Arbitration system broken, says Saint John mayor on heels of new police contract

'If the province is looking for an example of why the arbitration process is broken, they need look no further than Saint John," Mayor Don Darling said in a statement. (CBC)

A "looming" arbitration process with the city's police officers was weighing heavily on the minds of the Saint John Police Commission members when they reached a new contract agreement last week, Mayor Don Darling said Monday.

"The arbitration process is essentially ignoring the fact that our municipalities are unique, just like our employers are unique around this province, it ignores the ability-to-pay piece, and assumes that we can just ask our citizens to pay more," Darling, a member of the commission, said in an interview with Information Morning Saint John.

"With that as your option looming over you, there's

not a lot of appetite to go to arbitration."

The Saint John Police Commission announced the surprise deal Thursday morning, after it was ratified by members of the Saint John Police Association on Wednesday. It comes more than two years after their last labour contract expired.



The new four-year deal includes wage increases totalling 10.25 percent over four years — 2.75 per cent and 2.5 per cent retroactively for 2016 and 2017 and 2.5 per cent this year and next year.

The wage hike doesn't tell the whole story of the contract, said Const. Duane Squires, president of the Saint John Police Association.

"When you enter into negotiations, it's not all about money," he said. "There are other things your members want and ask for … and it was a lengthy process.

"We feel the package is fair, but we also feel that there were concessions made related to time off and overtime, which our members will directly see, but it also helps, we think, it will help with the financial situation."

Arbitration sided with firefighters 


The two sides had been in a deadlock and scheduled to head to arbitration on Feb. 12, just as the city's firefighters union did last month, landing a ruling in their favour.

Darling — who in a statement last week, called the arbitration process broken — said his opinions aren't a reflection of his views toward the city's first-responders.

"This has nothing to do with respect for our members … it does have to do with our ability to pay, and our ability to keep up with wage increases that have continued to be double the rate of inflation," said Darling.

"The arbitration process … has this premise that we can just put taxes up … and I reject that belief the system seems to have."

$9.4 million impact


In the case of the firefighters union, an arbitration board approved a 2.97 per cent annual wage increase from 2015 to 2018, and a 2.96 per cent increase in 2019.


That award "will impact the citizens of Saint John, the folks who pay the bills," by $9.4 million over the period of the contract, Darling said.

"These are pay scales that most people would dream to achieve, and we are investing the largest portion, 33 per cent of our budget into protective services."

He said he's concerned the cost of the agreements will force the city to employ fewer people.

"I don't think anyone wants that either."

$205 million in debt 


Meanwhile, the union wants to work with the police commission, despite "the situation the city is portraying about its financial issues," Squires said.

"We believe there are some people that had an agenda, and I guess we worked through that now.

"And the commission, which has members of council on it, passed the ratification vote in a majority, and our members passed it in a majority, and we'll work together and move forward."

Overall the municipality's $152 million budget for 2018 is $1.4 million lower than last year. Darling has said the city is more than $205 million in debt and can't ignore its financial situation.

The police and fire department budgets were each cut by $1.25 million.

GRAND BAY-WESTFIELD – The New Brunswick Liberal Association held a nomination convention Thursday night for the next provincial election on September 24, 2018.  Bill Merrifield was nominated as the Liberal candidate for Kings Centre in an uncontested meeting.

Premier Brian Gallant, who is also Leader of the New Brunswick Liberal Party, was present at the nomination and commended Merrifield on his professional accomplishments and community involvement. “With Bill’s experience, knowledge, and community involvement he will be a strong voice for the people of Kings Centre.” said Gallant.

William (Bill) Merrifield has deep roots in the community. He was volunteer Chair of Stonehammer UNESCO Global Geopark from 2010 to 2014 and remains member of board and Executive Committee.  He was appointed by UNESCO Global Geopark Network as field evaluator and revalidations of existing Global Geoparks in May 2016. He has been actively involved in official UNESCO application process and corporate/government fundraising since 2008.  He is past president of Lily Lake Pavilion Inc., and co-founder of the annual Pavilion Cup Pond Hockey Tournament and New Brunswick’s All American Soap Box Derby to raise funds for outreach programmes offered by the Pavilion for children and adults with financial and physical challenges.   His commitment as a volunteer has been formally recognized many times, including as recipient of the Queen Elizabeth Diamond Jubilee Medal for community service (2012), recipient (on Stonehammer’s behalf) of Deloitte Innovator of the Year Award (2011) and recipient of City of Saint John Volunteer of the Year (fundraising – 2010).

Merrifield is a Professional Wealth Manager engaged in the financial services industry since 1986 and is presently a Senior Investment Advisor.  He has been married to his wife Dawn for 48 years, and together have 2 daughters (Shannon and Brittany) and 6 grandchildren.

Robert Jones has been a reporter and producer with CBC New Brunswick
since 1990. His investigative reports on petroleum pricing in New
Brunswick won several regional and national awards and led to the
adoption of price regulation in 2006.

Properties under the sea are often associated with a cartoon character
in square pants, but a parcel in Saint John Harbour is becoming a real
life sponge for controversy.

The land, which covers two square kilometres of ocean floor near
Mispec Point, was sold by the New Brunswick government to Irving Oil
Ltd. for more than $800,000 in 2013 but is now assessed for taxes at
less than $170,000.

Gerry Lowe, a Saint John city councillor, thinks this is a sign New
Brunswick government property assessors are not doing their jobs
properly.

"I don't have any faith at all," Lowe said.

"If you buy a house for $240,000 it will be assessed at $240,000."

Gerry Lowe, a Saint John councillor, says if an independent appraisal
found Irving Oil's undersea parcel to be worth more than $800,000,
that's the value the province should use in its assessment. (CBC)

Lowe is convinced assessors routinely undervalue the worth of the
city's industrial properties, costing Saint John critical tax dollars.

In a unanimous vote last month, Saint John common council agreed to
Lowe's request that the city independently review whether assessments
and taxes in the city are being calculated fairly by comparing them to
similar properties in other provinces.

"It's the assessment that bothers me," Lowe said.

"Things that are assessed here in this province are assessed in other
provinces (for more) — I'm talking millions and millions and millions
difference."

Irving tank farm

Irving Oil bought the underwater parcel of land near its Canaport oil
tank farm, where it hopes to build a marine terminal for the Energy
East pipeline. (CBC)

In the case of the underwater lot, Lowe thinks the problem is even clearer.

The parcel sits just off the coast from Irving's Canaport oil tank
farm, close to where the company hopes to build a marine terminal for
the Energy East pipeline.

All sea floor property in and around New Brunswick is considered Crown
land but occasionally parcels are carved out and sold to private
owners. Irving Oil owns four separate lots at Mispec Point covering
more than six square kilometres of the sea floor surrounding its LNG
and oil tank farm properties onshore.

In an email, Irving Oil spokesman Andrew Carson said he was travelling
out of the country and could not immediately provide information on
what the $800,000 underwater property was for, but the sale was agreed
to by the province in 2013 and handled by the Department of
Transportation and Infrastructure.

Sought independent appraisal

According to department spokesman Shawn Berry, the province
commissioned a third party to help establish what it should charge for
the land.

"As required by the Public Works Act, the Department of Transportation
and Infrastructure had the property appraised by an accredited
appraiser to determine fair market value in order to carry out the
transaction," Berry said in an email for CBC News.

The department won't share that report, but based on it, the province
and Irving Oil reached an agreement on a price for the land —
$816,750.

Councillor says city loses

Two months later, however, when property tax bills were prepared, the
province assessed the new parcel to be worth, for tax purposes,
$160,900. In the two years since, that assessment has increased one
per cent, to $162,500

Lowe said the assessment has cost the city a significant amount of tax
revenue and believes if the underwater property was independently
appraised to be worth more than $800,000 and province and Irving Oil
agreed on that as a sale price, the assessment should reflect that.

Stephen Ward, the province's director of property valuation, said he
knows people do not always understand or agree with the property
assessments his department calculates.

    'The one thing that really stands out in this sale is Irving needs
that piece of property.'

But he insists it is all done according to professional standards and
without any political or outside influences affecting decisions

"We don't feel any kind of intense pressure politically to put this
value on or that value," Ward said. "We do our job based on what the
market information tells us."

In the case of the sea floor property, Ward said Irving paid
substantially more than what several other underwater lots in the
harbour are assessed to be worth, so the purchase price was not
considered a true market value.

Impressed by company's need

"The one thing that really stands out in this sale is Irving needs
that piece of property," Ward said.

"They're willing to pay above and beyond to have ownership of that
property. But just because they overpay for that property — that we
feel (they) have overpaid — we just can't increase Irving's assessment
up to that sale price because that's only one sale in the market
place."

Ward said all underwater properties in the Saint John harbour have to
be assessed as a group — and the Irving purchase appeared to be an
outlier.

"Last year, when the details of how much money Irving Oil was making
from the Repsol joint venture came to light, the city council became
so angry they demanded the provincial government scrap the tax
concession (which the government has so far refused to do).

Moreover, according to city councilor Gerry Lowe, the terminal only
created 51 jobs. “There is no problem giving a tax break if people
work there,” he says. “But not a ninety-five per cent one for 25 years
– that's totally scandalous.”

Meanwhile, Lowe says the city is in dire financial straits, with a
$76-million pension liability and unable to afford to replace retiring
firemen and police officers.

Lowe also notes the Irving Oil refinery pays only $5-million in taxes
to the city and province, while refineries of similar capacity pay
three times that sum. “We are looking for a fair deal because who's
paying the taxes in the city – it's the residential people.”
