AMHERST, NS – Cumberland North MLA Elizabeth Smith-McCrossin has withdrawn her legal action against the PC government in which she challenged the constitutionality of a Notice of Motion the government had introduced calling for her removal from the Nova Scotia House of Assembly.

“The original Notice of Motion was introduced by Karla McFarlane when she served as Minister of Community Services however, in light of the announcement of her decision to resign, the motion can only be brought forward with unanimous consent of the House. For that reason, I have decided to withdraw my court challenge,” said Smith-McCrossin. Last week, Ms. McFarlane announced her resignation as Speaker of the House and as an MLA.
In April 2023, Smith-McCrossin’s lawyers sent correspondence to the Minister of Justice challenging the legality of the Notice that requested Smith-McCrossin’s removal from the House unless she retracted statements made on March 29, 2023. Smith-McCrossin had been speaking in support of a bill she had introduced to end the use of non-disclosure agreements (NDAs) by political parties in cases of sexual assault. The motion threatened to have Smith-McCrossin removed from the House potentially on a permanent basis.
 
Amherst resident Vanessa Knock, who also launched a court challenge because she believed the action was undemocratic, has withdrawn her case as well. “I only pursued the legal action because Elizabeth was elected by the residents of Cumberland North and I refused to allow the government to take away her ability to represent all of us without a fight. With the case withdrawn, I do feel a sense of victory although it should never have been necessary in the first place.”
 
“The motion before the House of Assembly was unconstitutional”, noted Kevin Deveaux, a former Nova Scotia MLA who has worked directly with more than 80 parliaments globally as part of his work in building democracies world-wide. “I hope the government has learned a lesson from this process and will no longer threaten arbitrary suspension of an MLA just for advocating on behalf of those impacted by NDAs related to sexual assaults. Ms. Smith-McCrossin was using her freedom of speech privilege as an MLA to draw attention to an issue the government wishes would not be raised, but that does not enable them to abrogate the rights of an MLA to speak for her constituents.”

PM fires back at carbon tax opponents amid protests over carbon price hike

The price of carbon rose from $65 to $80 per tonne on Monday. Prime Minister Justin Trudeau says premiers opposed to the carbon tax are playing politics. But Grain Farmers of Ontario chair Jeff Harrison says the escalating tax has driven up production costs in his industry , placing a mental burden on farmers.
