conduit between authorities and protesters tried using a "measured approach" to warn protesters to go.

Police unable to enforce laws

His team was given messaging to do this from senior officers beginning on Feb. 15, the same day Ottawa Police Service former chief Peter Sloly resigned.

Blonde told the court prior to that date, police officers didn't have any consequences to detail to protesters who had chosen to stay in the city — despite state of emergency declarations by the city, province and, eventually, on Feb. 14, the use of the Emergencies Act by the federal government.

He said there was a "myriad of laws being broken" by people drinking alcohol openly, blocking streets, having open fires and other illegal activities but admitted to not seeing any tickets issued, arrests made or trucks towed until after the police operation began on Feb. 18.

"A great number of things couldn't be enforced. It was a safety issue," he said. 

Blonde described how a "great number of people didn't want" to receive notices being distributed by him and other officers between Feb. 15 to 17 telling protesters to leave.

During one delivery of flyers with a message from police, on Feb. 16, he said the "crowd was quite agitated and upset," "very hostile," and "quite confrontational."

He said generally the crowds were not acting this way, but the delivering of that police messaging caused hostility.

On Feb. 17, police again tried delivering a warning to protesters, but they were unable to continue after being surrounded by people screaming and yelling near the intersection of Wellington Avenue and Metcalfe Street.

Blonde said his team of police liaison officers left the area because they just "didn't feel safe," and it was one of only a few times in his experience as an officer where he felt his safety was at risk. 

He said several protesters were indicating they weren't leaving, and had resolved to be arrested. 

Blonde, who never interacted with King, agreed there were multiple convoys that had travelled to Ottawa to attend the protests. 

He told the court he recognized there were several different groups and factions involved in the protests, but considered the broader protest as a whole to be part of the Freedom Convoy.

Crown arguing King used control, influence to break laws

Throughout its submissions, Crown prosecutors have used social media videos and other evidence to argue King should be found guilty when a judgment is delivered by Superior Court Justice Charles Hackland. 

Crown prosecutors are arguing King was a leader of the protest and used his influence to counsel others to break the law. 

They say he was directly involved in organizing a slow roll at the Ottawa airport and had encouraged others to take part in the crime of mischief, in part by telling them to continue honking their horns.

King tells supporters to "get to Ottawa" and to "honk those horns, let the heavens hear you" in a Feb. 8 video, one day after the a judge granted an injunction against the use of horns.

Police directed protesters, failed residents

King's lawyer, Natasha Calvinho, entered as evidence detailed maps provided by Ottawa police to protesters on how to navigate the city's core to park in "staging areas" throughout it. 

Shared with protesters travelling to the city prior to their late-January arrival, the map directed the trucks downtown and instructed them to keep emergency lanes open, prevent closed trailers from being parked on Wellington Street or near Parliament, and how many types of different vehicles could fit where in Ottawa's core. 

Calvinho is trying to demonstrate King was not a leader of the Freedom Convoy and protesters, and residents, were failed by police and city officials in the midst of a legal protest. 

She pointed to a plan, called off by police, to remove trucks from residential areas and closer to the downtown core prior to the police action commencing. 

She also argued there was mixed messaging over whether people were able to leave with their vehicles on their own after police started enforcement efforts, and no plans or maps were ever provided to protesters on how best to exit the city.

Blonde agreed with her that police made it difficult for many protesters to leave with their vehicles starting on Feb. 15. But under re-examination by prosecutors, Blonde confirmed given the situation, vehicles could have been weaponized. 

The Public Order Emergency Commission (POEC) that looked into the federal government's use of the Emergencies Act found there were "several deficiencies" in the failure to how police responded. It found there were avoidable communications failures that "undermined" the Ottawa police's response to the protests.

King told supporters to respect police

During proceedings on Wednesday, Calvinho said it was "all about context" in showing videos of Pat King helping clear emergency lanes, encouraging supporters to respect police officers and showing off a quiet downtown Ottawa.

Calvinho introduced videos of King and other protesters in a more positive light during the protests in January and February 2022. 

In a video made on Feb. 16, 2022, King tells a group of protesters encircling police to "leave them alone" because they have a "job to do." 

"Do not engage, come on, back off," he yells to a group, who comply and break out into chants of "freedom" and singing, "Oh Canada." 

In the same video posted online, King tells the group assembled not to get agitated by police. 

A video from Feb. 7 features King walking down Wellington Street near Parliament Hill showing off no horns being honked, telling his roughly 300,000 followers the protesters had given City of Ottawa officials and police an "olive branch." 

"We stopped all the honking," he says. 

The temporary injunction against honking was granted by a Superior Court of Justice the same day the video was made.

King encourages Prime Minister Justin Trudeau to meet with the protesters and not to be a "chicken." 

"This was never about a vaccine," he said. "It was always about control."

Prosecutors are expected to close their submissions by the end of the week. 

The officer who arrested King on Feb. 18 is expected to testify Friday. 

King's defence is expected to begin submissions by calling Daniel Bulford, a former RCMP officer who was a key figure of the protests, as its first witness.

In videos taken from Pat King's social media and shown in court on day five of his criminal trial, the key figure in what became the Freedom Convoy urges supporters not to leave Ottawa and asks law enforcement to "stand down."

King, from Red Deer, Alta., is facing charges of mischief, intimidation, obstructing police, disobeying a court order and other offences for his role in the protest that gridlocked downtown for nearly a month in early 2022. King has pleaded not guilty to nine charges.

Over three days of testimony, a criminal intelligence analyst walked through videos taken from King's social media during the protests, now being used as evidence against him by Crown prosecutors. 

In a Feb. 9 video, King tells supporters to contact him if they need cash and asks people in Ottawa with big rig trucks to meet him the next morning. On Feb. 10, King and other protesters circled the Ottawa International Airport for about two hours. 

In the same video, he says this was approved by "higher ups" and that there were several logistics experts helping the protesters. He then says he is just a "social media guy" before winking at the camera three times. 

'Nobody is going anywhere'

Prosecutors are arguing King was a leader of the protests who used his control and influence to commit many of the crimes he is accused of. 

King rejects this, and his lawyer Natasha Calvinho is arguing he was not a leader. She pointed to instances in videos shown where King references being asked to complete tasks and taking "clear orders" from others. 

In other videos shown in court, King says he "cannot leave Ottawa and none of these trucks are leaving Ottawa." 

Crown prosecutor Moiz Karimjee argues statements like this, when taken in full, are a declaration that King would not leave the city despite being told by police and authorities to do so. 

In a Feb. 14 video made the same day the federal government invoked the Emergencies Act, King states: "Nobody is going anywhere," and continues to stress the protest was a peaceful one. 

"Hold the line, stand your ground, don't go anywhere," he told his supporters.

Two days later, on Feb. 16, King posted a video of him in downtown Ottawa sharing similar sentiments of not going anywhere: "We'll leave when we get the mandates lifted." 

Following the Feb. 17 arrests of convoy organizers Tamara Lich and Chris Barber, who are also facing criminal charges, King made videos for each encouraging supporters to honk their horns for five minutes in support of them. 

In one of those videos, he also tells supporters to park on Highway 417 and walk into downtown Ottawa if that's what they need to do to get there, and says he is working to ensure supply lines for the truckers will continue to flow.  

'Love and peace'

King posted frequently and regularly on social media during the protests to an audience of more than 300,000 followers. 

During her submissions, Calvinho pointed to sections of the videos introduced by the Crown where King tells supporters to continue being peaceful and encourages them to stop harassing certain individuals including a tow truck driver who was asked to help remove a structure from Confederation Park.

Calvinho argues the Crown is attempting to paint King with a certain brush, and the fuller picture is important to consider.

Superior Court Justice Charles Hackland, who's overseeing the judge-alone trial, said he could see generally how there was some effort by King to mitigate some issues arising during the convoy. 

In a Feb. 16 video, King tries appealing to law enforcement, telling them to "stand down from your orders." He tells them to "back off, stand down, put your badge down and stand with the people." 

Calvinho argues the theme of the video is "love and peace."

More video evidence expected

In a Feb. 17 video posted by King, he tells supporters he didn't want a riot and to remain peaceful, and encourages those who want to leave where to go to regroup. 

"Mr. King indicates there are options, he indicates options for people to get out of Ottawa if they choose to leave," Calvinho said. "It really does show it was more about: get out, regroup, this is what you can do and we have options. It wasn't, 'Dig in, stand your ground.'" 

King was arrested Feb. 18, the day of a major police operation to clear Ottawa streets. He remained in jail for five months before being released on bail. 

His trial is sitting for three non-consecutive weeks and is expected to end later in the summer. More video evidence is expected to be introduced by King's lawyer when the trial continues Wednesday.

The third day of trial for a key figure in what became the Freedom Convoy continued Thursday with prosecutors showing videos from his social media feed for the first time. 

Pat King has pleaded not guilty to nine charges, including mischief and intimidation of police, for his role in the 2022 protest that took over downtown Ottawa for several weeks. 

In one video, King describes co-ordinating the placement of trucks and laughs about clogging Kent Street, a main road near the parliamentary precinct.

At the time of the demonstrations, King had around 354,000 followers on one of his social media pages. It was a must-watch for many participants in the protest as well as those following the events from elsewhere.

"We have all of Ottawa gridlocked right now," he said in a Jan. 31, 2022 video that was introduced as evidence Thursday while an Ottawa police officer was in the witness box.

Crown prosecutors are arguing King was a leader of the protest and used his influence to counsel others to break the law. 

More than 30 videos are expected to be introduced as evidence as part of the Crown's case during the trial, which is expected to sit for three non-consecutive weeks and end in July.

In another video made on Feb. 7, 2022 — one of six shown in court Thursday — King tells his supporters to be silent because a Superior Court of Ontario had issued an injunction against the use of horns that day.

"We're not here to harass the citizens of Ottawa," he says, instructing them not to blast their horns for 10 days. 

In the same video, he also says it's "pretty hilarious" that residents had not been able to sleep.

'Game on, let those horns go'

Prosecutors say King was directly involved in organizing a slow roll at the Ottawa airport and had encouraged others to take part in the crime of mischief, in part by telling them to continue honking their horns.

A day later, in a video shot on Feb. 8, he tells viewers he is "pissed off."

"It's game on, let those horns go, I don't care anymore," he says.

King tells supporters to "get to Ottawa" and to "honk those horns, let the heavens hear you."

In another video made Feb. 16, King is seen walking around the parliamentary precinct greeting supporters. 

Throughout the video, people approach him to ask for his signature and to pose for photos, a testament to the sway his name carried. 

"You are the reason why we're here. We drove five hours yesterday to get here," says an unidentified supporter in one video. 

In another, a protester from Quebec City tells King that he has followed him "from the beginning."

More videos are expected to be entered into evidence as the trial continues. 

Downtown witnesses also testify

Earlier in the week, the trial heard from one small business owner in the ByWard market and a downtown church administrator.

Each described their negative experiences during the protests, including lost revenue and unfriendly interactions with people downtown at the time. 

Fewer than 10 witnesses are expected to be called by the Crown over the course of the judge-only trial. 

If King is found guilty, prosecutors could seek a prison term of around five years.

Crown attorneys are arguing a key figure in what became known as the Freedom Convoy is guilty of crimes in part because of his presence and conduct during the weeks-long protests in 2022.

Pat King is facing nine charges, including mischief, intimidation of police and other charges.

They say he was directly involved in organizing a slow-roll at the Ottawa airport and encouraged others to take part in the crime of mischief by telling them to continue honking their horns.

Fewer than 10 witnesses are expected to be called by the Crown over the course of the trial, which is expected to last three non-consecutive weeks and end in July.

Day one of the trial saw downtown resident Victoria De La Ronde enter the witness box.

She described the difficulty of living with a visual impairment during the protests and told the court it was hard for her to leave her building because the methods she used to navigate the city were hindered by protesters.

"I certainly could not go out alone on my street because of the trucks that were blocking, at times they were encroaching on intersections, so I could never tell where those were. I could not hear the signals for crossing," she said, adding that the vehicles' idling and honking was  "too loud."

She said she wasn't able to access taxis, public transit or ridesharing services during the protest, making it difficult to leave her apartment and escape the constant noise.

"It forced me to try and come up with ways to try and work around that situation," she said. "It made me feel cracked and very worried for myself and others in my situation, and worried for everybody in that situation."

She said the loud music, megaphones and occasional fireworks kept her from sleeping. 

"There was fear and there was also an impact of moving towards almost total exhaustion for lack of sleep," she said.

"Being up under that constant noise, and also attached to that the fact that I was near exhaustion, I wasn't able to concentrate, though I was trying my hardest, and I would have these headaches from lack of sleep."

She also complained about the smell of exhaust fumes entering her unit.

Under cross-examination by King's lawyer Natasha Calvinho, De La Ronde, a former federal government employee, described how she contacted lawyer Paul Champ's office about a proposed class action lawsuit launched against many of the people involved in the convoy, including King. 

• Lawsuit against convoy organizers moves forward

Because De La Ronde lived in the affected area, she would be entitled to any financial compensation made available through that class-action lawsuit, which is still being litigated.

Crown prosecutors are expected to call as their next witness Vivian Leir, an employee at St. Andrew's Presbyterian Church in Ottawa.

Leir testified in the trial of Tamara Lich and Chris Barber, two organizers also facing charges for their role in the protests. During that testimony in October, Leir described seeing protesters urinate on church property.

She told court at the time she was "overwhelmed with trucks parked all around our church" when they arrived at the end of January.

WATCH ABOVE: The criminal trial of Pat King, one of the most prominent figures associated with the 2022 Freedom Convoy protest in Ottawa, is expected to begin Monday.

As his criminal trial got underway, “Freedom Convoy” organizer Pat King pleaded not guilty to a list of nine charges related to the major protest that paralyzed downtown Ottawa in 2022.

King was involved in a convoy that saw hundreds of big-rig trucks and other vehicles roll into Ottawa two years ago to protest COVID-19 public health measures, as well as Prime Minister Justin Trudeau’s Liberal government.

King presented himself as an outspoken leader throughout the demonstration and documented his experience with frequent livestreams on social media, Crown attorney Emma Loignon-Giroux told the court Monday.

Several of those videos are expected to be entered as evidence and make up a significant part of the Crown’s case.

King offered his plea in court wearing a black suit, with about a dozen supporters in the benches behind him.

He is charged with mischief, counselling others to commit mischief, disobeying a court order, obstructing police, blocking a highway and other offences related to his role in the three-week long demonstration.

“This case is straightforward. It’s not about politics. It’s not a debate about the government’s response to the COVID-19 pandemic,” Loignon-Giroux told the court.

“This case is about Mr. King’s conduct.”

She began the Crown’s case by describing life in Ottawa during the Freedom Convoy protest and the “severe disruptions” and “nearly intolerable” conditions residents of the city faced.

The sound of airhorns blared through the courtroom as she played an 11-minute compilation video to show the court some of the scenes she described, including streets blocked by trucks and crowds shouting “Freedom” and “We’re not leaving.”

The Crown’s first witness, Victoria De La Ronde, answered questions about the fear and exhaustion she experienced as a blind woman living six blocks from Parliament Hill during the protest.

Once the protest began, she could no longer navigate the familiar streets around her home because big rigs and other vehicles blocked her way, she said.

The audible signals she used to cross the streets safely were drowned out by the sound of horns and idling engines, which kept her up all night.

She described feeling trapped in her home — a feeling that still affects her more than two years later. She has only ventured out of her home on foot by herself a handful of times since, she said.

De La Ronde previously testified before a federal commission of inquiry into the government’s use of the Emergencies Act during the protest.

Several other witnesses the Crown intends to call also testified in the criminal trial of Tamara Lich and Chris Barber, two of the most prominent organizers of the convoy.

None of them had any contact with King himself.

The defence also intends to call evidence in the case, King’s lawyer Natasha Calvinho said Monday.

One of the most polarizing figures to gain notoriety during what became known as the Freedom Convoy in Ottawa more than two years ago will stand trial Monday, signalling the tail end of criminal proceedings that have dogged hundreds of individuals who participated in the historic protest.

Pat King, from Red Deer, Alta., is facing charges of mischief, intimidation, obstructing police, disobeying a court order and other offences for his role in the protest that gridlocked downtown for nearly a month in early 2022. 

Arrested and jailed for five months before his release that summer, King is unlikely to serve more time behind bars if he is found guilty, given laws around credit from time served.

Like other prominent convoy leaders, King's trial is expected to draw a sizeable crowd outside the Ottawa Courthouse. 

But unlike the trials of Tamara Lich and Chris Barber, King's defence won't be bankrolled by The Democracy Fund or the Justice Centre for Constitutional Freedoms — both well-mobilized entities with deep ties to libertarian and right-wing backers. 

Similarly, many of the convoy supporters and even some of the original core organizers who once shouted slogans against vaccine mandates alongside King have abandoned or distanced themselves from the 46-year-old, who is known for making incendiary remarks.

He knows all this, perhaps better than anyone else. 

"I'm about to go into the fight of my life," he told his social media audience on April 29.

Left to defend himself

King, who was granted permission to livestream online for fundraising purposes, admitted to supporters in that final video before he travelled to Ottawa that he's looking forward to the end of the legal ordeal so he could return to some normalcy. 

"It's been hard," he told supporters.

A day later he posted on Facebook: "My lawyer just contacted me that we are sitting at 9037$ in donations just from last night . I cannot thank you enough !" he wrote.

Without financial backing from any major advocacy group, King has had to raise money mostly on his own, hosting events both in Alberta and Ontario. 

Prior to his most recent fundraiser in early May, he said he was around $60,000 short of his goal. But King is hardly alone in his fight. 

On Facebook alone, King still draws 339,000 followers, posting videos from events including a highly publicized one featuring Alberta premier Danielle Smith and former Fox News host Tucker Carlson in Calgary earlier this year. 

An early organizer

King was brought in as an early planner of the Freedom Convoy, conceived by an ad-hoc group that connected online as a protest against vaccine mandates, in January 2022. 

He had, after all, been involved in an earlier convoy to Ottawa. In 2019, he helped organize the United We Roll movement in support of Canada's oil and gas sector.

Inspired by protests in France over rising fuel costs, that event only attracted a few hundred people. But it set the stage for some of the challenges organizers of the Freedom Convoy would eventually encounter — notably, how the main message was quickly diluted by others vying for the microphone.

Like the much bigger lockdown of Ottawa in 2022, they included calls to arrest Prime Minister Justin Trudeau, as well as racist sentiments. 

King made headlines almost immediately when thousands of truckers and protesters started rallying to head to Ottawa. His online fame soared, buoyed by his antics in Red Deer where he criticized COVID-19 mandates and protested against an anti-racism rally. 

Various fundraisers launched in support of the Freedom Convoy received millions of dollars in pledges before they were shut down by the online platform hosting them. 

One such effort, known as "Adopt-A-Trucker," was launched on Jan. 18, 2022. It was described as being "endorsed" by King, a testament to the weight his name carried among sympathizers. 

He was also listed as a "road captain" for Alberta truckers.

King's sizeable online audience, his experience organizing protests and his bombastic live feeds as he travelled to Ottawa quickly turned him into a key figure of the protests. 

His online presence became a must-watch for anyone keeping tabs on the convoy, and he used his influence to help coordinate demonstrations including a "slow roll" at the Ottawa International Airport.

Old videos resurface

Sensing his unpredictability and tendency to attract negative attention, however, Lich, Barber and others sought to distance themselves from King as the weeks-long protest continued. News media scrambled to determine who best represented the movement as competing voices vied for clout and credit.

As the public's attention on King intensified, some of his old videos resurfaced.

Snippets showed King mocking specific ethnicities, talking about the Anglo-Saxon race "being one of the strongest bloodlines," and warning: "Trudeau, someone is going to make you catch a bullet one day."

He has long maintained the videos were spliced and edited to make him look bad.

But his statements spread, furthering the idea that the Freedom Convoy was less about vaccine mandates and more a protest conceived and promoted by far-right characters.

King's controversial statements gained a national audience when CBC's The Fifth Estate aired an interview with King. King went ahead with the interview against the advice of Lich, Barber and others involved in organizing the protest. 

But even before that, other organizers had raised concerns about King. 

According to evidence presented at the Public Order Emergency Commission (POEC), which looked into the federal government's decision to use the Emergencies Act to break up the protest, Lich and Barber discussed trying to send King home even before the convoy's arrival in Ottawa. 

By Jan. 26, concerns about his involvement were great enough to prompt more discussion about sending him home. King wouldn't end up returning to Alberta until several months later, however.  

After cycling through lawyers, he was released in July 2022 and met by chants of "freedom" outside the Ottawa Courthouse. Conditions of his release included no more protesting or public assembly specifically related to the COVID-19 pandemic, the Freedom Convoy or anti-government demonstrations.

King's lawyer Natasha Calvinho later argued her client was too "notorious" to be tried in Ottawa and said King "was and still is more highly publicized than most other people involved in the Freedom Convoy." 

The request to move his trial elsewhere was denied. He will face the judge alone in Ottawa.

Co-accused pleaded guilty, released

King was arrested while livestreaming on Feb. 18, 2022, and charged alongside his sidekick Tyson "Freedom George" Billings, who was often seen with King. 

They were charged with two counts each of intimidation and obstructing police, and one count each of mischief, counselling to commit mischief, counselling to obstruct police, counselling intimidation, disobeying a court order and counselling to disobey a court order.

Billings pleaded guilty and was released from jail in June 2022. He pleaded guilty to one count of counselling to commit mischief, but the other charges were withdrawn.

Sentenced to six months of probation, he returned to his home in High Prairie, Alta., and has since continued to take part in convoy-adjacent protests.

King stayed in jail, service 150 days in all, telling his supporters privately he would fight his charges, and picking up more along the way.

Now, his opportunity has arrived.

"My heart and soul tell me that we will be victorious," he told supporters in his final video. 

The trial is expected to sit for nine days, then break before a final week in mid-July.

After 26 days the criminal trial for a pair of "Freedom Convoy" organizers has now taken longer than the original protests in 2022. 

The trial, originally slated for 16 days, has been bogged down by delays like the legal wrangling over certain testimony or evidence, or how Ottawa police collected and handed over evidence to Crown prosecutors.

Tamara Lich and Chris Barber, the two most prominent leaders of the trucker protest, helped lead thousands of demonstrators to Ottawa where they clogged streets for nearly four weeks in January and February of 2022.

They are on trial for charges of committing mischief, obstructing police, counselling others to commit mischief and intimidation for their role in the protest.

At the outset of the high-profile trial, the court dedicated 10 days for the Crown to make their case that Lich and Barber "crossed the line," but the pace of proceedings slowed almost immediately.

Issue with 1st witness

The Crown's first witness came with a few hiccups.

First the court entered into a voir dire — a "trial within a trial" — to determine the permissibility of a compilation of police-gathered video clips, which prosecutors were trying to introduce as evidence. 

Cross-examination was then delayed because Barber's lawyer, Diane Magas, requested and was granted access to all the open source and police video used to make the compilation video.

The first week also saw technological and other delays bring proceedings to a crawling pace and when it ended, the defence had established its frustration, raising complaints about the large swaths of new evidence from the Crown introduced mid-trial. 

Justice Heather Perkins-McVey also told the court she was "very unhappy" about those disclosures, even calling a short recess to "settle" herself.

"This should have been done well before the trial," she chided before leaving the courtroom.

Three extra days were added as a precaution.

Issues with other witnesses, police

As the trial crawled on, three of four police officers who entered the witness box had their testimony halted because of issues over how police disclosed materials to Crown prosecutors.

Perkins-McVey also had to order the Crown to disclose internal police documents to the defence after Lich and Barber's lawyers requested information from the police service about a software upgrade that wiped phones from at least two officers who were communicating directly with protesters.

The judge called it "very unusual" and ordered the Crown produce an internal police email about the phone upgrade for defence lawyers to review.

After reviewing heavily blacked-out internal police emails, she also unredacted the contents: detailed instructions to officers on disclosing evidence. 

Kim Ayotte, Ottawa's manager of emergency and protective services, then showed up to testify about his role, but he didn't bring his notes and that caused a recess.

Perkins-McVey vowed before the trial began she would keep the proceedings on the rails, and as the first week ended, she repeated that intention.

Defence attempt blocking testimony, evidence

That was not the case when court returned the following Monday. 

Barber's lawyers rose to block nine Ottawa residents and businesses from testifying on behalf of the Crown, which further delayed the trial. Ultimately the citizens did testify, about the protest's impact.

Defence lawyers then argued against Crown plans to use 212 pages worth of posts and videos from the "Freedom Convoy 2022" Facebook page, including updates that convoy organizers gave to supporters. Again, more delays.

More delays are likely because there is ongoing discussion about the contents of text messages retrieved from Barber's phone. The defence and Crown are painstakingly going through about 20 conversations with Perkins-McVey to decide what should be admissible.

The trial was adjourned on Nov. 3 with no additional sitting days scheduled, but lawyers plan to meet next week to set some.

The trial has run long despite prosecutors staying a bail-related charge against Lich to ensure the criminal trial was the focus.

Still, Diane Magas has said multiple times — if the trial slows because of the Crown — she would consider seeking an application to have the charges stayed because her client's right to be tried within a reasonable time would have been violated, also known as a Jordan application.

On Thursday, the commission announced it would make its final report
public later today after tabling it in Parliament.

The Canadian Press reported the commission had requested, and been
granted, an extension to the original Feb. 6 deadline for submitting
its final report to the government.

The deadline for tabling the report in Parliament — Feb. 20 — remained
intact, however. That meant the commission's findings and
recommendations had to be made public no later than Monday, the Family
Day statutory holiday in Ontario.

(The timeline set out by the Emergencies Act requires that the report
be submitted to Parliament and released to the public within 360 days
of the emergency declaration being revoked, which occurred on Feb. 23,
2022.)

Mayor, councillors gone

The commission heard from 76 witnesses over six weeks of public
testimony, from Oct. 14 until the prime minister's appearance on Nov.
25. Of those, seven were either elected officials or senior
bureaucrats with the City of Ottawa, and five more were senior members
of the Ottawa Police Service (OPS).

None of the elected officials from the city who testified — former
mayor Jim Watson, former councillor and police services board chair
Diane Deans, and former councillors Mathieu Fleury and Catherine
McKenney — remains in office. Of those, only McKenney ran for
re-election last fall, but failed in their bid to become mayor.

Of the other city officials who testified, only Kim Ayotte, Ottawa's
general manager of emergency and protective services, remains in the
same job.

Former city manager Steve Kanellakos, who testified about his efforts
to broker a deal between police and the protesters, resigned amid
controversy on Nov. 28, just two days before the release of a damning
report on Ottawa's troubled LRT project.

All 5 OPS witnesses remain

All five senior members of the Ottawa Police Service who testified
before the commission last fall remain, though most have changed jobs.
(This doesn't include former chief Peter Sloly, who resigned during
the occupation of Ottawa by convoy protesters, and who had been out of
policing for more than eight months by the time he testified before
the commission in late October.)

Steve Bell, who was named interim chief after Sloly's resignation, and
who oversaw the eventual dispersal of the protest in Ottawa, is now a
deputy chief and chief administrative officer of the OPS. At the time
of the convoy's arrival in Ottawa, Bell was in charge of intelligence,
information and investigation for the force.

Patricia Ferguson, who testified to the deep "dysfunction" at the top
of the OPS, and said the force was left "floundering" when protesters
failed to leave the capital after the first weekend, remains acting
deputy chief.

Russell Lucas, an inspector with the police service's special events
section during the protests, is currently an acting superintendent,
according to an update provided by the OPS on Thursday.

Supt. Robert Bernier, an inspector within the force's communications
branch who was appointed event commander during the occupation, is
also listed by the OPS as an acting superintendent.

Supt. Robert Drummond, who was tasked with overseeing the police
liaison team that negotiated with protest leaders and the public order
unit that eventually helped end the occupation, also maintains that
rank. (Drummond was in an acting role at the time of his testimony
last fall.)

'Multiple points of failure'

In an email to CBC, Paul Champ, a lawyer who represented downtown
residents and businesses during the Emergencies Act inquiry, noted the
commission heard "extensive evidence of multiple points of failure" by
both government officials and police.

"Even though many of those responsible have left the stage, the POEC
report will memorialize those mistakes and serve as a guide for public
officials going forward. I would also like to see some apologies by
the police, the city and the province, but that's probably asking too
much," Champ wrote.

He said he also hopes to see the report provide some guidance "about
the oversight and direction the Ottawa Police Services Board can have
over the Ottawa Police Service."

Journalists covering the inquiry will be allowed to peruse an
embargoed version of the report starting at 10 a.m. ET. The embargo
will be lifted once the report is tabled in Parliament.

Commissioner Paul Rouleau will also read a prepared statement, which
will be streamed live on the commission's website, where the full
report will be made available to the public.

Rep. Alcee Hastings, D-Fla., died Tuesday after a more than two-year
bout with pancreatic cancer, NBC News confirmed.

Hastings, who served in the House for nearly three decades, was 84.
Throughout his career, he held several key committee assignments and
leadership positions, most recently as vice chairman of the rules
committee. He had also been Florida’s first Black federal trial judge,
appointed to the bench in 1979 by President Jimmy Carter.

“As an attorney, civil rights activist and judge, and over his nearly
thirty years in Congress, he fought tirelessly to create opportunities
to lift up working families, communities of color, children and
immigrants,” House Speaker Nancy Pelosi wrote in a statement.

President Joe Biden reacted to Hastings’ death on Tuesday afternoon.
“Across his long career of public service, Alcee always stood up to
fight for equality, and always showed up for the working people he
represented,” he said in a statement. “Jill and I are saddened to
learn of his passing.”

Democrats now hold a narrower advantage in the House, 218-211, giving
the party a smaller margin of error in passing legislation. Six seats
are vacant, four of which were previously held by Democrats and two by
Republicans.

Three of the four Democratic House seats were vacated by appointments
to positions in President Joe Biden’s Cabinet. Deb Haaland, of New
Mexico, was appointed secretary of the Department of Interior; Marcia
Fudge, of Ohio, was named head of the Department of Housing and Urban
Development, and Cedric Richmond, of Louisiana, became senior advisor
to the president and director of the White House Office of Public
Engagement.

One of the two vacant GOP seats is no longer up for contest. Julia
Letlow of Louisiana was elected in late March but has yet to be sworn
in. Julia will replace her late husband, Luke Letlow, who was elected
to the seat but died before being sworn in due to Covid-19
complications.

In 1983, when Hastings was a federal judge, he was acquitted in
criminal court on a charge of conspiring to solicit a bribe in
exchange for leniency in a sentencing.

Nevertheless, the House impeached Hastings in 1988 amid accusations
that he perjured himself during that criminal trial. The Senate voted
to convict him, removing him from the bench, but did not vote to
disqualify him from holding future office.

Hastings appealed the impeachment conviction in 1992. A federal judge
overturned the conviction, on the grounds that a 12-member Senate
committee, rather than the full Senate, conducted the impeachment
trial. This was the first time a Senate conviction was overturned by a
federal judge.

The next year, the U.S. Supreme Court ruled federal courts do not have
the authority to review the procedures of a Senate impeachment trial.
Hastings’ legislative career, which began with his election in 1992
and continued until his death, was unaffected by the decision.

KYIV, UKRAINE -- Ukrainian President Volodymyr Zelensky on Thursday
accused Moscow of building up troops on his country's border as the
United States warned Russia against "intimidating" Ukraine.

Kiev has been locked in a conflict with Russian-backed separatists
since 2014, and this week Ukrainian officials reported Russian troop
movement in annexed Crimea and on the border, near territories
controlled by Moscow-backed separatists.

On Thursday, Zelensky's ministers discussed the escalating security
situation with Western allies including U.S. Secretary of Defence
Lloyd Austin.

"Muscle-flexing in the form of military exercises and possible
provocations along the border are traditional Russian games," Zelensky
said in a statement.

He accused Moscow of seeking to create "a threatening atmosphere" as
Kiev hopes to resume a ceasefire brokered last year.

The U.S. State Department said it was "absolutely concerned by recent
escalations of Russian aggressive and provocative actions in eastern
Ukraine."

"What we would object to are aggressive actions that have an intent of
intimidating, of threatening, our partner Ukraine," State Department
spokesman Ned Price told reporters.

Some observers say the reported Russian troop buildup is a test for
the administration of U.S. President Joe Biden, who caused an uproar
in Moscow last month by calling his Russian counterpart Vladimir Putin
a "killer".

This week, Moscow and Kyiv blamed each other for a rise in violence
between government forces and Kremlin-backed separatists in eastern
Ukraine, which has undermined the ceasefire.

Zelensky said 20 Ukrainian servicemen had been killed and 57 wounded
since the start of the year.

Separately, the military announced that a Ukrainian soldier was
wounded in an attack it blamed on separatists.
'READY FOR AN OFFENSIVE'

On Thursday, U.S. Secretary of Defence Austin called his Ukrainian
counterpart Andriy Taran, Ukraine's defence ministry said.

Austin said during the call that Washington would "not leave Ukraine
alone in the event of escalating Russian aggression", the ministry
said.

Ukrainian Foreign Minister Dmytro Kuleba for his part discussed the
"aggravation by the Russian Federation of the security situation" on
the frontline with his Canadian counterpart Marc Garneau.

Ukraine's military intelligence accused Russia of preparing to "expand
its military presence" in the separatist-controlled eastern regions of
Donetsk and Lugansk.

In a statement, the intelligence service said it "does not rule out"
an attempt by Russian forces to move "deep into Ukrainian territory".

A high-ranking Ukrainian government official, speaking on condition of
anonymity, claimed that the Russian army was practising "military
co-ordination" with separatists.

"From mid-April their combat units will be ready for an offensive,"
the official told AFP.
WEST SHOULD NOT 'WORRY'

Moscow has repeatedly denied sending troops and arms to buttress the
separatists and Putin's spokesman stressed on Thursday that Moscow is
at liberty to move troops across its territory.

"The Russian Federation moves its armed forces within its territory at
its discretion," spokesman Dmitry Peskov told reporters, but he did
not directly confirm a troop buildup on the Ukrainian border.

He added that "it should not worry anyone and does not pose a threat to anyone".

The war in eastern Ukraine broke out in 2014 when Russia annexed the
Crimean peninsula following a bloody uprising that ousted Ukraine's
Kremlin-friendly president Viktor Yanukovych.

On Wednesday, the Pentagon said U.S. forces in Europe had raised their
alert status following the "recent escalations of Russian aggression
in eastern Ukraine".

Mark Milley, chairman of the U.S. Joint Chiefs of Staff, also spoke
with his Russian and Ukrainian counterparts, Valery Gerasimov and
Ruslan Khomchak.

Khomchak said this week that 28,000 separatist fighters and "more than
2,000 Russian military instructors and advisers" are currently
stationed in eastern Ukraine.

On Thursday, the deputy head of Zelensky's office, Roman Mashovets,
called for joint drills with NATO forces to "help stabilise the
security situation".

Zelensky was elected in 2019 promising to end the years-long conflict,
but critics say a shaky ceasefire was his only tangible achievement.

The fighting has claimed more than 13,000 lives since 2014, according
to the United Nations.

(CNN)Top US national security officials have spoken with their
Ukrainian counterparts, and America's top general held a call
Wednesday with his Russian opposite number amid concern over Russian
military activity in Crimea and eastern Ukraine, including what the US
deemed a violation of a ceasefire by Moscow that led to the deaths of
four Ukrainian soldiers last week.
"Russia's destabilizing actions undermine the de-escalation intentions
that had been achieved through [last year's agreement]," chief
Pentagon spokesman John Kirby said Wednesday. "Additionally, we are
aware of Ukrainian military reports concerning Russian troop movements
on Ukraine's borders."

Secretary of State Tony Blinken reaffirmed the "unwavering support" of
the United States for Ukraine's territorial integrity in the face of
"Russia's ongoing aggression in the Donbas and Crimea," according to a
readout of his call with Ukrainian Foreign Minister Dmytro Kuleba
Wednesday. Chairman of the Joint Chiefs of Staff Gen. Mark Milley also
spoke to the top Ukrainian general Wednesday, while national security
adviser Jake Sullivan spoke with his Ukrainian counterpart at the
beginning of the week.

The Pentagon had grown increasingly concerned after military
intelligence reports assessed that some 4,000 heavily armed Russian
forces had been observed moving in Crimea, according to a US defense
official. "It was not totally clear what they were up to," the
official said, adding that the US now believes on further assessment
it may have been part of a Russian military exercise. Part of that
assessment was based on calls with Ukrainian officials who also viewed
the Russian activity as an exercise.

If so, the movement of so many Russian military personnel was a large
exercise and may be a deliberate message from the Kremlin to the Biden
administration about Russia's strength in the region and its ability
to challenge US allies, the official said.

This comes as NATO countries on Monday scrambled jets 10 times to
track an unusually high level of Russian military flights over a large
area of Europe including the North Sea, the Black Sea and the Baltic
Sea. NATO jets wound up conducting six intercepts in a six-hour
period.

The Biden administration is taking a tougher approach to Russia, and
Ukraine is only the latest source of tension between the two
adversaries. The White House unveiled a raft of sanctions against
Russian officials and entities at the beginning of the month over the
poisoning of opposition leader Alexey Navalny. President Joe Biden
then warned that Russian President Vladimir Putin would "pay a price"
for his efforts to undermine the 2020 US elections and went on to call
Putin a "killer." Meanwhile, the administration is expected to impose
more sanctions on Russia over election interference and the SolarWinds
cyberattack.

On Wednesday, Milley spoke with his Russian counterpart, Gen. Valery
Gerasimov. While the topics the two generals discussed have not been
made public, behind the scenes the Defense Department has been
concerned for the last several days about the build-up of Russian
troops and equipment along the Ukraine border. The Defense Department
recently raised the so-called "watch condition level" on that region
to gather updated intelligence assessments on Russian activity and
intentions, while monitoring any potential threats. The New York Times
was first to report that development.

Russia blamed Ukraine for renewed fighting in eastern Ukraine. Kremlin
spokesman Dmitry Peskov said this week that Russia was concerned about
"Ukraine's provocations," but he said he hoped it would not escalate
to fighting.

But Ukraine warned of a series of Russian violations of the ceasefire,
including two incidents of mortar fire and large-caliber machine gun
fire that led to the death of the four Ukrainian soldiers last Friday.
On Tuesday, Ukraine accused Russia of violating the ceasefire seven
times, prompting the country's parliament to call for an increase in
political and economic pressure on Moscow.

(CNN)NATO scrambled fighter jets 10 times Monday to track and
intercept an unusually "rare peak" of Russian bombers and fighters
flying over the North Sea, Black Sea and Baltic Sea, according to a
NATO official.
"NATO aircraft intercepted six different groups of Russian military
aircraft near alliance airspace in less than six hours," the
organization said in a statement.

The Russian activity across an unusually wide area of European skies
came on the same day North American Aerospace Defense Command said it
tracked Russian aircraft off the coast of Alaska.

None of the Russian aircraft entered the national airspace of NATO
nations in Europe and the intercepts were considered safe, but an
alliance statement detailed the activity.

Norwegian F-16s scrambled after radars detected two groups of Russian
military aircraft near Norway's coastline. The Norwegians intercepted
two Tu-95 Bear bombers which flew south over the North Sea. That
prompted the United Kingdom to send up Typhoon aircraft and Belgium to
deploy F-16 fighters.

The Norwegian F-16s later intercepted two Tu-160 bombers over
international waters nearby.

Separately, NATO radars detected three Russian military aircraft near
allied airspace over the Black Sea which were tracked by Turkish,
Romanian and Bulgarian fighters aircraft until they left the area.

In another encounter, NATO said Italian fighter jets intercepted a
Russian II-38 maritime patrol aircraft which was already being
escorted by Russian fighter jets over the Baltic Sea flying from
Kaliningrad.

CNN reported Saturday that the US is preparing to carry out a
classified war game this summer where a major focus of the scenarios
will be how the US should respond to aggressive action and unexpected
moves by China and Russia.

Tensions with Russia are high, and last week, Secretary of State
Antony Blinken called out Russia for "reckless and adversarial
actions" at a NATO meeting in Brussels and observed that Moscow has
"built up a forces, large scale exercises and acts of intimidation, in
the Baltic and Black Sea."

"Intercepting multiple groups of Russian aircraft demonstrates NATO
forces' readiness and capability to guard Allied skies 24 hours a day,
7 days a week, 365 days a year," Brig. Gen. Andrew Hansen, deputy
chief of staff operations at Allied Air Command, said in the NATO
statement.

NATO aircraft scrambled more than 400 times in 2020 to intercept
unknown aircraft according to the alliance. About 90 percent were in
response to flights by Russian aircraft. NATO says Russian flights
often pose a risk to civilian air traffic over Europe because the
Russians often fly without transmitting a transponder code indicating
their position and altitude and do not file a flight plan or
communicate with air traffic controllers.

The prosecution agrees to provide evidence and a witness list after
Lich brings a motion for particulars.

TORONTO: Tamara Lich's lawyer appeared before the Ontario Court of
Justice Tuesday seeking particulars of the alleged crimes committed by
his client during the Freedom Convoy protests. The motion concluded
with the prosecution agreeing to provide a full list of witnesses and
evidence by August 1, 2023.

The concept of particulars is similar to but distinct from disclosure.
TDF's litigation director, Alan Honner, explains: "The prosecution has
a duty to fully disclose all relevant evidence to the accused, but
particulars need only be disclosed if a judge is satisfied that it is
necessary for a fair trial." According to Honner, particulars might be
ordered where a crime can be committed in different ways, where
disclosure is broad, or where there are multiple co-accused.

Tamara's defence is being crowd-funded by The Democracy Fund. She has
retained Lawrence Greenspon, who is one of the best-respected lawyers
in Ottawa. Her trial is expected to last three weeks and is scheduled
to begin in Ottawa on September 5, 2023.

As Emergencies Act report tabled, key witnesses have moved on

As the Public Order Emergency Commission (POEC) prepares to release
its highly anticipated report into last winter's convoy protests, many
of the witnesses from the City of Ottawa and the Ottawa Police Service
who testified last fall have either left or moved to new roles.

On Thursday, the commission announced it would make its final report
public later today after tabling it in Parliament.

The Canadian Press reported the commission had requested, and been
granted, an extension to the original Feb. 6 deadline for submitting
its final report to the government.

The deadline for tabling the report in Parliament — Feb. 20 — remained
intact, however. That meant the commission's findings and
recommendations had to be made public no later than Monday, the Family
Day statutory holiday in Ontario.

(The timeline set out by the Emergencies Act requires that the report
be submitted to Parliament and released to the public within 360 days
of the emergency declaration being revoked, which occurred on Feb. 23,
2022.)

Mayor, councillors gone

The commission heard from 76 witnesses over six weeks of public
testimony, from Oct. 14 until the prime minister's appearance on Nov.
25. Of those, seven were either elected officials or senior
bureaucrats with the City of Ottawa, and five more were senior members
of the Ottawa Police Service (OPS).

None of the elected officials from the city who testified — former
mayor Jim Watson, former councillor and police services board chair
Diane Deans, and former councillors Mathieu Fleury and Catherine
McKenney — remains in office. Of those, only McKenney ran for
re-election last fall, but failed in their bid to become mayor.

Of the other city officials who testified, only Kim Ayotte, Ottawa's
general manager of emergency and protective services, remains in the
same job.

Former city manager Steve Kanellakos, who testified about his efforts
to broker a deal between police and the protesters, resigned amid
controversy on Nov. 28, just two days before the release of a damning
report on Ottawa's troubled LRT project.

All 5 OPS witnesses remain

All five senior members of the Ottawa Police Service who testified
before the commission last fall remain, though most have changed jobs.
(This doesn't include former chief Peter Sloly, who resigned during
the occupation of Ottawa by convoy protesters, and who had been out of
policing for more than eight months by the time he testified before
the commission in late October.)

Steve Bell, who was named interim chief after Sloly's resignation, and
who oversaw the eventual dispersal of the protest in Ottawa, is now a
deputy chief and chief administrative officer of the OPS. At the time
of the convoy's arrival in Ottawa, Bell was in charge of intelligence,
information and investigation for the force.

Patricia Ferguson, who testified to the deep "dysfunction" at the top
of the OPS, and said the force was left "floundering" when protesters
failed to leave the capital after the first weekend, remains acting
deputy chief.

Russell Lucas, an inspector with the police service's special events
section during the protests, is currently an acting superintendent,
according to an update provided by the OPS on Thursday.

Supt. Robert Bernier, an inspector within the force's communications
branch who was appointed event commander during the occupation, is
also listed by the OPS as an acting superintendent.

Supt. Robert Drummond, who was tasked with overseeing the police
liaison team that negotiated with protest leaders and the public order
unit that eventually helped end the occupation, also maintains that
rank. (Drummond was in an acting role at the time of his testimony
last fall.)

'Multiple points of failure'

In an email to CBC, Paul Champ, a lawyer who represented downtown
residents and businesses during the Emergencies Act inquiry, noted the
commission heard "extensive evidence of multiple points of failure" by
both government officials and police.

"Even though many of those responsible have left the stage, the POEC
report will memorialize those mistakes and serve as a guide for public
officials going forward. I would also like to see some apologies by
the police, the city and the province, but that's probably asking too
much," Champ wrote.

He said he also hopes to see the report provide some guidance "about
the oversight and direction the Ottawa Police Services Board can have
over the Ottawa Police Service."

Journalists covering the inquiry will be allowed to peruse an
embargoed version of the report starting at 10 a.m. ET. The embargo
will be lifted once the report is tabled in Parliament.

Commissioner Paul Rouleau will also read a prepared statement, which
will be streamed live on the commission's website, where the full
report will be made available to the public.
