Most leases in Crown auction fetch minimum price, but last-minute flurry injects drama

There's still a bit of magic — and market value — in one salmon pool along New Brunswick's fabled Miramichi River fishery.

Wednesday's auction of once-coveted Crown angling leases, which grant exclusive 10-year fishing rights, featured a down-to-the-wire bidding war for the most valuable pool in the watershed. 

The seven-kilometre Square Forks lease on the Big Sevogle River, a tributary of the Northwest Miramichi River, had an "upset price," or minimum bid, of $12,450.

But a late flurry of bids in the final minutes of the auction drove the price up to $56,500.

That's more than four times the starting bid and it's higher than the $49,800 minimum bid for the pool in the last auction, held in 2013.

The website of Jardine Auctioneers, which conducted the online auction for the province, did not identify the successful bidders for the 15 leases that sold on Wednesday.

But historically, incumbent lessees have been willing to increase their bids to stave off competitors, especially when they've invested in lodges and other infrastructure near the pools.

The New Brunswick government slashed the lease prices for the 14 salmon leases in Wednesday's auction by 40 to 75 per cent, depending on the river.

Earlier this month, a spokesperson said a third-party appraiser based the lower upset prices on "comparable private land transactions, Atlantic salmon returns, and catch statistics."

Some salmon anglers say the drop in prices reflects a dramatic decline in Atlantic salmon returns in the rivers, making the once-coveted angling leases less valuable.

All the leases other than Square Forks attracted a single bid each, and each of those bids was close to the "upset price" or minimum amount listed in the auction catalog. 

Even so, those bidders — many of them exclusive salmon clubs — are paying much less for access this time around. Upset prices on the Restigouche River were reduced by 40 per cent and those in the Miramichi system by 75 per cent. Other rivers saw reductions of 50 to 55 per cent.

Cross Point, a pool on the Restigouche River that had the highest upset price of $87,300 per year in the last auction, was reduced to $52,380 this time and ended up selling for $52,500.

The upset price on the second-most expensive lease in the Miramichi system in 2013, called the Northwest Miramichi lease, dropped from $20,800 to $5,200. The rights sold Wednesday for $5,500.

One of the 15 leases auctioned was for fishing rights to trout in Dicks Lake in southern New Brunswick.

That was the only one that was not deeply discounted compared to 2013, with the upset price dropping from $2,900 to $2,728. The sole bid was $3,000.

Plunging salmon pool prices highlight stock's decline, anglers say

Most minimum bids in province’s once-a-decade Crown angling lease auction drop 40 to 75 per cent

The New Brunswick government has dramatically dropped the price for leases on a group of publicly owned salmon pools once considered among the most prized and lucrative fishing spots in North America.

Those 10-year leases are up for bids this week and give lessees the right to fish renowned Crown salmon pools on the Miramichi, Restigouche and other rivers.

The auction catalogue shows the province has dropped minimum bids, known as "upset prices," for pools in the Miramichi system by 75 per cent compared to the 2013 auction.

The upset price for Square Forks, which is on the Big Sevogle River, has dropped from $49,800 in 2013 to $12,450 this year.

Upset prices on the Restigouche are down by 40 per cent. The river's Cross Point lease, which carried an upset price of $87,300 in 2013, is now priced at $52,380. 

Other leases on the Kedgwick, Upsalquitch, Tabusintac and other rivers have also been discounted by 50 to 55 per cent.

The Department of Natural Resources refused to make anyone available for an interview about why the leases have lost so much value.

The department also refused to say what the inflation-indexed lease payments were this year.

In an emailed statement, spokesperson Nick Brown said the upset prices for the 2025 auction were determined by a third party that he did not identify.

"The appraisals considered a range of factors, including comparable private land transactions, Atlantic salmon returns, and catch statistics," he said.

Bradford Burns, an angler and guide from Maine who fishes on the Miramichi, said a 90 per cent decline in Atlantic salmon stocks in the last 15 years is likely to blame.

"I wouldn't be surprised if they have great difficulty even getting bids on many of the properties," he said.

"It isn't like you went out and instead of catching 10 fish, you caught one fish. It may be that you go days and days and not catch any at all, or even see any, because there aren't any there."

Burns is part of a lawsuit along with five other anglers and lodge owners filed against the federal government over the fate of the salmon.

Alex Mills, a lawyer and lodge owner who used to help assess the value of pools, and who is also part of the legal case, agreed.

"From having worked in the field of salmon pools for most my career, I know there's a correlation between catches and runs and the values of properties and the values of leases," Mills said.

The claim argues that management decisions by the Department of Fisheries and Oceans have led to explosive growth in the Miramichi's striped bass population, which it says is "aggressively preying" on salmon smolts.

"It's a great fishery, there's no doubt about it," Mills said of the striped bass, "but it's going to consume the Atlantic salmon fishery, and the economics and the culture and everything that goes with it."

The Department of Fisheries and Oceans did not immediately respond to a request for a comment.

A spokesperson for DFO said the department would not comment while the lawsuit is in court.

The new auction was due in 2023 but was delayed because of the COVID-19 pandemic and last year's provincial election, according to Brown.

Two leases auctioned in 2013, for the Grog Brook pool on the Upsalquitch and the Rafting Grounds pool on the Restigouche, are not being auctioned this time.

The two lessees who won the bidding for those pools gave them up in 2017 and 2021, respectively, Brown said.

"No decision has been made for these stretches of Crown waters … and both areas remain under the stewardship of the minister of natural resources," he said.

Brad Burns

Save Miramichi Salmon Inc. Threatens DFO With Litigation

Fishing Friends –

This posting to my blog is one that I must tell you I have no great joy in making, but to those of us who love the Miramichi and its Atlantic salmon, the message is critical.  A group of 6 private citizens: Alex Mills, John Bagnall, Karl Wilson, Rip Cunningham, Joe Walsh and myself have founded a not-for-profit Canadian corporation called Save Miramichi Salmon Inc.  “SMS.”  Our plan is to positively affect the Department of Fisheries and Oceans “DFO’s” management of Atlantic salmon in the Miramichi River.  Organizations like the Miramichi Salmon Association, New Brunswick Salmon Council and Atlantic Salmon Federation are continually trying to work through the standard channels to achieve the same goal that we are, and at this point we are all trying to save the Miramichi River salmon from extinction.  DFO’s gross mismanagement of salmon and striped bass has caused SMS, though, to take a different route.  We are going through the Canadian federal court system. What exactly does that mean, and why are we choosing this path?

First, the why.  In the simplest terms, DFO has managed Miramichi striped bass to the detriment of many other fish in the ecosystem.  Not just salmon, but sea run brookies, smelt and even gaspereau have suffered.  Salmon have probably suffered the worst, because there is a point at which the spawning striped bass, beginning near the head of tide, intercept the height of the smolt run on its way to the ocean.  Tagging has shown that over 70% of SW Miramichi smolts are eaten by the bass before they can get to sea, and more than 90% perish on their way out of the NW Miramichi.  Just a few years ago about 65 to 75% of the Miramichi smolts made it out to sea, slightly less than rivers like the Restigouche and the Cascapedia, but sufficient to insure that the Miramichi salmon population was sustainable.  This new reality of much lower smolt survival has nearly destroyed the salmon runs in what was just 15 years ago the most prolific Atlantic salmon river in North America.   In just a few more years the run will be extinct.  Yes, it is that bad!

I can tell you, because I was there, that Mark Hambrook and the MSA tried as hard as possible to convince DFO that the striped bass were wiping out the salmon.  For whatever reason they just wouldn’t listen, or at least some that were in control at DFO wouldn’t listen or didn’t want to hear it.  Now, it is completely indisputable, but DFO is still not showing the sense of urgency that is necessary to turn this situation around in the time that is available before the salmon are gone.

SMS did some research and hired a lawyer named Ian Knapp from the firm MacKenzie Fujisawa LLP.  This firm is from Vancouver, and has considerable experience litigating against DFO on fisheries issues on the West Coast.  The firm has represented First Nations entities as well as many other fisheries interests.

We are not jumping into a lawsuit.  We would certainly like to avoid that if possible.  What Knapp’s firm has done is to send a document to the Minister of DFO called a Demand Letter.  I have posted a PDF of our entire filing that contains this letter at this link on the Brad Burns Fly Fishing website.  The Demand Letter says that the Minister – you always address the Minister in legal proceedings even though it may be the local office that is at fault – has not followed her duties to protect the Atlantic salmon of the Miramichi, and has allowed striped bass to be managed in such a way that they have done serious harm to the salmon.  There are formal DFO policies that are supposed to stop this from happening, but they have not been applied.

SMS has built a team of several of the most knowledgeable fishery scientists in the Province.  They have written a scientific paper that shows in great detail exactly what DFO has done and is continuing to do that is wrong and in violation of DFO policy.  That paper begins on page 13 of the action at the link above. 

We are demanding that DFO bring the striped bass population back to less than 100,000 adult spawners within 4 years.  This is the number that our scientists calculate is the maximum number of striped bass that can coexist in the Miramichi with a healthy population of Atlantic salmon.  It is approximately where the two stocks were in the 2010/2011 time frame.  At that point there was excellent fishing in the Miramichi for both species.  That is our goal, not to wipe out striped bass, but to manage them at a level where both species can reasonably co-exist, as per DFO policy. 

Secondly, we are demanding that DFO allow a major salmon stocking program from the MSA hatchery in South Esk, and that DFO fund that stocking program.  DFO, and DFO alone is responsible for the decline of the Miramichi salmon population, and it is only fair that they should pay for its restoration.  Would the population bounce back without stocking?  That is addressed in the scientific paper, but the answer is that if it would, it would be very tenuous, and that without stocking the rebuilding would take a very long time.  The Miramichi system had been stocked for about 140 years before DFO pulled the plug on meaningful stocking.  DFO’s refusal to allow the CAST program dealt the salmon a double whammy of striper predation and no mitigating salmon stock supplementation.  Now less than 10 years later, here we are.

DFO has been given 30 days to respond to our demand letter and enter into earnest negotiations towards achieving the necessary conservation measures.  If DFO does respond positively we will involve representatives from the local conservation organizations in those deliberations, and work together to design a salmon rebuilding program that we feel will work within a reasonable time frame.

If DFO does not enter into earnest negotiations we are going to proceed with litigation where the facts of our case will be argued, and if we are successful, we will be granted relief by the court.

There are lots of potential twists and turns along this path.  If you want to be kept abreast of developments and be given the opportunity to add your voice to the deliberations as we go along, please send me an e-mail at bigbass@maine.rr.com.  We are going to try and set up a separate website for SMS with a data base for interested parties.  Right now, we will just keep that database manually on an excel spread sheet.  Let me assure you that names on that database will not be used for any purpose other than to provide information to you about the status of this action as discussed in this paragraph.

    No matter how nice you word it your suing the Canadian Federal Department of Fisheries and Oceans and me as a Canadian Taxpayer and Outfitter and Guide and every other Canadian Angler that pays taxes here in Canada.

    The only thing sending me a letter threatening to sue me will ever get you is land you in a Court House somewhere where more of my and your personal money and other tax payers dollars will be wasted and you will only set talks back and everyone will only plant their feet in deeper.

    Forming a non-profit specifically to sue our own Canadian Federal Government is a weak and cowardly way to ever go about suing all of us Canadian Tax Payers and not think that your special non-profit corporation corporate vale will not very soon be pierced by our Federal Government and the DFO lawyers under environmental terrorism Bill-C41, abuse regulation laws concerning non-profits being deliberately set up and structured to force your own will’s on others and no everyone of yous belonging to it and sitting on its board being personally sued even if they sit on its board as a corporation executive of another corporation.

    I would advise to burn your intended demanding letter and save our Atlantic Salmon with the great amount of money that will be wasted when yous lose your non-profit immunity and are sued personally and charged with abusing non-profit special status for personal gains which is illegal and I am no lawyer.

    Brother taking Brother before the Law and that before the unjust is NOT the thing to do to people being able to sleep well, at peace and with a clear conscious at night in the future.

    You may not like what I post here and it may be that your thinking that desperate times demand desperate demand letters and suing others but I strongly and respectfully advise you to cease and desist from driving further wedges between Brothers and I send you this caution out of Brotherly love and peace and all things good, while noting that I will be defending myself as a Canadian Taxpayer upon my being sued by you or any one or by any falsely and wrongly setup abusive non-profit corporation or any law firm or anyone who sues me and please notify your lawyers in placing me on their 30 day defendants response list for my defense submission.

  5. I am glad that you have taken this action. Unfortunately it is extremely hard to litigate responsibility with the government of Canada .DFO has been the principle enemy of Atlantic Salmon since the mid 90’s. During that time they have almost totally eliminated protection branch .Closed hatcheries throughout the Mariitmes. Refused to act on the damages to salmon and lobster stocks precipitated by fish farms.Refused to acknowledge the dangers that stripped bass and smallmouth bass represented and used science branch as a reason for inactivity. A proactiveDFO could do much to reverse the decline of salmon stocks.It did in the 1980s ,it could again.

I have read this document a couple of times and discussed it with some of my
salmon fishing friends who have also read it. I’m not really sure what the
document is intended to accomplish or how it will accomplish it. I do know,
though, that for various reasons some of our most important salmon rivers are
really struggling, and in many cases for obvious reasons that DFO could do
something about.

I have been a riparian owner on the SW Miramichi and Cains Rivers in New
Brunswick for more than 20 years. I have written two books about these
rivers. In my limited time I have learned that the Miramichi historically, and still
today, hosts something close to 90% of all salmon fishing activity in NB. When
it comes to public ownership of fishing rights, private ownership of fishing
rights, indigenous participation in fishing and tourism fishing for Atlantic
salmon the Miramichi stands head and shoulders above virtually every other
river in Canada. The famous conservationist Percy Nobbs once wrote that the
spawning gravel of the Miramichi was roughly equal to that of all the salmon
rivers on the Gaspe combined. In 2011 we had a run of approximately 70K
Atlantic salmon and grilse. Everyone was quite happy - relatively minor
squabbles and poaching activity aside. The strength of the stocks seemed to be
getting better not worse. When you drive across the border heading in to
Houlton, Maine, the border guards usually look at you and simply ask “how was
the fishing.” They know you have been fishing on the Miramichi.
 
 
About this same time the ASF and the MSA discovered that the river’s growing
population of striped bass, which were gathered in the estuary and lower
reaches of the SW and NW rivers to spawn, were eating an increasing
percentage of the salmon smolts that were descending the river to reach the
sea. At that point we had around 100,000 striped bass. You folks know the
rest of the story.
 
Assigning a striped bass quota to the gaspereau traps in the Miramichi estuary
and partnering with the MSA hatchery could turn this situation around in 6 to
10 years. That is the kind of specific action that is needed. More consultations
or additional restrictions stacked in the way of recreational fishing
opportunities won’t help a bit. Recreational anglers aren’t now, never were
and never will be the problem. In addition to all of the economic benefits that
recreational angling brings to the Canadian Atlantic Provinces, the presence of
recreational anglers along with outfitters and guides is the greatest anti-
poaching tool available to DFO. Without a doubt, these days, poaching exacts
more mortality on Atlantic salmon than the tiny amount that comes from all
recreational salmon fishing activity.

Now is the time for a simple common sense approach and not more time-
consuming deliberations. Here is a simple formula for success:
· Open striped bass commercial fishing in the Miramichi estuary with a
commercial quota giving the gaspereau trap netters and rod and line
fishermen a chance to sell their catch. Set a flexible quota designed to
bring the striper population back to the 90 to 100,000 individual adult
fish that we know to be compatible with a similar sized salmon
population. This will cost the DFO nothing and be relatively easy to
supervise.
· Fund and assist the MSA hatchery’s stocking efforts allowing the activity
to take place on a scale that will bring the population back to 2010
levels. This should take no more than 10 years and will undoubtedly
show progress long before that.

We are the solicitors for Save Miramichi Salmon Inc., a new association based on the Miramichi River

Our client was formed to advance the cause of preserving and protecting the native Miramichi Atlantic
salmon. Our client’s members are a collection of stakeholders on the Miramichi River, including owners
of riparian land, private fisheries, and sport fishing guiding and outfitting businesses all of which have
direct interests, both personal and pecuniary, in the well-being of Atlantic salmon. Their individual
experiences all stretch back three or four decades with one member/directors family’s involvement in the salmon fishery spanning more than a century.
 
We write to you about a matter of utmost urgency and to demand your immediate action. The Miramichi Atlantic salmon are at a crisis point which now requires your immediate, vigorous and timely intervention to prevent the inevitable collapse of the species within the near future. This crisis has been precipitated by an explosion of striped bass which is a voracious predatory species of fish. The striped bass population must be brought under control without delay.

from noted fisheries biologists, former eminent senior DFO scientist, Dr. John Ritter and Dr. R. Allen
Curry, a senior scientist with the Canadian Rivers Institute and University of New Brunswick professor.
The briefing is based on literature, much of which is peer reviewed, and evidence collected from the river, both of which we have also enclosed.

times ahead for
François Legault
Former Minister Pierre Fitzgibbon, arguably the
most powerful minister in the Quebec government
over the last few decades, resigned from politics
on September 4, because he was… tired of poli-
tics. At nearly 70 years old, Mr. Fitzgibbon was no
longer willing to make the compromises required
in politics.
In time, we may learn more about the reasons
behind his decision to resign. However, whether
we liked him or not, his direct way of answering
questions usually allowed listeners to get the record
straight. It was both a strength and a weakness.
Coming from the business sector, Pierre
Fitzgibbon did not need politics to make a living.
By the time he was first elected in the riding of Ter-
rebonne in 2018, when the Coalition Avenir
Québec (CAQ) party formed the government, he
was already 63 and financially independent.
He quickly occupied a major function in that
government. That function was enhanced following
the 2022 election as the Energy portfolio in addi-
tion to his previous responsibilities in Economy
and Innovation. Scientific research was added to
his portfolio, though he showed little interest in
that field. In 2022, he was also tasked with Re-
gional Development and appointed minister re-
sponsible for Montreal.
An Outspoken
Minister
Journalists will certainly miss Pierre Fitzgibbon
for certain aspects of his personality. He was out-
spoken to a rare degree, almost a loose cannon at
times, and in a political world controlled by image
makers and public relations people, his positions
were most of the times refreshing.
His blunders also got him in trouble. Quebec’s
Ethics Commissioner launched six investigations
into Pierre Fitzgibbon's actions, notably because
of his close acquaintances with people from the
business sector. He often waived the fact that his
business contacts were theoretically supposed to
talk to him through the lobbying register if they
wanted to reach him.
He didn’t care much about the Ethics Commis-
sioner, as he rarely adjusted to her recommenda-
tion, which triggered cynicism in the public. He
didn’t care much about public criticism either.
Sophie Brochu, the former chief executive offi-
cer of Hydro-Québec, left the public utility because
of Pierre Fitzgibbon’s strong presence in her man-
agement, even though she never really came right
out and said that. She used more subtle ways to ex-
press the reasons behind her departure.
He was a man full of contradictions. He wanted
to channel a lot of electricity towards the new au-
tomobile, truck and bus battery manufacturing
plants that he promoted, only to say shortly after
that Quebecers had to reduce by half the number
of vehicles on their roads if they wanted to respect
the greenhouse gas emission targets.
Moreover, the individual car battery plant under
construction by Northvolt, a project he fiercely de-
fended, is far from what our society has to do in
order to respect those same emission reduction
goals.
Strange timing
for a departure
In business, most people who launch a project
will at least stay until the ribbon cutting ceremony
before leaving, or before launching another ven-
ture. In that, Pierre Fitzgibbon failed.
He had said on many occasions since the spring
that he would likely not stay until the end of his
term as Member of the National Assembly and, by
the same token, as the most powerful minister in
François Legault’s cabinet.
However, most people were expecting him to
stay at least until the end of the year, since the par-
liamentary session was about to start when he offi-
cially announced that he was retiring from politics
on September 4.
So, he will not be there to explain and defend
what he had himself called the utmost program of
his political career, the new energy policy that is
supposed to lead Quebec into the next decades. It
could have been a sound way to pull out of poli-
tics.
He decided otherwise. Again, Pierre Fitzgibbon
showed that he walks to the beat of his own drum.
He also leaves at a time when the Northvolt
project is experiencing problems.

The CAQ will face the test
of a by-election
Pierre Fitzgibbon and François Legault have a
long-standing friendship dating back to their busi-
ness days.
Pierre Fitzgibbon was the only person in the
premier’s cabinet who could say just about any-
thing he wanted, even if it was sometimes coming
in full contradiction with what François Legault
was expressing.
The premier has promised for months, if not
years, that Hydro-Québec’s rates for households
will never increase by more than 3% annually,
while Mr. Fitzgibbon knows darn well that they
will rise above 3% if the public utility is to keep
serving its customers while taking the decarboniza-
tion turn.
Saying that Pierre Fitzgibbon found a strange
way to help his friend Legault is an understate-
ment. Leaving politics at the dawn of the National
Assembly session was far from a nice goodbye
handshake, even though Mr. Legault, knowing that
his super minister would not finish his term, appar-
ently wanted him to quit now, instead of having to
face questions about that departure until 2025.
The CAQ government must now call a by-elec-
tion within six months. The riding of Terrebonne
has been represented by a Parti Québécois Member
of the National Assembly over 41 of the last 48
years. Pierre Fitzgibbon’s six years and a very short
term as an Action démocratique du Québec Mem-
ber of the National Assembly in 2007-2008 were
the sole exceptions.
Given Parti Québécois leader Paul Saint-Pierre-
Plamondon’s momentum of late, and given the rate
of dissatisfaction tied to the CAQ since the spring
of 2023, the Terrebonne by-election will represent
one hell of a test for François Legault.
Moreover, in his heavily centralized govern-
ment, as long as Pierre Fitzgibbon was around, the
premier could share some of the attention with his
friend.
Since nobody will likely occupy the spotlight
the way Pierre Fitzgibbon did, the attention will
converge towards Premier Legault. He has a ten-
dency to make blunders as well, and increasingly
since his October 2022 re-election.
François Legault has a wealth of experience in
politics and he can take blows. However, the tough-
est period of his National Assembly career could
well be ahead of him, instead of in the past.

Thank you for your various correspondence about abusive tax schemes,
and for your understanding regarding the delay of this response.

This is an opportunity for me to address your concerns about the way
the Canada Revenue Agency (CRA) deals with aggressive tax planning,
tax avoidance, and tax evasion by targeting individuals and groups
that promote schemes intended to avoid payment of tax. It is also an
opportunity for me to present the Government of Canada’s main
strategies for ensuring fairness for all taxpayers.

The CRA’s mission is to preserve the integrity of Canada’s tax system,
and it is taking concrete and effective action to deal with abusive
tax schemes. Through federal budget funding in 2016 and 2017, the
government has committed close to $1 billion in cracking down on tax
evasion and combatting tax avoidance at home and through the use of
offshore transactions. This additional funding is expected to generate
federal revenues of $2.6 billion over five years for Budget 2016, and
$2.5 billion over five years for Budget 2017.

More precisely, the CRA is cracking down on tax cheats by hiring more
auditors, maintaining its underground economy specialist teams,
increasing coverage of aggressive goods and service tax/harmonized
sales tax planning, increasing coverage of multinational corporations
and wealthy individuals, and taking targeted actions aimed at
promoters of abusive tax schemes.

On the offshore front, the CRA continues to develop tools to improve
its focus on high‑risk taxpayers. It is also considering changes to
its Voluntary Disclosures Program following the first set of program
recommendations received from an independent Offshore Compliance
Advisory Committee. In addition, the CRA is leading international
projects to address the base erosion and profit shifting initiative of
the G20 and the Organisation for Economic Co-operation and
Development, and is collaborating with treaty partners to address the
Panama Papers leaks.

These actions are evidence of the government’s commitment to
protecting tax fairness. The CRA has strengthened its intelligence and
technical capacities for the early detection of abusive tax
arrangements and deterrence of those who participate in them. To
ensure compliance, it has increased the number of actions aimed at
promoters who use illegal schemes. These measures include increased
audits of such promoters, improved information gathering, criminal
investigations where warranted, and better communication with
taxpayers.

To deter potential taxpayer involvement in these schemes, the CRA is
increasing notifications and warnings through its communications
products. It also seeks partnerships with tax preparers, accountants,
and community groups so that they can become informed observers who
can educate their clients.

The CRA will assess penalties against promoters and other
representatives who make false statements involving illegal tax
schemes. The promotion of tax schemes to defraud the government can
lead to criminal investigations, fingerprinting, criminal prosecution,
court fines, and jail time.

Between April 1, 2011, and March 31, 2016, the CRA’s criminal
investigations resulted in the conviction of 42 Canadian taxpayers for
tax evasion with links to money and assets held offshore. In total,
the $34 million in evaded taxes resulted in court fines of $12 million
and 734 months of jail time.

When deciding to pursue compliance actions through the courts, the CRA
consults the Department of Justice Canada to choose an appropriate
solution. Complex tax-related litigation is costly and time consuming,
and the outcome may be unsuccessful. All options to recover amounts
owed are considered.

More specifically, in relation to the KPMG Isle of Man tax avoidance
scheme, publicly available court records show that it is through the
CRA’s efforts that the scheme was discovered. The CRA identified many
of the participants and continues to actively pursue the matter. The
CRA has also identified at least 10 additional tax structures on the
Isle of Man, and is auditing taxpayers in relation to these
structures.

To ensure tax fairness, the CRA commissioned an independent review in
March 2016 to determine if it had acted appropriately concerning KPMG
and its clients. In her review, Ms. Kimberley Brooks, Associate
Professor and former Dean of the Schulich School of Law at Dalhousie
University, examined the CRA’s operational processes and decisions in
relation to the KPMG offshore tax structure and its efforts to obtain
the names of all taxpayers participating in the scheme. Following this
review, the report, released on May 5, 2016, concluded that the CRA
had acted appropriately in its management of the KPMG Isle of Man
file. The report found that the series of compliance measures the CRA
took were in accordance with its policies and procedures. It was
concluded that the procedural actions taken on the KPMG file were
appropriate given the facts of this particular case and were
consistent with the treatment of taxpayers in similar situations. The
report concluded that actions by CRA employees were in accordance with
the CRA’s Code of Integrity and Professional Conduct. There was no
evidence of inappropriate interaction between KPMG and the CRA
employees involved in the case.

Under the CRA’s Code of Integrity and Professional Conduct, all CRA
employees are responsible for real, apparent, or potential conflicts
of interests between their current duties and any subsequent
employment outside of the CRA or the Public Service of Canada.
Consequences and corrective measures play an important role in
protecting the CRA’s integrity.

The CRA takes misconduct very seriously. The consequences of
misconduct depend on the gravity of the incident and its repercussions
on trust both within and outside of the CRA. Misconduct can result in
disciplinary measures up to dismissal.

All forms of tax evasion are illegal. The CRA manages the Informant
Leads Program, which handles leads received from the public regarding
cases of tax evasion across the country. This program, which
coordinates all the leads the CRA receives from informants, determines
whether there has been any non-compliance with tax law and ensures
that the information is examined and conveyed, if applicable, so that
compliance measures are taken. This program does not offer any reward
for tips received.

The new Offshore Tax Informant Program (OTIP) has also been put in
place. The OTIP offers financial compensation to individuals who
provide information related to major cases of offshore tax evasion
that lead to the collection of tax owing. As of December 31, 2016, the
OTIP had received 963 calls and 407 written submissions from possible
informants. Over 218 taxpayers are currently under audit based on
information the CRA received through the OTIP.

With a focus on the highest-risk sectors nationally and
internationally and an increased ability to gather information, the
CRA has the means to target taxpayers who try to hide their income.
For example, since January 2015, the CRA has been collecting
information on all international electronic funds transfers (EFTs) of
$10,000 or more ending or originating in Canada. It is also adopting a
proactive approach by focusing each year on four jurisdictions that
raise suspicion. For the Isle of Man, the CRA audited 3,000 EFTs
totalling $860 million over 12 months and involving approximately 800
taxpayers. Based on these audits, the CRA communicated with
approximately 350 individuals and 400 corporations and performed 60
audits.

In January 2017, I reaffirmed Canada’s important role as a leader for
tax authorities around the world in detecting the structures used for
aggressive tax planning and tax evasion. This is why Canada works
daily with the Joint International Tax Shelter Information Centre
(JITSIC), a network of tax administrations in over 35 countries. The
CRA participates in two expert groups within the JITSIC and leads the
working group on intermediaries and proponents. This ongoing
collaboration is a key component of the CRA’s work to develop strong
relationships with the international community, which will help it
refine the world-class tax system that benefits all Canadians.

The CRA is increasing its efforts and is seeing early signs of
success. Last year, the CRA recovered just under $13 billion as a
result of its audit activities on the domestic and offshore fronts.
Two-thirds of these recoveries are the result of its audit efforts
relating to large businesses and multinational companies.

But there is still much to do, and additional improvements and
investments are underway.

Tax cheats are having a harder and harder time hiding. Taxpayers who
choose to promote or participate in malicious and illegal tax
strategies must face the consequences of their actions. Canadians

Pierre Poilievre vs. the Longest Ballot Committee

For the second time this year, Conservative Leader Pierre Poilievre’s name will appear on one of the longest electoral ballots in Canadian history. Poilievre — and nearly 200 other people — are candidates in a byelection in Battle River-Crowfoot following the resignation of Conservative MP Damien Kurek to make way for Poilievre’s return to the House of Commons after his April loss in Carleton.

Most of these candidates are affiliated with the Longest Ballot Committee, a group seeking to draw attention to itself by flooding ballots with as many candidates as possible in high-profile ridings. Mr. Poilievre has called these actions a “scam” and a “blatant abuse” of electoral democracy. He’s right. The Longest Ballot Committee’s ballot-hijacking has no democratic value, serves no public purpose, and stands no chance of setting up a serious conversation about electoral reform. But Canadian democracy is strong enough to handle this kind of nonsense without overreacting. Let’s not dignify their stunts with a response – especially not a legislative one.

Spokespeople for the Longest Ballot Committee claim that their objective is to start a public dialogue about changing the way we run elections. They take issue with the fact that politicians and political parties are the ones who decide the rules of engagement when it comes to voting, citing a conflict of interest because they stand to benefit from the rules they design. The Longest Ballot Committee argues that a citizens’ assembly is the best and fairest way to make decisions about how electoral democracy works in Canada, including the timing of elections and which electoral system we use.

To be fair, many people would agree with their stated objectives. Electoral reform advocacy has been alive and well in Canada for years and, as we learned when former Prime Minister Justin Trudeau abandoned his promise of electoral reform back in 2017, there is reason to think that politicians – especially the ones who win enough votes to form government – are deeply reluctant to change the rules.

But let’s call B.S. on the tactics of the Longest Ballot Committee, which are disconnected from its stated goal and potentially damaging to the democracy that they claim to care so much about. Long ballots are not a design flaw of first-past-the-post systems. In fact, if we were to switch to a proportional system like the single transferable vote, our ballots would be longer because parties would run more than one candidate in multi-member ridings.

What the Longest Ballot Committee is really doing is mocking the provisions in our election law that make the ballot accessible, particularly to independent candidates without powerful networks, all while claiming to have a beef with the concentration of power in the hands of political parties.

Their actions prove how easy it is to get one’s name on a ballot. All you need to do is obtain the signatures of 100 people living in the riding and have an official agent file your paperwork. You don’t even have to live in the riding. The Longest Ballot Committee helps their affiliated candidates to meet this threshold by having constituents sign multiple candidates’ forms and by having the same official agent file on behalf of numerous candidates, all of which is permitted under the law.

Essentially, the Longest Ballot Committee is doing the signature collection work that would normally be absorbed by a single candidate and then using that list for as many willing participants as they can find.

The fact that election law allows eligible individuals to run in whatever riding they want – not necessarily the riding they live in – means that the Committee can draw from a larger pool of people willing to attach their names to this endeavour.

    Let’s call B.S. on the tactics of the Longest Ballot Committee, which are disconnected from its stated goal and potentially damaging to the democracy that they claim to care so much about.

The Longest Ballot Committee has targeted several ridings over the past few years, including Carleton in the 2025 general election and Toronto-St. Paul’s in the byelection of 2024. Its candidates’ vote share, even when added together, has been negligible. In Carleton, none of them won any more than .1% of the vote. So, committed politicians needn’t worry that the Committee’s efforts will result in vote-splitting. Voters aren’t biting.

Further, there is zero evidence that these stunts have led to any kind of serious discussion about electoral reform. If anything, their tactics undermine their message by making them look like high school pranksters with too much time on their hands.

If the Longest Ballot Committee is having any effect on democracy at all, it is a negative one. It is possible that ballots with so many names on them will be confusing to voters. It is also possible that serious independent candidates, like Bonnie Critchley in Battle River-Crowfoot, will have a very difficult time distinguishing themselves from other independent candidates on the ballot.

But the true victims of the Longest Ballot Committee are the staff at Elections Canada who are stuck counting three-foot ballots into the wee hours of the morning. It is their unhappy job to pour over these things with a fine-toothed comb, searching for the voter’s X and ensuring that the ballot is not spoiled.

In a letter to Liberal House leader Steven MacKinnon in which he calls for legislation to ban long-ballot shenanigans, Mr. Poilievre wrote the following of those candidates affiliated with the Longest Ballot Committee: “They aren’t real candidates. They aren’t campaigning. They aren’t engaging with constituents.” Again, he’s right.

Poilievre is suggesting we combat long ballots by requiring that candidates obtain signatures from 0.5% of a riding’s population rather than the current requirement of 100 signatures. Also, he says that official agents should not be permitted to represent more than one candidate and that voters should not be permitted to sign more than one form. His ideas, if passed into law, would blow up every aspect of the Longest Ballot Committee’s strategy. This is tempting, but we should not write or amend election law based on bad faith actors.

These rules would make it more difficult for good faith independent candidates to throw their hats in the ring, which would further entrench the power of political parties as gatekeepers of electoral democracy. Let’s not give the Longest Ballot Committee the satisfaction of proving their point. And frankly, it’s already hard enough to get people to run for office. We should not make it a steeper climb.

Democracy is meant to be accessible to everyone. Otherwise, we cannot meaningfully and truthfully claim that our constitutional right to political equality is real. There will be times when individuals or groups take advantage of this just to get their names in the paper, but it’s nothing we can’t handle. Any measure taken to make the ballot less accessible to jokers will apply equally to people who want to run for the right reasons. It’s not worth the sacrifice.

Alexandra Moore started the website in 2018 but it was during the COVID 19 Pandemic that the site really took off. Alexandra is not a lawyer. She is a concerned citizen about the rights of people being run roughshod over by the justice system and she has sharp criticism of lawyers whom she says have failed their clients. Much of her recent posts deal with the cases dismissed from courts across Canada that may soon take up a nomenclature as “COVID 19 Jurisprudence.”

(Delivered orally from the Bench in Fredericton, New Brunswick, on
December 14, 2015)

The Plaintiff seeks an appeal de novo, by way of motion pursuant to
the Federal Courts Rules (SOR/98-106), from an Order made on November
12, 2015, in which Prothonotary Morneau struck the Statement of Claim
in its entirety.

At the outset of the hearing, the Plaintiff brought to my attention a
letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal).  In that letter
he stated:

As for your past President, Mr. Bell, may I suggest that you check the
work of Frank McKenna before I sue your entire law firm including you.
You are your brother’s keeper.

Frank McKenna is the former Premier of New Brunswick and a former
colleague of mine at the law firm of McInnes Cooper. In addition to
expressing an intention to sue me, the Plaintiff refers to a number of
people in his Motion Record who he appears to contend may be witnesses
or potential parties to be added. Those individuals who are known to
me personally, include, but are not limited to the former Prime
Minister of Canada, The Right Honourable Stephen Harper; former
Attorney General of Canada and now a Justice of the Manitoba Court of
Queen’s Bench, Vic Toews; former member of Parliament Rob Moore;
former Director of Policing Services, the late Grant Garneau; former
Chief of the Fredericton Police Force, Barry McKnight; former Staff
Sergeant Danny Copp; my former colleagues on the New Brunswick Court
of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted
Police.

In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so.


AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion.  There
is no order as to costs.

On page 99 of this years CPP IB annual report, "Total Liabilities" Increased to $ 220,040 Millions. The increase in financial liabilities, in recent years, has been faster than the increase in total asset values and assets comprise the sum of pretend increases in "private equity investments" ( those not valued from open market/public trading) , the increase from publicly traded securities and from taxation of worker's incomes. In addition, the reported financing expenses for the past year came in at $7,213 Millions. It suggests a "bleeding out" of pension money , fulfilling the prophesy given by Brooksley Born , in the late 1990s, when she used the term "tape worm" economics (the parasite consumes the host until both are dead).

 

Coming into this century there was a very large number of documented "Trading Losses" from "the smartest guys in the room", thinking investing in derivatives would make them heroes. The use of personal financial incentives might have also played a part. From one public report, the investing in derivatives was characterized as gambling , a 90% loss rate.

 

This is my last attempt.at intervening at the CPP IB. From the reported evidence , over the past 20 years, it looks like the Canadian Government planned and still plans to ride it out or ride it into the ditch. The then Members of Parliament , in 2007, accepted accountability for Derivative Investments, but whether the current MPs will see it that way has yet to be determined.

 

For those relying on other pensions, do not make the mistake of thinking you pension money is not exposed to this kind of loss risk. The few other plans I have looked at also have this type of investment.
