Open-pen salmon farming to continue in N.B., despite closure on West Coast
After DFO decision to ban B.C.'s open-pen farms, N.B. minister says provincial industry is open for business
Although salmon farms with open net pens have their critics in New Brunswick, the provincial aquaculture minister says she wouldn't support a ban, something just announced for Canada's West Coast.
Last week, Fisheries and Oceans Canada said the practice would be banned in British Columbia waters by 2029, a delay from earlier promises to ban this by 2025.
Despite the federal decision, New Brunswick continues to support marine-based net-pen salmon farming," Aquaculture Minister Margaret Johnson said in a statement.
"We are open for business and encourage new investment in this ever-evolving sector that supports many coastal communities."

CBC News requested an interview with Johnson but was instead sent an email statement.
The federal government oversees aquaculture in B.C., but it's under provincial jurisdiction in New Brunswick.
"Elsewhere in Canada, where provinces and territories are the lead regulator, Fisheries and Oceans Canada respects their jurisdiction," the DFO release said.
The announcement has received both praise and scorn from industry stakeholders in British Columbia and mixed reactions from First Nations on the West Coast, some of whom rely on the industry for jobs.
A spokesperson for the Wolastoqey Nation, which claims most of the Fundy coast as part of its unceded territory, said the nation is still gathering information about the industry.
"We have raised a number of technical questions to the province and industry regarding the impacts that aquaculture has on wild salmon and the environment over the years, but we do not feel that the responses have been adequate thus far to allay concerns," the spokesperson said.
Chief Hugh Akagi of the Peskotomuhkati Nation at Skutik, whose ancestral lands include the region where salmon aquaculture is concentrated in New Brunswick, did not respond to requests for comment.
DFO's announcement of the closure in B.C. said wild salmon face "unprecedented threats to their survival," and the federal government wants to promote "more sustainable aquaculture practices."
But Johnson said salmon farming has been a sustainable industry in New Brunswick for 40 years and is a significant contributor to the province's economy.
The Aquaculture Department says New Brunswick's latest numbers, from 2022, show $312.8 million worth of salmon exports from the province that year.
Johnson did not say whether she viewed salmon farming as a threat to the wild Atlantic salmon population.
"Wild Atlantic salmon populations are at risk from a variety of impacts," she said. "We have the ability to manage aquaculture through our various regulatory elements.
Conservation groups see issues in N.B.
Two New Brunswick conservation groups, the Atlantic Salmon Federation and the Conservation Council of New Brunswick, have been outspoken about the risks that open-net-pen salmon farming poses in the province.
Problems with the industry that exist on the West Coast are worse on the East Coast, said Neville Crabbe, a spokesperson for the salmon federation.
Crabbe said it's been demonstrated that issues of sea lice and disease concerns, escaped farm salmon, and interbreeding between farm and wild salmon have been shown to exist in New Brunswick.
Instead of an outright ban, the federation's position is that the industry should not expand further in New Brunswick, he said.

"It's not the level of performance that warrants expansion, and ASF believes that the industry should make use of their current licences and find a way to rectify and improve their operations, reduce their harms on the environment, and stay put where they are," he said.
Matthew Abbott, the conservation council's marine co-ordinator, said he's not surprised by the province's stance following the decision about B.C.
"They've long supported salmon aquaculture, regardless of the significant impacts we've seen," Abbott said.
"The provinces on the East Coast have shown they're not terribly likely to challenge some of the impacts of the industry."
Abbott also pointed to the dangers of escaped farm salmon, interbreeding, and illegal pesticide use, all of which he said have been scientifically proven to exist in New Brunswick.
He said open-net-pen salmon farms are made up of a large plastic ring that floats on the surface of the ocean, with nets extending down into the water. There's another net covering the top to keep birds away, and another net underwater to keep predators away from the salmon swimming in the pen.
They're called open-net pens because while the nets keep the salmon inside, aquaculture byproducts like uneaten food for the salmon, feces, urine, and any chemicals used can simply float out into the ocean.
The council takes the position that salmon farming should move to closed-containment, land-based salmon pens instead.

"This industry has shown us that it needs to be closely watched, it's shown us that its primary concern, as you'd expect from a business, is to make money."
Abbott said he especially took issue with Johnson's declaration the province is 'open for business' in the industry, adding that waters here are too densely packed already with salmon aquaculture.
An interactive map on the province's government website shows all leased finish aquaculture sites. Johnson's statement said there are currently 86 open net-pen sites that fall under a "stringent regulatory regime" along with other provincial and federal regulations.
Abbott said each site can have anywhere from six or seven up to about 15 open net-pens.

"We have more sites than is responsible, in my mind," Abbott said.
"And the notion we would try and entice more activity here is irresponsible, at best."
Crabbe said the province is second to British Columbia in terms of tons of salmon produced.
The industry here "has reached the point of saturation," Crabbe said.
Cooke says practice is safe, supports economy
New Brunswick-based Cooke Seafood, an aquaculture company that touts itself as the world's largest private family-owned seafood company, is a major player in the province's salmon farming industry.
"The provincial government's position is clear — New Brunswickers support the thousands of fellow coastal New Brunswickers who work in the seafood sector including responsible and sustainable salmon aquaculture to produce local food for grocery stores," Cooke spokesperson Joel Richardson said in an email statement.
He also said that ocean finfish aquaculture, which includes salmon farming, is the "most efficient" form of animal protein farming on earth with the lowest carbon footprint.

Unprompted, Richardson's statement had strong words for Atlantic Salmon Federation, which had no involvement in DFO's ban in British Columbia.
"Atlantic Canadians don't believe the lies about aquaculture being promoted by environmental activists like the Atlantic Salmon Federation who only care to fearmonger through desperate fundraising tactics off the backs of hard-working people in coastal communities," Richardson said.
In response to the Cooke statement, Crabbe called the federation "principled and reasoned" and has been researching the aquaculture industry in New Brunswick for over 50 years.
"I think it betrays a deep insecurity on their part," Crabbe said.
"That rather than talk about the known and scientifically documented impacts of their operations, they're quick to point their finger at a critic."
New Brunswick's position on the open-net salmon farming has support from a political opponent.
Saint-John Rothesay Liberal MP Wayne Long called out his own government in a social media post over the B.C. ban, and expressed thanks to Premier Blaine Higgs and Johnson for supporting the industry in New Brunswick.
"Great to see us get it right on one coast," Long said in the post. "I'm still shocked by the shameful decision by my gov. on the West Coast putting B.C. coastal and First Nation communities at risk.
Long could not be reached for comment.
Scientists differ on threat from Atlantic salmon that escape into the wild
One expert says wild and farmed salmon are the same, another says 'absolutely not'
As an Atlantic salmon advocacy group raises the alarm over escapes from New Brunswick salmon farms, two scientists are divided over whether farmed fish are a risk to their wild counterparts.
The Magaguadavic River has been the focus of the Atlantic Salmon Federation's data on fish that escape from the salmon-farming industry's open water nets in the Bay of Fundy.
A federation release earlier this fall said it had captured 46 escaped salmon in the Magaguadavic since Aug. 1, and argued they present a "high-level threat to wild salmon."
The group said farmed salmon are genetically different from wild salmon because of "intensive inbreeding for commercial traits" and crossing with European species.

Brian Glebe, who has worked with Atlantic salmon for 45 years, including with the Department of Fisheries and Oceans and in the aquaculture industry, said escaped farmed salmon don't pose a threat to the wild salmon population on the Magaguadavic, because the fish are genetically the same.
"The Magaguadavic River is a unique river in that it never had a wild [salmon] population," said Brian Glebe.
Glebe said a fishway was constructed on the Magaguadavic in the 1920s, which allowed fish passage through the river from Passamaquoddy Bay, an inlet of the Bay of Fundy.
There were no salmon in the river, he said, so it was stocked with smolt, a juvenile salmon, from the St. John River system.
That same population in the St. John River system was used to start the salmon aquaculture industry in the region, Glebe said.
"What they're calling wild fish are really the same genetic stock," Glebe said.
Another scientist says the opposite, however.
Scott Pavey, a professor and Canada Research Chair at the University of New Brunswick Saint John, is with the Canadian Rivers Institute and studies the genetics of fish and fisheries.
He said the escaped farmed salmon are absolutely not the same fish as any stocked "wild" salmon in the Magaguadavic, which they're at risk of interbreeding with.
The farmed salmon "would be the same species, but that would be a domestic strain that's gone many, many rounds of artificial selection by humans compared to fish that have been in the wild and have been influenced by natural selection," Pavey said.

He said the aquaculture industry desires certain traits such as how the fish filets look as well as faster breeding and disease resistance.
"It's going to include a bunch of other traits that really don't have anything to do necessarily with a wild salmon being evolutionarily successful, which would mean reproducing in nature," Pavey said.
He said that escaped farmed salmon are certainly a threat, and it's been shown that they can breed with wild salmon and produce offspring that are less genetically fit for survival and reproduction.
"That would be considered to be not a great thing that would be good to minimize," Pavey said.
But despite the threat of escapes, Pavey said, aquaculture has environmental benefits.
For example, he said, the salmon farming industry is far less damaging in terms of its carbon footprint and water use than the beef industry.
"It's a very low carbon food source, there's a lot of bang for your buck with fish aquaculture," Pavey said.
Salmon company 'puzzled' by claims
Cooke Aquaculture, the company the Atlantic Salmon Federation blames for the escaped salmon, would not provide anyone for an interview, but spokesperson Joel Richardson emailed a statement.
The statement acknowledged there was damage to three ocean nets in August from seals but said the salmon inside were likely eaten by the seals and not able to escape.

Richardson disagreed with the claim that Cooke salmon are "genetically different."
"Cooke only uses native, non-genetically modified St. John River Atlantic salmon strain in our breeding program — this is well-documented and highly regulated," Richardson said.
Cooke only uses salmon bred from the St. John River strain, he said, and it's the same strain that has been released in the Magaguadavic and other rivers in the province.
"We are puzzled by the ongoing disinformation being asserted by the Atlantic Salmon Federation that farmed salmon are a high-level threat to wild Atlantic salmon, or that they are cross-bred for commercial traits," Richardson said.
Why federation uses Magaduavic in research
Jonathan Carr, vice-president of research and environment with the salmon federation, acknowledged the Magaguadavic doesn't really have wild salmon, but he said the river is used as what's called an "index river" for scientists and government to measure how many fish could be escaping in a certain region.
"The real threat here is not [to] the Magaguadavic River in terms of wild stock," Carr said in an interview. "The wild stock is virtually gone.
"It's the surrounding rivers in the Bay of Fundy and the inner Bay of Fundy that are at high risk if we're finding this many escapes."
Carr said his organization has been monitoring the Magaguadavic for escaped salmon annually since 1992. He said the river was specifically chosen because it's in the "heart of the aquaculture industry" and because of the fish ladder, it's easy to collect and count fish that pass through.
Salmon farming begins with hatched fish that grow to a juvenile stage in freshwater tanks on land, then are transported to cages in the ocean to fully mature before being harvested.
Carr said there are body differences in the farmed salmon, as well as differently shaped scales.
"You can tell just by looking at them that these aren't wild fish," Carr said.
He said interbreeding between farmed and wild fish is dangerous, because less-fit genes are passed on. He echoed Pavey's concerns that the farmed salmon are fundamentally different from wild salmon.
"In as simple terms as possible, the fish reared in the industry have lost their wildness," Carr said.

He also added that wild salmon are at risk of picking up diseases and sea lice when they are near farm cages.
As for Cooke's claim that its farmed salmon are "non-genetically modified," Carr said this is "absolutely true," but selective breeding falls outside the definition of genetic modification, as "you can still genetically select traits without messing with organisms."
Carr said the federation is concerned there aren't efforts to catch escaped fish in nearby rivers. It has called on DFO to require farmed fish to be tagged so they can be identified more easily if they escape.
He also said the federation has offered samples of the collected fish to DFO and Cooke Aquaculture.
DFO's response to federation claims
The Department of Fisheries and Oceans would not provide anyone to speak about the issue but sent a statement.
Under the federal Fisheries Act, "DFO only licenses the stocking of farms with Atlantic salmon that have been assessed for disease, genetic or ecological risks, including consideration of mitigation measures, and that pose low risks to wild fish and their habitats," it said.
It said DFO licenses the federation to capture and record escaped farmed salmon, so the department is aware of he group's reports.
DFO recently convened a national meeting on risks posed to wild Atlantic salmon's numbers and diversity by "direct genetic interaction with fish that have escaped from East Coast Atlantic salmon aquaculture facilities." A report is due later this year.
Call for 'balanced approach'
Reflecting on his own change of opinion on salmon farming, Scott Pavey said people should take a balanced approach to the topic.
He said he was first against the practice, citing instances of escaped fish on West Coast farms. But the industry is now better at preventing escapes, said Pavey, who comes back to his thought that farming salmon is much better environmentally than raising beef, pork or chicken.
"Because there's advocates that are pretty opinionated on either side and there's advantages and disadvantages to farming salmon, and you've got to look at it in a balanced way," Pavey said.
Public needs educating, scientist says
Brian Glebe said that he feels the federation doesn't appreciate the advances the aquaculture industry has made to deter escaped fish. Fish cages now have lights shining on them 24 hours a day, which he said prevents them from maturing to a sexually active stage.
"If you don't have maturing fish when they escape, they don't breed with wild fish. Period," Glebe said.
It's also good business to eliminate salmon escapes, he suggested.
"No salmon farming company wants to lose fish, you're losing profit," Glebe said.
Ultimately, Glebe said, governments and public interest groups aren't always fully knowledgeable on the latest practices inside the aquaculture industry and could be better educated.
He also wants to see all parties combine their efforts to focus on the real issue of declining natural populations of salmon.
"It's just not happening, there's so much adversarial effort going on," Glebe said.

Advocate wants stricter regulations after escaped aquaculture salmon found in Maritime rivers
The escapees were caught at three sites around the Bay of Fundy and Gulf of Maine this year
Farmed Atlantic salmon have been found at a hatchery in Nova Scotia among adult fish that were collected from the Gaspereau River.
Staff at the Fisheries and Oceans Canada's Coldbrook Biodiversity Facility in Nova Scotia spotted the two rogue aquaculture fish among seven other wild adult fish.
The suspected aquaculture escapees were isolated inside the hatchery and scale samples were taken to confirm their origin. After the fish were determined to be escapees, they were euthanized as protocol does not allow for the fish to be released.
This is not the first time escaped salmon have been caught this year. Nine aquaculture fish have been found in rivers in New Brunswick, Nova Scotia and Maine.
According to Maine's Department of Marine Resources, four aquaculture salmon were captured at a dam on the Union River.
Atlantic Salmon Federation scientists also found three aquaculture salmon trying to enter the Magaguadavic River, near Saint George Parish.
That has conservation advocates like Abby Pond concerned about the future of Atlantic Salmon.

"Their populations are critically low and if you've got thousands of fish returning into a river, if an aquaculture escapee fish gets into the population and spawns and their genetic material gets into the population, it's detrimental," said the Atlantic Salmon Federation's New Brunswick regional director, in an interview.
Pond said a farmed salmon is a different genetic strain from a wild fish from the Gaspereau River.
"They're generally in the Bay of Fundy from St. John River stock, so the stock would have been from a different genetic strain than from the Gaspereau River in the live gene bank program."
The concern is that if domesticated salmon breed with wild fish, their offspring will be less healthy, which could lead to population decline and even collapse.
Pond wants better regulations in tracking where exactly escaped salmon come from.

It is difficult to track now and Pond attributes this to lack of reporting and weak regulations.
"The [federal] government has signed on to reduce the number of aquaculture escapees. But there is inconsistencies between provincial and federal governments on tracking and reporting and announcing when these escapes happen."
In late August, a notice from New Brunswick's registrar of aquaculture reported a net tear at a Cooke cage in Seeley's Cove in Charlotte County.
But Pond notes, "This escapee could have been living in the wild for who knows how long and migrated to this river. So it's very difficult right now because of the lack of regulations in place or the lack of enforcement to be able to track exactly where these escapees are coming from."

Problem since inception
Pond said the problem has existed since the inception of the industry.
The Bay of Fundy's geographical features, its dynamic tides and frequency of storms increases the chance of damage to open net fish pens, creating the opportunity for farm fish to escape.
"We're not against aquaculture, we're for responsible aquaculture... Ideally, we'd like to see a transition away from these open net pens and onto land based aquaculture. So this would never even become an issue," said Pond.
"We can sustainably feed people without endangering our critically endangered populations even further."
Pond said there are no monitoring programs in these rivers to specifically watch for escapees – it is only when fish are encountered as part of other research that they are recorded.
"We'd like to see a robust tracking program in place, particularly on the rivers that have endangered populations."

Feds delay closure of B.C.'s open-net salmon farms until 2029
Industry, environmentalists split on federal plan
The federal government announced Wednesday that it would delay the closure of open net salmon farms off British Columbia's coast until 2029 to facilitate a transition to closed containment systems.
The announcement was met with praise and scorn from stakeholders in B.C.'s salmon industry.
The government had promised to phase out the farms by next year, but Fisheries Minister Diane Lebouthillier instead outlined a transition to closed-containment salmon farm operations she said would allow aquaculture farms to renew their licences in a "responsible, realistic and achievable" way.
It was met with skepticism from the industry.
"The objective is unreasonable because there is no scientific basis to this decision," said Canadian Aquaculture Industry Alliance president and CEO Tim Kennedy in a statement.
"The objective is irresponsible because it threatens 5,000 highly paid and skilled jobs in coastal British Columbia (500 of these jobs held by Indigenous people) during a time of economic stagnation."
The alliance says over 95 per cent of Canada's salmon production comes from salmon farms in ocean pens in British Columbia.
The B.C. Salmon Farmers Association has said an analysis showed the province could lose up to $1.2 billion in economic activity annually if the licences are not renewed.
Open-net fish farms off B.C.'s coast have long been the subject of debate, with environmental groups and some Indigenous nations saying they are linked to the transfer of disease to wild salmon.
A marine conservation specialist with the David Suzuki Foundation praised the federal government's commitment to ending open-net systems and said they were pleased to see a concrete deadline set.
However, Kilian Stehfest argued in a written statement that the five-year timeline failed to meet the "urgency of the moment given the dire state of many wild salmon runs."
"We look forward to a strong transition plan that enshrines an end to open-net pens in law or regulation and supports workers and communities," the statement said.
A group that services B.C.'s salmon farming industry says Ottawa needs to revisit its decision and work toward improving the current net pen sector while developing new technologies.
"The success of introducing innovative technologies in British Columbia relies on this investment and supply ecosystem being strong, stable and predictable," said Ryan Brush, general manager of Aquatrans Distributors.
"The absence of certainty and clarity has already weakened capital investment," he said.
B.C.'s minister of water, land and resource stewardship says it's up to Ottawa to help fund the transition away from open-net salmon farming.
"The federal government needs to work directly with impacted communities and workers on next steps, and they must make sure First Nations have a direct role in determining what the transition looks like in their territories," said Nathan Cullen.
Indigenous leaders from British Columbia have called on the federal government to stand by plans to transition away from open-net salmon farms in an effort to help threatened wild salmon stocks.
The plan to remove open net-pen salmon farms from B.C. coastal waters is supported by most First Nations in the province, said Bob Chamberlin, who represents more than 100 B.C. nations in the First Nations Wild Salmon Alliance.
"It benefits all British Columbians and so this is a very important day for wild salmon, but I think it's a big day for reconciliation across the province," he said at a news conference.
Meanwhile, the Watershed Watch Salmon Society says that while it's pleased with Wednesday's announcement, the planned five-year phase-out period is too long.
"That's five more years of bombarding wild salmon with parasites and viruses from factory fish farms," said Aaron Hill, the society's executive director.
Lebouthillier has been consulting with several groups about the transition plan involving 79 salmon farms after Prime Minister Justin Trudeau pledged during the 2019 election that his government would phase out ocean-pen farming.

William Shatner slams open-net salmon farming in video from Ryan Reynolds' company
Canadian actor William Shatner has waded into the debate over open-net salmon farming with a profanity-laced video for Pacific Wild.
The video, which was uploaded to the conservation group's YouTube page Thursday, features 93-year-old Shatner reacting to the federal government' decision to extend the licences for salmon farms operating off the B.C. coast for another five years.
"You know, for almost a century I have been a kind, decent Canadian," Shatner says in the ad.
"But when I see what open-net farming is doing to the environment and wildlife, I just can't be Canadian about it any longer."
The legendary "Star Trek" actor then launches into a stream of bleeped-out expletives.
The video was created by Maximum Effort, the production company started by Ryan Reynolds, and also features a cameo from former Vancouver Canuck Kirk McLean.
The B.C. Salmon Farmers Association declined an interview request on the video Thursday, with executive director Brian Kingzett dismissing the clip as "childish and obscene"It's rude and insulting to all of the people and First Nations who are so committed to sustainably producing farmed salmon and jobs for Canada," Kingzett told CTV News in an email.
"We will be reporting this irresponsible video," he added.
The federal government previously promised to phase out open-net salmon farms by 2025, leaving some opponents of the practice frustrated when Fisheries Minister Diane Lebouthillier announced the licence extensions on Wednesday.
Critics have argued the farms can spread disease and lice to wild fish, though recent science indicates uncertainty over the risks.
Pacific Wild said the Shatner video is part of a campaign(opens in a new tab) urging the public to sign "the most un-Canadian letter ever written for elected officials" demanding more urgent action.
"After years of broken government promises, Canadians have had enough. It’s time for leaders to hear Canadians’ voices as raw and real as they are, and to respond with meaningful action now," executive director Karen McAllister said in a statement.
Officials said the extended licences will offer farmers a "responsible, realistic and achievable" grace period to transition to closed-containment or land-based facilities – though the industry has raised concerns that the technology necessary to do so will not be ready in time.
On Wednesday, the B.C. Salmon Farmers Association said five years was an "unrealistic" period for making such a major transition.
"This focus on unproven technology jeopardizes the sector’s ability to fulfill agreements with rights-holder First Nations and will cause further harm to our communities," Kingzett said in a statement responding to the announcement.

FYI the reason I was so pissed off was a few days earlier a host of
very corrupt cops in seven cars pounced my son and I at 2:30 in the
morning right after the David Alward and the PCs won their big
mandate. As you can see I have reloaded some of my old videos that
were maliciously deleted just as the writ was dropped. Surf through

criminal matters first before filing civil complaints in the USA. As I
told you when you called a lot has been happening. I have made a lot
of cops mad at me and I don't trust them a bit particularly after the
Police Commission is willing to check their work so i have been busy
watching my back and covering my butt. However that does not mean that
I have not thought about our conversation and was curious about a few
things.
I was glad to receive your call and impressed by the fact that you
were more than willing to receive the material and a copy of the
wiretap tape in particular. Your stated willingness to uphold the law
was a rare statement to me. However I was curious why you only
mentioned my voicemail to Mr. Pozen and not the email to your company
and the news program that it owns. Did they not inform you as well? If
they didn't I am not surprised because I have some other rather
interesting denials from the Media. the most interesting would have to
be from the PBS program called Frontline when I introduced its
producer Michael Sullivan to the US Attorney Michael J. Sullivan. Now
that is a story well worth W5 telling. Too bad they showed me their
ass. As a courtesy to you and a further act of good faith, I will not
forward this email to anyone else until after I return to the USA and
nothing has been resolved between BCE and I and I am compelled to name
it in my complaint. I would find it very hard to believe that Mr,
Pozen does not know everything he needs to know about me right now.
I had also called a lawyer, Steven Skurka who had a week long little
special on CTV . I had tried to inform him that I knew my rights his
assistant hollered at me. You from speaking to me yourself that I am
not a rude character. I found it too funny to be treated that way and
I had resolved to serve him this stuff byway of the local ATV Station
that had presented his smiling talking head to me. That is why I was
telling you that you could get this stuff from the local ATV station.
I found it quite strange that you did not rely on them to send it on
to you. Thus I must make an extra copy to comply with your request.
I know the date stamp on the forwarded email is incorrect but that is
because my old laptop goes to the first year in it when I boot up and
sometimes I am too busy or tired to bother changing it. However MSN
tracks it with the true date. Brad Smith and I have a bone to pick as
well and I have been checking his work rather closely since he ignored
my letter to him last year. His boss Bill Gates is gonna be very angry
and Brad Smith and Steve Balmer in the near future if I have anything
to do with it. If you do act ethically and immediately I will settle
with your company very cheaply in comparsion to the bottom lines of my
first two complaints. In fact I will be so impressed I will
immediatlely offer you a better job than the one you have now. Please
study the material I will provide you closely and ask me any thing you
wish.
I will do as I promised and send the material you requested as soon as
I can put it all together. Right now I am on the move and far away
from my printer. Is the following your correct address? Perhaps you
should consider sending someone to the my meeting with the Police
Commission in Fredericton next week in order to hear me speak of these
matters to law enforcement before I return to the USA. Once I do
return there I will serve the Mr. Pozen the material as promised and
call him to testify in my pending trial. The following emails should
explain some of my concerns to you. My wife will be in Canada next
week as well to pick up our kids. I will allow you to speak to her if

I am a Canadian Citizen who thus far, as a plaintiff, has two Lawsuits
in the US District Court of Massachucetts they are numbered 02-11686-
RGS and 02-11687-RGS.
They were removed to that Court from the Norfolk Superior Court by the
US Attorney Michael J. Sullivan very improperly. However they shall
remain there because of my status as a Canandian Citizen. Judge Sterns
has not even held a Conference about the matters because he likely
does not want to hear the matter because I have presented all Members
of the Bar with their worst fear of a catch 22 problem.
Accordinging to law he is late. I have complained of 47 defendants 34
of whom are State Defendants( the Attorney General, The Commission of
Judicial Conduct Board of Bar Overseers etc) and 3 are Federal
Treasury Agents. Some of the defendants are over two months late in
their answer to the Summons.
The smallest suit amounts to 188 million dollars in the form of
relief. There is a lot to these matters and too much to briefly
explain. But in a nutshell my wife's Aunt, who is buried beside Rose
Kennedy, left my wife some money. It was stolen by her relatives in
executing the estate. No news there. But the crooks are very well
connected politically and every part of the old crony network in
Boston covered for them.
The crook and our cousin, Charles J. Kickham Jr of the Kickham Law
Office on Beacon St, has been past President of Bar Associations. He
has sat on the Board of Governors of Harvard Law School etc. I have
given much information to many members of the press who have simply
ignored some interesting facts.
What should be somewhat newsworthy is how far a wild colonial boy has
come in prosecuting Pro Se the most profund Yankee carpetbaggers. My
next two lawsuits Under title 18 are wickedly righteous. I have left
one copy of much information in Saint John New Brunswick at a lawyer's
Office, Mosher and Chedore 33 Charlotte St if some one wishes to view

I believe that only propaganda exists these days. The other two terms

Perhaps some clever Indian in BC will ask me why I ran against Andy
Scott when he was the Minister of Indian Affairs EH John Duncan? I see
folks in your neck of the woods checking my work alot lately. No doubt

Cullen to question Enbridge, government at JRP in February
FOR IMMEDIATE RELEASE
DECEMBER 12, 2012
Prince Rupert – MP Nathan Cullen will next appear before the National
Energy Board's Enbridge Joint Review Panel (JRP) in February.
Cullen will question witnesses from Enbridge on emergency preparedness
and response mechanisms that would be established to deal with oil
spills.
Later in the spring, Cullen will also cross-examine Department of
Fisheries and Oceans officials about federal assessments of the
project’s environmental impacts.
JRP hearings continue in Prince Rupert this week and are set to resume
there on February 4. The panel will sit for two-week rotations until
early spring and must issue its recommendation by the end of 2013.

Apologies for the delay in my response. This week was jammed with
board meetings for our riding and a massive volunteer appreciation BBQ

Apropos the information you sent to me, I found it very interesting.
In fact, here in Calgary East, I'm planning a series of
workshops/public lectures that look at "Corruption in Canada". My
policy team and I are meeting this week to discuss the items you sent
to me and your case in particular to see what we can do in terms of,
at least, bringing some public awareness to this case and other cases
of corruption and questionable practices in Canadian governance and
government relations with businesses.
Do make sure to send us a follow up on what you decide to do, apropos
your proposed law suit. I will share the information with my team.
As my own follow up question, though, why have you sent me this
material as opposed to approaching your local MP and/or Liberal
candidate? Surely others would be interested too.
I know Ted. He's a great person and he'll be a wonderful MP. Do let me
know what transpires on that front.

about 30 April 2002 after Mr. Byron Prior, the Defendant/Plaintiff by
Counterclaim, had made allegations against Mr. Matthews in a
publication called "My Inheritance - The truth - Not Fiction: A Town
with a Secret". In that publication, the allegation was made that Mr.
Matthews had had sex with a girl who had been prostituted by her
mother. That girl was alleged to have been Mr. Prior's sister.
THAT upon being retained, Mr. Edward Roberts wrote a letter to Mr.
Prior. That letter to Mr. Prior is attached as Exhibit "1" to my
Affidavit.
THAT subsequent to Mr. Roberts' letter to Mr. Prior, Mr. Roberts
received a 1 May 2002 e-mail from Mr. Prior. That e-mail is attached
as Exhibit "2".
THAT subsequent to Mr. Roberts receipt of the e-mail, Mr. Prior swore
an Affidavit acknowledging that what had been said in that publication
was false. That Affidavit is attached as Exhibit "3" to my Affidavit.
Following Mr. Roberts' receipt of that Affidavit, Mr. Matthews advised
that he was satisfied not to pursue the matter any further and our
firm closed our file.
THAT on or about 25 October 2004, I was retained by Mr. Matthews
following his gaining knowledge that a web site, made a series of
allegations against him relating to my having sex with a girl of
approximately 12 years old through to an approximate age of 15 years
old. It also accused him of being a father of one of her children and
accused him of having raped that girl. Upon checking the web site I
saw that Byron Prior, the Defendant, had been identified as the author
of the material on the site.
THAT Mr. Matthews instructed me to write Mr. Prior, to remind him of
the fact that the allegations had been admitted to being false through
a 16 May 2002 Affidavit to advise him of Mr. Matthews' intentions to
commence legal proceedings if the comments were not removed from the
web site. A copy of my letter to Mr. Prior is attached as Exhibit "4"
to this Affidavit.
THAT I attach as Exhibit "5" a transcript from a 5 November 2004
voicemail left by David Amos, identified in the voicemail as a friend
of Mr. Prior.
THAT I attach as Exhibit "6" a portion of a 6 November 2004 e-mail
from Mr. Amos.
THAT until I received his voicemail and e-mail, I had never heard of Mr. Amos.
THAT Mr. Amos has continued to send me e-mail since his 5 November
e-mail. Including his 6 November 2004 e-mail, I have received a total
of 15 e-mails as of 23 January 2005. All do not address Mr. Matthews'
claim or my involvement as Mr. Matthews' solicitor. I attach as
Exhibit "7" a portion of a 12 January 2005 e-mail that Mr. Amos sent
to me but originally came to my attention through Ms. Lois Skanes
whose firm had received a copy. This e-mail followed the service of
the Statement of Claim on 11 January 2005 on Mr. Prior. I also attach
as Exhibit "8" a copy of a 19 January 2005 e-mail from Mr. Amos.
THAT I attach as Exhibit "9" a copy of a 22 November 2004 letter
addressed to me from Edward Roberts, the Lieutenant Governor of
Newfoundland and Labrador covering a 2 September 2004 letter from Mr.
Amos addressed to John Crosbie, Edward Roberts, in his capacity as
Lieutenant Governor, Danny Williams, in his capacity as Premier of
Newfoundland and Labrador, and Brian F. Furey, President of the Law
Society of Newfoundland and Labrador. I requested a copy of this
letter from Government House after asking Mr. Roberts if he had
received any correspondence from Mr. Amos during his previous
representation of Mr. Matthews. He advised me that he received a
letter since becoming Lieutenant Governor, portions of which involved
his representation of Mr. Matthews. Mr. Roberts' letter also covered
his reply to Mr. Amos.
THAT I attach as Exhibit "10" an e-mail from Mr. Amos received on
Sunday, 23 January 2005.
THAT I swear this Affidavit in support of the Application to strike
Mr. Prior's counterclaim.

David Amos asked me to contact you. I met him last June after he became
an independent (not representing any political party) candidate in our federal
election that was held June 28. He was a candidate in our constituency of
Fundy (now called Fundy-Royal).
I wrote a profile story about him, as I did all other candidates. That
story appeared in the Kings County Record June 22. A second story, written
by one of my reporters, appeared on the same date, which was a report on
the candidates' debate held June 18.
As I recall David Amos came last of four candidates in the election.
The winner got 14,997 votes, while Amos got 358.
I have attached the two stories that appeared, as well as a photo
taken by reporter Erin Hatfield during the debate. I couldn't find the photo
that ran, but this one is very similar.

Raising a Little Hell- Lively Debate Provokes Crowd

"If you don't like what you got, why don't you change it? If your
world is all screwed up, rearrange it."
The 1979 Trooper song Raise a Little Hell blared on the speakers at
the 8th Hussars Sports Center Friday evening as people filed in to
watch the Fundy candidates debate the issues. It was an accurate, if
unofficial, theme song for the debate.
The crowd of over 200 spectators was dwarfed by the huge arena, but as
they chose their seats, it was clear the battle lines were drawn.
Supporters of Conservative candidate Rob Moore naturally took the blue
chairs on the right of the rink floor while John Herron's Liberalswent
left. There were splashes of orange, supporters of NDP Pat Hanratty,
mixed throughout. Perhaps the loudest applause came from a row towards
the back, where supporters of independent candidate David Amos sat.
The debate was moderated by Leo Melanson of CJCW Radio and was
organized by the Sussex Valley Jaycees. Candidates wereasked a barrage
of questions bypanelists Gisele McKnight of the Kings County Record
and Lisa Spencer of CJCW.
Staying true to party platforms for the most part, candidates
responded to questions about the gun registry, same sex marriage, the
exodus of young people from the Maritimes and regulated gas prices.
Herron and Moore were clear competitors,constantly challenging each
other on their answers and criticizing eachothers' party leaders.
Hanratty flew under the radar, giving short, concise responses to the
questions while Amos provided some food for thought and a bit of comic
relief with quirky answers. "I was raised with a gun," Amos said in
response to the question of thenational gun registry. "Nobody's
getting mine and I'm not paying 10 cents for it."
Herron, a Progressive Conservative MP turned Liberal, veered from his
party'splatform with regard to gun control. "It was ill advised but
well intentioned," Herron said. "No matter what side of the house I am
on, I'm voting against it." Pat Hanratty agreed there were better
places for the gun registry dollars to be spent.Recreational hunters
shouldn't have been penalized by this gun registry," he said.
The gun registry issues provoked the tempers of Herron and Moore. At
one point Herron got out of his seat and threw a piece of paper in
front of Moore. "Read that," Herron said to Moore, referring to the
voting record of Conservative Party leader Steven Harper. According to
Herron, Harper voted in favour of the registry on the first and second
readings of the bill in 1995. "He voted against it when it counted, at
final count," Moore said. "We needa government with courage to
register sex offenders rather than register the property of law
abiding citizens."
The crowd was vocal throughout the evening, with white haired men and
women heckling from the Conservative side. "Shut up John," one woman
yelled. "How can you talk about selling out?" a man yelled whenHerron
spoke about his fear that the Conservatives are selling farmers out.
Although the Liberal side was less vocal, Kings East MLA Leroy
Armstrong weighed in at one point. "You're out of touch," Armstrong
yelled to Moore from the crowd when the debate turned to the cost of
post-secondary education. Later in the evening Amos challenged
Armstrong to a public debate of their own. "Talk is cheap. Any time,
anyplace," Armstrong responded.
As the crowd made its way out of the building following the debate,
candidates worked the room. They shook hands with well-wishers and
fielded questions from spectators-all part of the decision-making
process for the June 28 vote.

David Amos Isn't Campaigning For Your Vote, But….

FUNDY—He has a pack of cigarettes in his shirt pocket, a chain on his
wallet, a beard at least a foot long, 60 motorcycles and a cell phone
that rings to the tune of "Yankee Doodle."
Meet the latest addition to the Fundy ballot—David Amos.
The independent candidate lives in Milton, Massachusetts with his wife
and two children, but his place of residence does not stop him from
running for office in Canada.
One has only to be at least 18, a Canadian citizen and not be in jail
to meet Elections Canada requirements.
When it came time to launch his political crusade, Amos chose his
favourite place to do so—Fundy.
Amos, 52, is running for political office because of his
dissatisfaction with politicians.
"I've become aware of much corruption involving our two countries," he
said. "The only way to fix corruption is in the political forum."
The journey that eventually led Amos to politics began in Sussex in
1987. He woke up one morning disillusioned with life and decided he
needed to change his life.
"I lost my faith in mankind," he said. "People go through that
sometimes in midlife."
So Amos, who'd lived in Sussex since 1973, closed his Four Corners
motorcycle shop, paid his bills and hit the road with Annie, his 1952
Panhead motorcycle.
"Annie and I rode around for awhile (three years, to be exact)
experiencing the milk of human kindness," he said. "This is how you
renew your faith in mankind – you help anyone you can, you never ask
for anything, but you take what they offer."
For those three years, they offered food, a place to sleep, odd jobs
and conversation all over North America.
Since he and Annie stopped wandering, he has married, fathered a son
and a daughter and become a house-husband – Mr. Mom, as he calls
himself.
He also describes himself in far more colourful terms—a motorcyclist
rather than a biker, a "fun-loving, free-thinking, pig-headed
individual," a "pissed-off Maritimer" rather than an activist, a proud
Canadian and a "wild colonial boy."
Ironically, the man who is running for office has never voted in his life.
"But I have no right to criticize unless I offer my name," he said.
"It's alright to bitch in the kitchen, but can you walk the walk?"
Amos has no intention of actively campaigning.
"I didn't appreciate it when they (politicians) pounded on my door
interrupting my dinner," he said. "If people are interested, they can
call me. I'm not going to drive my opinions down their throats."
And he has no campaign budget, nor does he want one.
"I won't take any donations," he said. "Just try to give me some. It's
not about money. It goes against what I'm fighting about."
What he's fighting for is the discussion of issues – tainted blood,
the exploitation of the Maritimes' gas and oil reserves and NAFTA, to
name a few.
"The political issues in the Maritimes involve the three Fs – fishing,
farming and forestry, but they forget foreign issues," he said. "I'm
death on NAFTA, the back room deals and free trade. I say chuck it
(NAFTA) out the window.
NAFTA is the North American Free Trade Agreement which allows an
easier flow of goods between Canada, the United States and Mexico.
Amos disagrees with the idea that a vote for him is a wasted vote.
"There are no wasted votes," he said. "I want people like me,
especially young people, to pay attention and exercise their right.
Don't necessarily vote for me, but vote."
Although…if you're going to vote anyway, Amos would be happy to have
your X by his name.
"I want people to go into that voting booth, see my name, laugh and
say, 'what the hell.'"

I am not responding to Dave Amos' emails, but I believe I have heard
he has some "issues". I have no sense of what his involvement is with
the organization or why he is threatening law suits (my receptionist
just intercepted a call and he told her he didn't want to leave a
message and to just tell her that he would "see me in court").
Does anyone have any idea what to do about this guy? Should we just
ignore him?

COALITION CALLS ON LEADERS TO ACT IMMEDIATELY TO STOP OIL AND GAS
EXPLORATION IN GULF OF ST. LAWRENCE
For Immediate Release - October 4, 2010
PICTOU, NS – Today’s decision by the Canada Newfoundland and Labrador
Offshore Petroleum Board (CNLOPB) to allow seismic blasting in the
Gulf of St. Lawrence was met with shock and concern by a coalition
calling for a moratorium on oil and gas development in the Gulf of St.
Lawrence. The coalition - made of aboriginal, fishing, and
environmental organizations - is calling on municipal, provincial,
federal, and aboriginal leaders to act swiftly to halt the testing.
“With this decision, the CNLOPB has approved an activity that could
damage this entire precious ecosystem,” according to Mary Gorman of
the Save Our Seas and Shores, “We want this decision reversed
immediately, and action taken to allow jurisdictions bordering on the
Gulf to have a say in its future.”
“Seismic testing could start in the next 48 hours, potentially
damaging marine mammals like blue whales, and disrupting fish and
fisheries. This approval has given oil and gas as a toehold in the
Gulf that could lead to full scale drilling,” according to Danielle
Giroux of the. “Fishermen I work for need more say over protecting the
Gulf. We want the CNLOPB’s decision reversed immediately.”
“An oil spill in the Gulf of St. Lawrence would impact fish stocks and
coastal communities in Quebec, PEI, New Brunswick, Nova Scotia, and
Newfoundland. Moreover, the national importance of this ecosystem must
be upheld.” says Gretchen Fitzgerald, of the Sierra Club Canada. “
Federal laws to protect endangered species and fish habitat recognize
the importance of protecting our shared biodiversity and resources.
This decision is not reflecting this shared responsibility or concerns
expressed by groups around the Gulf.”

Bennett was assisting Cape Bretoners opposing a coal-fired power plant
at Point Aconi in Nova Scotia when he first caught the attention
Elizabeth May, then Sierra Club Canada’s executive-director. May liked
his approach – among other things, he’d brought his wife and two
daughters to a potluck supper meeting and assured the group he was
there to hear from them, not issue orders. Several years – and, after
an interview on a train ride from Toronto to Ottawa -- later, she
hired him as the Club’s director of atmosphere and energy.
He managed environmental education campaigns; was the Club’s main
spokesperson on air, energy, automotive and climate change issues;
prepared fundraising proposals; and wrote position papers and research
articles.
During this period, Bennett also headed the Climate Action Network, an
association of up to 100 environmental, health, labour and faith
organizations from 10 provinces and two territories. There, he was
also the chief spokesperson, wrote releases and papers, and acted as
liaison with government officials, ministers, MPs, their staffs and
industry leaders. He did similar work with a successor organization,
ClimateforChange.ca.
It was then that he was involved in preparing reporters for the
federal Conservative government’s climate plan. “I figured we had to
talk to the media. We had to meet the government head-on, and say what
they were doing was going backward. We were very effective.”
The work “succeeded to the extent that when Stéphane Dion became
Liberal leader, the party thought the climate and environment were
where they should campaign. They were right; they just did it very
badly.”
A spirit of collaboration
Most recently, Bennett was communications director for the Green Party
of Canada, including the 2008 campaign in which the Greens, led by
May, won nearly a million votes and was the only party to increase its
total.
“It’s a well-rounded background, ranging from activist events to
negotiating in the halls of power,” Bennett says. “My knowledge covers
the spectrum of issues across the country.”
Bennett’s experience has demonstrated the importance of collaborating
with other groups and including as many people as possible, and their
ideas, in whatever work must be done. That was especially obvious in
the creation of the Green Budget Coalition, which analyzed federal
budgets in terms of their impact on environmental concerns.
