Local official calls police on residents seeking public government records
Sunbury-York South CAO facing charges for obstructing access to public documents
An official of a rural municipality outside Fredericton is facing charges after she called the RCMP on residents asking for public documents they were legally entitled to.
Marjorie Turner, the chief administrative officer for Sunbury-York South, was scheduled to appear in Fredericton provincial court on Wednesday on two charges of violating the Local Governance Act, which police officials called "extremely rare."
Turner was not present, but CBC News made a request for an interview through her lawyer, who was in court for the proceeding, which was adjourned without plea until May 28. Turner has not yet responded to the interview request.
Created under the province's 2023 municipal amalgamations, Sunbury-York South includes Nasonworth, Rusagonis, Waasis and Charters Settlement.
Mac Burns, who's lived in the community for 50 years, first took an interest in the new council after it proposed building an $8 million municipal complex last fall. Council later backed down after a public outcry.

"We were saying, if they're going to spend $8 million on a municipal building, where else are they spending the money?" he said in an interview earlier this week.
Burns started looking into how much the municipality had paid for land on Chaparral Road in Waasis for the proposed building and how much it was paying to rent a temporary office in neighbouring Oromocto.
CAO called police on two residents
Burns went to the municipal office on Dec. 19 to ask for records that would explain why certain matters had been discussed in closed session. Under the Local Governance Act, a council must record "the type of matter" discussed in closed session in their meeting minutes.
The act also states that most council documents "shall be available for examination by members of the public" in the clerk's office.
But the clerk told Burns several times it was not available. He said Turner then appeared and asked him to leave while she was on the phone to the RCMP. Burns recorded the audio of the interaction on his phone, which he shared with CBC News.
By that time, Turner had already called the RCMP on another resident, Melissa Gillis, who had also been seeking public records.
Gillis confirmed with CBC News that she was given a trespass notice on Nov. 27.

She also shared an April 11 email from Mayor David Hayward, who apologized for the notice and said it had been lifted.
When asked if he was concerned with what happened, Hayward said in an interview that he wanted to make clear that it was Turner as an individual facing charges, not the entire municipal government.
Hayward said Turner has been out of the office "for some time" and he hasn't spoken with her since the incidents.

asked if he would support her employment if Turner is found guilty,
Hayward said it would be a human resources matter to be discussed at
that time.
RCMP confirms they were called to office twice
In an interview, RCMP Sgt. Stéphane Esculier of the Oromocto detachment confirmed the RCMP were called to the municipal office for "disturbances" on both dates and said a trespass notice was issued for the first incident but not the second, although it "had been considered."

Esculier said there is a "fairly low threshold" to issue a trespass notice to someone.
"It's something that was requested by the CAO at the time to avoid, I guess, further disturbances at the location," he said.
Esculier said the RCMP then investigated the incidents, which resulted in the charges the CAO now faces — two counts of failing to provide documents required for examination by members of the public. She faces a maximum fine of $5,200.
He said the Local Governance Act is not something the RCMP deals with very often, although it does have jurisdiction.
"Personally, that's the first time I've seen charges under that act," Esculier said.
Charges racked up at Costco, Amazon
Burns said his investigation revealed other concerns, completely separate from the charges Turner is facing.
Documents received through a right to information request show the municipality's bank card racked up charges for various items at Costco.
The receipts don't have a name attached and include office-type purchases like coffee pods and office supplies. But they also go beyond the expected, including gouda and havarti cheese, pickles, ramen, yogurt, peanut butter, fruit salad, dark chocolate, mozzarella bites and carrots.

There was also a receipt from the Costco food court for a chicken tenders meal — with extra gravy.
Receipts for Amazon were clearly addressed to Turner. They include a $26.44 microwave egg cooker and a $41.99 essential oil diffuser.
"I'm concerned with the administration office when you're buying peanut butter and Mr. Noodles, dill pickles and being charged to the taxpayers," Burns said.
He said he's kept on the case because he's retired and wants to hold municipal officials accountable.
"I think what we found was no checks and balances with the CAO," he said.
"So the message is to be diligent. See what your council is doing, see what the mayor is doing and that act — make sure they follow the act."
Mayor stands by staff, council
Hayward said he was aware of the receipts and that they led the municipality to start working on a new spending policy for employees.
"Without that structure in place, if there isn't a rule, then you're not breaking the rule," Hayward said.
"I want to be be very clear that I don't believe any member of our council or staff have any nefarious plans or there's been any extraordinary expenditures outside of the norm."
Retired mountie says situation is 'nonsense'
Gilles Blinn, a retired RCMP staff sergeant who's lived in Nasonworth for 30 years, said he's concerned about "a lack of accountability."
He called the trespass warnings nonsense and said citizens are entitled to public information "because we pay their wages, right? It's a government organization. They have to provide it. There's no two ways about it."

Blinn echoed what Esculier said about charges under the Local Governance Act being rare.
"I don't know if we've ever laid one in this province, ever," Blinn said.
He admitted that it's "not the crime of the century," likening it more to a speeding ticket than a criminal offence. But Blinn said it was serious enough to warrant a charge and that the CAO is ultimately beholden to residents.
"These people request something, you have to provide it, right?" he said.
"You just can't call the police for everybody that shows up requesting something."

Marjorie Turner
Marjorie has an honors Bachelor of Finance degree and a Master of Business Administration in Venture Commercialization – Scaling and Investment on the Deans’ list from the University of New Brunswick. She has many years in management roles. She has experience as a Real Estate Agent, in domestic construction, and in a few entrepreneurship endeavors.
She has worked for the New Brunswick Legislative Assembly and was appointed to an elected provincial political party as Lead Researcher and analyst. During her term with the Legislative Assembly, researching government finance department records relating to the Motor Vehicle Act developed a case for the New Brunswick Government officials showing how the department could save 42 million dollars and allow one-time car registrations. Without this financial evidence, the remainder of Bill 18 would have been voted out. Instead, the financial savings forwarded that portion of the bill into a review. The other two parts (Front License Plate Removal) and (Car inspection changes) of the amendment passed and became law on January 21, 2020. She also worked for Opportunities New Brunswick Export team and the New Brunswick Provincial Justice and Public Safety as a Financial analyst.
Marjorie loves to be with family and friends in her spare time. She spends time at her cottage on the Miramichi River and has caught a 12lb Atlantic salmon on a fly. She loves all types of boating. She appreciates all forms of culture and is an artist.

Some residents concerned about the impact new municipal building would have on their taxes
A controversy has developed in the newly amalgamated community of Sunbury-York South over plans for a new municipal building.
Opposition erupted after a move by council to ask the Municipal Capital Borrowing Board, a provincial government entity, for pre-approval to borrow up to $8 million for the project, located in a community south of Fredericton.
A meeting to hear public input was to take place Tuesday, however, the application was withdrawn Friday, said Mayor David Hayward.
At that point, many people in the community had already expressed anger and concern about it online.
The dollar figure prompted some residents to liken the proposed structure to the Taj Mahal and to worry about the impact on their taxes.
While acknowledging that a new building would likely cause taxes to increase, Hayward said his belief is that much of the opposition has been based on misinformation.
"It was never anyone's intention to build an $8-million building for four staff," he said, describing that notion as "absurd."
"That would outrage anyone, and I can certainly understand people's frustrations with that," he said.
What is actually being considered is a building that may incorporate additional facilities or services, he said.
A new fire hall, for example, might be worth the extra tax dollars if it results in savings on insurance, he suggested.

There is no office space available in Sunbury-York South, said Hayward, noting it's currently renting municipal offices in Oromocto.
Objections to the size of the new building are also premature, said Hayward, as no plans have been drawn up.
It could end up being a lot cheaper to build than the $8-million approval sought from the borrowing board, he added, likening the process to getting pre-approved for a mortgage before house shopping.
"It seemed a little bit over the top to just land us with $8-million worth of debt without having more consultation about it," said resident Jeanne Clarke-Walker, who first learned of the plan a few weeks ago, after someone shared an article about it on social media.
Clarke-Walker said she subsequently sought information on the municipality's website, but couldn't find any.
She was one of several Sunbury-York South residents who wrote to CBC's Information Morning Fredericton to express concerns about the plans for the building.
"I personally don't see the need to spend that sort of money," she wrote.
In a subsequent phone interview, Clarke-Walker said she and her husband are pensioners and choose to live in a rural area specifically for its low tax rate.
"We don't have a lot of disposable income that we can add additional taxes to," she said.
She also took issue with a perceived lack of transparency.
"I'd just like to know what we're paying for," she said.
"I believe that their future plans for the community need to be fully discussed before we launch ourselves into that much debt."
She and several other residents also expressed concern that 30 acres of land may have already been purchased for the project without public notice or opportunity to object.
The mayor had not yet responded to a message from CBC to confirm that as of publication time, but the incurrence of a long-term debt of $300,000 is mentioned in the minutes of a council meeting in September.
Another Sunbury-Yorth South resident, Carolyn Nickerson said she felt council had been misled into trying to develop municipal infrastructure similar to its westerly neighbour, Hanwell.
"We are in a completely different tax bracket and population size," said Nickerson, who also noted concerns about increased spending on the chief administrative officer's salary and bylaw enforcement.
Nickerson and some others who wrote in said rather than a big new municipal building, they'd prefer to have the municipality renovate an existing recreation centre in Rusagonis, which is one of the communities amalgamated into Sunbury-York along with Nasonworth, Beaverdam, Charters Settlement, Waasis, and Tracyville.
There is still plenty of time for community consultation, said the mayor.
Input will be gathered over the next six months, he said.
Despite the objections and the withdrawal of the borrowing board application, preliminary work for a new building is still going ahead, said Hayward.
An alternate source of provincial funding has been secured to begin the planning process, he said.

Union says RCMP decision not to comment further on mass shooting 'difficult' for front-line officers
The union representing RCMP officers in Nova Scotia says its members are finding it challenging that the force has stopped releasing information about the April mass shooting, especially as they continue to struggle with the personal toll of responding to the killing of 22 people, including their colleague Const. Heidi Stevenson.
On April 18 and 19, a gunman travelled nearly 200 kilometres through rural communities shooting strangers, neighbours and acquaintances while masquerading as a Mountie.
Families of the victims are now suing the RCMP and have questioned whether the force did enough to stop the killer and warn of the danger. They've also been critical of the amount of information they've received about their loved ones' deaths. CBC News and other media organizations have gone to court to unseal search warrant documents in the case.
The last press conference about the attacks was June 4 and in recent months, the RCMP has repeatedly declined interviews about its investigation. In response to media requests, it has sent the same statement reiterating its commitment to accountability, transparency and participating in the public inquiry, which it describes as "the most appropriate and unbiased opportunity" to provide the facts about what happened.
Brian Sauvé, president of the National Police Federation, said he wouldn't second-guess the force's decision to stop releasing information, but acknowledged front-line officers are finding it hard.
"Our members want closure. Our members want ... to essentially be vindicated in their actions," said Sauvé, whose group represents approximately 1,060 RCMP officers stationed in Nova Scotia.
"I'll say that because from what I've seen, heard, read, those on the ground — and I'm not talking about command decisions, I'm talking about those on the ground who've responded to this incident — acted and worked in an extremely heroic manner with the resources available to them.
"For membership not to hear the RCMP support, that is challenging to them. And to wait for an inquiry to have their day and their say is difficult."
Members not allowed to speak with media
The mass casualty commission has started its work and a final report is expected in November 2022.
Meanwhile, the police investigation — which includes looking at where the shooter obtained his weapons and whether he had help — continues. Two weeks ago, the RCMP announced three people, including the gunman's spouse, her brother and brother-in-law, face a charge related to allegedly providing the gunman with ammunition. The Mounties have not answered questions or provided any information beyond a press release.
Individuals members of the RCMP are not permitted to speak to the media and could face disciplinary actions by doing so. Several officers declined to speak to CBC about their experiences in recent months, with some citing the possible repercussions.
Gilles Blinn, who retired from the RCMP in New Brunswick in 2018, said he's frequently in touch with former colleagues in Nova Scotia who are struggling with criticism of their actions during the mass shooting and who are frustrated that they can't defend themselves.
"They're far removed from all the decisions that are made at headquarters in Halifax and headquarters in Ottawa. They have no say in what's going on ... it's like they're gagged," Blinn said.
"They feel like
they're not supported at the top. And any manager knows this, that if
your people aren't happy under you, you have bad morale…. I think the
morale is very low in Nova Scotia currently due to the fact that no one
is speaking out on their behalf."
Blinn spent 31 years with the RCMP, including eight on the staff organization that preceded the union. For many years, the former staff sergeant originally from Digby County answered media calls. He'd like to see the RCMP provide more information that could clear up questions about how officers responded to one of the country's worst mass killings in modern history.
"You don't want to hamper your investigation. You don't want to hamper your upcoming coroner's inquest or anything else that's going on. And you have to be very diplomatic into what you're going to say. But there are things that I believe that they could say to satisfy all parties involved," he said.
Blinn's son was one of the officers who
responded in Portapique on April 18, though he stressed he couldn't
speak to his son's experience and didn't know exactly what happened that
night or the following morning.
But many of the people he knows are also grappling with the horror of what unfolded, Blinn said. Overall, he said Mounties don't feel supported by their leadership or the public.
"I know of some that turn to liquor. I know of some that were so traumatized that they've retired," he said.
"The effects don't happen right away, for some members it'll take years.... The trauma of seeing all this death and destruction and the agony of the victims' families, which is what never goes away. 'I'm seeing burnout'
The RCMP offered employees the option of taking leave in the wake of the shootings. The force said some members took time off but would not disclose how many as it involves private health information.
Some employees are performing modified duties and others are on different types of leave, Cpl. Lisa Croteau said in an email. The RCMP employs about 1,450 people in the province, though not all are members of the union.
CBC has confirmed some officers remain off work, in part, because they're dealing with the psychological impact of responding.
Sauvé said across the board, members have been hurting alongside their communities in a year that has been particularly challenging for policing. He said COVID-19 has meant fewer officers are being trained to fill vacancies, recruitment remains low, and the union is starting collective bargaining after nearly four years without a raise.
On top of that, protests against policing and police brutality in the U.S. and Canada have prompted widespread criticism of the profession.
The fact that officers have taken time to deal with trauma is positive, the union president said, as it signals an understanding that it's OK to admit to needing help.
"We don't have to, you know, suck it up and soldier on any longer.... the RCMP, as well as Canadians, are starting to realize that trauma affects everybody differently and recovery from traumatic events can take longer for some than it can for others," said Sauvé.
"They had to respond to the incident. They've had to deal with the aftermath and the investigations of that incident, at the same time grieving the loss of one of their colleagues as well as some of their friends."
The union said close to 100 officers travelled to Nova Scotia to help investigate the shootings and backfill officers who took time off in the months since the tragedy.
But even still, he said the force is facing "big morale challenges" exacerbated by COVID-19 and staffing stretched to the limit. Sauvé said many officers have been denied vacation time due to operational requirements and have been working "day in and day out."
"I'm seeing burnout. I am worried about it," said Sauvé.

The Plaintiff seeks an appeal de novo, by way of motion pursuant to the
Federal Courts Rules (SOR/98-106), from an Order made on November 12, 2015,
in which Prothonotary Morneau struck the Statement of Claim in its entirety.
At the outset of the hearing, the Plaintiff brought to my attention a letter
dated September 10, 2004, which he sent to me, in my then capacity as Past
President of the New Brunswick Branch of the Canadian Bar Association, and
the then President of the Branch, Kathleen Quigg, (now a Justice of the New
Brunswick Court of Appeal). In that letter he stated:
As for your past President, Mr. Bell, may I suggest that you check the work
of Frank McKenna before I sue your entire law firm including you. You are
your brother’s keeper.
Frank McKenna is the former Premier of New Brunswick and a former colleague
of mine at the law firm of McInnes Cooper. In addition to expressing an
intention to sue me, the Plaintiff refers to a number of people in his
Motion Record who he appears to contend may be witnesses or potential
parties to be added. Those individuals who are known to me personally,
include, but are not limited to the former Prime Minister of Canada, The
Right Honourable Stephen Harper; former Attorney General of Canada and now a
Justice of the Manitoba Court of Queen’s Bench, Vic Toews; former member of
Parliament Rob Moore; former Director of Policing Services, the late Grant
Garneau; former Chief of the Fredericton Police Force, Barry McKnight;
former Staff Sergeant Danny Copp; my former colleagues on the New Brunswick
Court of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted Police.
In the circumstances, given the threat in 2004 to sue me in my personal
capacity and my past and present relationship with many potential witnesses
and/or potential parties to the litigation, I am of the view there would be
a reasonable apprehension of bias should I hear this motion. See Justice de
Grandpré’s dissenting judgment in Committee for Justice and Liberty et al v
National Energy Board et al, [1978] 1 SCR 369 at p 394 for the applicable
test regarding allegations of bias. In the circumstances, although neither
party has requested I recuse myself, I consider it appropriate that I do so.
AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion.

27. The Plaintiff states that the Sergeant-at-Arms, two Commissionaires, a
librarian, and two members of the FPF knew that the Plaintiff was in
legislative assembly on June 24, 2004 looking for the “blogger” Charles
Leblanc. While the Plaintiff was waiting for Charles Leblanc to arrive that
day he exercised his democratic right to witness the proceedings of the
Legislative Assembly from the gallery.
28. The Plaintiff states that apparently a friend of the Crown put a new
spin on this matter the following day. The Crown’s corporate media has never
said anything about the Crown’s malicious actions barring him it has had
lots to say about the barring the blogger Charles Leblanc two years later
and it has made the arrests and prosecutions of him well known. On June 25,
2004 Charles Leblanc a well-known friend of the MLAs, the Sergeant-at-Arms,
the Commissionaires, the RCMP and the Fredericton Police Force falsely
reported in the social media that the Plaintiff had been “shown the door”
claiming that he had attempted to interrupt the proceedings in the
Legislature by speaking from the gallery. The Crown knows if that were true
it would have been recorded in the legislative records. The words of Charles
Leblanc an important witness to be called to testify as to what he knows
about this matter are as follows

“There’s always undercovers cops around but only when the House is in
session. As God as my witness I hope nothing happens but it’s just a matter
of time till someone is push over the edge. I guess a guy name David Amos
was shown the door yesterday at the Legislature. This guy is running as an
Independent candidate in the riding of Fundy Royal. I met the guy over the
net and he has a beef with our political bureaucrats. I admire people
fighting for what they believe in but you can’t get carried away. I guess in
this case? He wanted to speak from the Gallery and that’s a big faux pas!”
32. The Plaintiff states that many politicians knew that the CBC had hard
copy of two lawsuits of his since 2002 and their journalists had been
laughing at him for two years. It was a profound mistake for CBC to ignore
his candidacy now that he did as he promised in a statement of one lawsuit
and was running for public office in Canada. As CBC continued serving the
interests of the politicians who provided the funding sourced from the
Canadian taxpayer other citizens noticed that the CBC was ignoring his
candidacy. One journalist who had laughed at him called back and tried to
make a deal after the Plaintiff had called the Ombudsman for CBC complaining
of him and his associates only to be laughed at some more and invited to sue
CBC. CBC continued to ignore the Plaintiff even though the popular former
CBC reporter Mike Duffy was now employed by their largest corporate
competitor, CTV and they claimed Fundy was a riding to watch and at least
three newspapers and even the CBC’s blogger friend Charles Leblanc had
chosen to put his strange spin the actions and words of the Plaintiff while
calling him a Hells Angel. However, the aforementioned CBC journalist did
not keep his job very long after his boss and three directors of CBC
received the very same documents and CD that the Plaintiff’s political
opponents had in their possession. (The former CBC journalist did get a job
with the government of NB and has continued with his obvious malice ever
since)
33. The Plaintiff states that the CBC would not have ignored its mandate
and the standing of a candidate if he or she were a member of the Liberal
Party or the newly merged Conservative parties or the Bloc Quebecois Party
or the Green Party or the New Democratic Party without expecting to deal
with legions of lawyers. CBC had no legal right whatsoever to ignore the
Plaintiff merely because he was an Independent. In fact the mandate of CBC
as a publicly owned broadcaster dictates that he must not be ignored whether
he be a member of a powerful political party or not. With regards to this
complaint, on June 24, 2004 there were many journalists inside the
legislative properties of NB not just CBC. They published nothing about the
Plaintiff of his running for public office or his being barred or even after
their blogger friend, Charles Leblanc certainly did.
34. The Plaintiff states that in June of 2006 Charles Leblanc was also
barred from the same legislative properties but not the Public Documents
Building on the UNB campus. More importantly the Sergeant-at-Arms was clever
enough not to sign or date the English only document this time. Thus Charles
Leblanc who usually demands things in French from the government when he is
in trouble was never barred at all. The CBC immediately reported the barring
of Charles Leblanc falsely claiming that the Sergeant-at-Arms had signed the
Barring Notice. CBC wrote the Sergeant-at-Arms admitted that he had barred
about six others but did not disclose as to who they were. CBC did not ask
who who the other citizens were because they knew they would have to name
the Plaintiff as well. Many people have protested the barring of Charles
Leblanc and a petition to have it revoked was placed in the public record of
the legislative assembly to no avail. In 2006 Charles Leblanc was arrested
in Saint John and in 2011 in Fredericton. In 2009 and 2012 the FPF arrested
their blogging friend Charles Leblanc on the legislative properties. The CBC
reported each time but failed to follow up and investigate and report why
the Crown refused to charge Charles Leblanc in both instances. The CBC knows
that as soon as the Plaintiff contacted the politicians and police to remind
them that he would appreciate being called to testify at Charles Leblanc’s
trial as a hostile but ethical witness about the barring actions of the
Crown it would never go forward with the charges. Leblanc was arrested by
the FPF two other times in recent years and he is on trial right now. The
CBC knows the Plaintiff has talked to members of the RCMP, the FPF, the
Saint John Police Force, the Miramichi Police Force and the Edmundston
Police Force who were investigating Leblanc for various reasons since 2006.
The police usually denied knowing who the Plaintiff was as they refused to
answer his emails. The Plaintiff knows the reason why Charles Leblanc was
barred from legislative property. He agrees with the Crown doing so but it
failed to allow the nasty blogger the right to due process of law just like
it did with and several others. He has never understood why the Crown has
not charged Leblanc under sections 300 and 319 of the Criminal Code in lieu
of arresting him for protesting too loudly or possible child porn or
trespass or punching an equally nasty poetic beggar.
35. The Plaintiff states that by the end of November of 2004 a lawyer in
the employ of the Attorney General of NB had answered him in writing and the
FPF, two lawyers, the Mayor and a city councilor of Fredericton had some
very serious email exchanges with the Plaintiff. The only responses to the
Plaintiff about the breach of his right to peaceful assembly came from the
(NBPC) on September 14, 2004 acknowledging his complaint (File no
2110-04-11) and two letters byway of email from the FPF. On September 30,
2004 a Staff Sergeant of the FPF wrote that he was in possession of the
complaint and requested evidence to support the Plaintiff’s statement that
he had been barred from the legislative properties for “political reasons
not legal reasons” The Plaintiff responded and suggested that the FPF listen
to the tape of the interview he had with the NBPC and study all the evidence
he gave to the NBPC in the presence of a lawyer as a witness. The Staff
Sergeant responded on October 29, 2004 stating that he had detailed reports
from fellow members of the FPF and he had interviewed the Sergeant-at-Arms.
He claimed that his fellow police officers acted appropriately and he would
inform the Chief of the FPF that he did not have sufficient cause under the
Police Act to investigate the complaint the Plaintiff registered with the
NBPC against the FPF. The Plaintiff pointed out that the conflict of
interest but grateful the FPF acknowledged the incident. The Mayor of
Fredericton found no humour in that fact and sent the Plaintiff many emails
within minutes no doubt in an effort to overload his email account. In 2003
the Plaintiff had demanded the Crown investigate the actions of RCMP now the
RCMP should do the same with the Crown because that para-military police
force has jurisdiction everywhere in Canada including all public and private
property controlled by the Crown even military bases. The words of the
Sergeant-at-Arms, Commissionaires and police were witnessed by only the
Plaintiff. A legal action about their offences against his rights under the
Charter would boil down to their word against his. Evidence was required
because he was outnumbered and attacked by people the Crown employed to
understand the law. It was doubtful they would act ethically and until June
16, 2006 the Crown refused to put anything in writing to prove this claim
about the fact that the Plaintiff is barred from parliamentary properties.
36. The Plaintiff states that the Crown is aware that far greater offences
have been practiced within the Capital District of NB by the FPF and the
RCMP against the Plaintiff. Many servants of the Crown have challenged him
to seek relief in a Canadian provincial court. The Plaintiff will not oblige
Crown attorneys of thier desires he will file in a court of a country at a
time he chooses. Time is on the Plaintiff’s side even though he getting old
and was finally allowed to collect his Canada Pension. His children and
grandchildren are still very young. Whatever was done against the Plaintiff
was done against his Clan as well. All of the Plaintiff’s heirs are Canadian
citizens and two of them are American citizens as well. The Crown, INTERPOL
and the American law enforcement authorities cannot deny that there is no
statute of limitations on certain crimes. The problem the Plaintiff is
finding an ethical journalist to report about the legal actions that he and
the Crown have already been involved in since 1982.
37. The Plaintiff states that in October of 2004 if the Staff Sergeant of
the FPF had listened to the tape of his interview with the NBPC and studied
the documents they have in their possession he would not have been so quick
to dismiss the Plaintiff and his concerns in such a fashion. Their many
lawyers hardly ever allow corrupt police officers to admit that the
Plaintiff exists or put their malice towards him in writing. The Plaintiff
had explained to the NBPC what transpired on June 24th, 2004. To explain
briefly the police should have known instantly the Sergeant-at-Arms actions
were for political reasons as soon as he turned in the guest pass and picked
up his documents as he stepped outside the building. While the Plaintiff was
inside the legislative building he spoke to only three employees two
Commissionaires and the librarian. He did not interfere with the proceedings
in the House as he watched the MLAs and their assistants from the gallery,
some of whom he knew personally. He did notice political pundits in the
building. One Cabinet Minister’s assistant had been following him for a
couple of days. His political foes wanted him off the property immediately
but they knew that he was not shy of litigation if the Crown attempted to
place a malicious charge against him. Therefore they elected the
Sergeant-at-Arms to try bully the Plaintiff.
38. The Plaintiff states that he satisfied himself as to the reasons behind
the blatant malice once he asked Sergeant-at-Arms and the police three
questions as follows:
(1) The Plaintiff first asked was why he was being barred from the
legislative property. The Sergeant-at-Arms falsely claimed in front of the
police that the Plaintiff had tried to serve documents on somebody inside
the parliamentary building. The Commissionaires and police knew that was
untrue because they all witnessed the fact that the Plaintiff had left all
the documents in his possession with the Commissionaire at the entrance
before he was allowed into the building and they all watched him pick up the
same documents as he turned in a visitor’s pass after he was asked to step
outside of the building.
(2) The second question was to the police to see if they agreed to the
false claim of the Sergeant-at-Arms and if they would identify themselves.
After the Sergeant-at-Arms said something quickly in French and both police
officers stated that they agreed with him but only one would state his name
and rank.
(3) The Plaintiff then asked the Sergeant-at-Arms and the police if they
thought they had jurisdiction over him. They all said yes but refused to
take any documents from the Plaintiff just as the Deputy Prime Minister
suggested.
39. The Plaintiff states that three people who were mentioned during the
aforesaid meeting with the NBPC were Charles Leblanc, Byron Prior and the
most wanted American gangster Whitey Bulger. All three were well aware of
the Plaintiff and his actions. More importantly the NBPC were made well
aware of the RCMP’s knowledge of his possession of many American police
surveillance wiretap tapes. The NBPC were shown the very same tapes that he
had promised to give to the Suffolk County District Attorney in the
Dorchester District Court of Boston Massachusetts before a hearing to
discuss an illegal summons to answer a malicious unsigned criminal complaint
(Docket no. 0407CR004623). When the Plaintiff did so he was falsely
imprisoned under the charges of “other”.
42. The Plaintiff states that in 2014 a confidential letter from the lawyer
who is now the chair of the NBPC was published by Charles Leblanc. Within
the aforesaid letter by a lawyer who was an officer in the Canadian Forces
when the Plaintiff was illegally barred in 2004 explained why he and some
other unnamed lawyers claimed that the Chief of the FPF and the NBPC did not
have jurisdiction over the legislative properties in order to investigate
the wrongs of the members of FPF under the Police Act. The lawyers claimed
that whereas the police were acting under the orders of the Sergeant-at-Arms
the immunity afforded them by parliamentary privilege would be undermined if
the Chief of the FPF and the NBPC upheld the law and the Charter.
67. The Plaintiff states that in 2004 the 37th Parliament and many others
in NB and NL were informed that he knew of Byron Prior and Charles Leblanc
and that he supported their pursuit of justice byway of the social media. He
called his fellow Maritimers after reading their words about politicians and
listened to the reasons why they were collecting social assistance and could
not afford computers. They did not care about his concerns with politicians
but he believed them and offered his assistance by giving them computers.
The Plaintiff asked that they publish the truth about his actions and to
serve politicians copies of his documents. Leblanc publicly insulted the
Plaintiff after receiving his computer and stole documents he promised to
give to the Attorney General of NB and gave them to his activist friends
instead. Leblanc was asked why behaved in such a fashion and he wrote back
that he thought he was being funny and stated that he was not a sheriff then
sent an email asking if the Plaintiff was a fair comparison to his dog. That
email convinced the Plaintiff that Leblanc was a Conservative insider
because he had apparently read a letter sent to the Attorney General. It did
not take the Plaintiff long to figure out who his activist friends were
because Leblanc had forwarded their email address along with pictures of his
dog. Prior was difficult to deal with but he was true to his word. It was he
who delivered the documents to the parties named in paragraph 53. In 2005
Prior was sued for libel within his website. The Plaintiff wrote his defence
and counterclaim and it remained on the Internet until 2010. Prior’s one
website had more visitors than all the blogs of Leblanc until late 2006 when
the New York Times reported that a judge found Leblanc not guilty in a
criminal trial and considered him to be a legitimate journalist. As the
readership of his blog soared, Leblanc and all politicians became much
better friends. In 2007 the Irving media empire complained of the Plaintiff
and Leblanc to Google and Yahoo. In response the Plaintiff’s blog, two email
accounts and all his legal documents stored within Yahoo’s domain were
deleted. Leblanc’s blog was deleted then restored. The FPF arrested Leblanc
again in 2012. The Plaintiff reminded the Crown of a judgment of Byron Prior
finding Section 301 of the Criminal Code unconstitutional and law professors
came to Leblanc’s aid. The Plaintiff caused Leblanc’s “other personality”
blog to be deleted not the FPF.
68. The Plaintiff states that the Crown is well aware of three legal
actions against Byron Prior. One action is a civil lawsuit for libel filed
in Supreme Court of NL in January of 2005 against Byron Prior by a MP and
that a publication ban was placed on the matter immediately. Two are
criminal prosecutions of Byron Prior for libel. One prosecution under
section 301 of the Criminal Code was found to be unconstitutional in 2008.
The Plaintiff was falsely imprisoned by the RCMP in a mental ward of a
hospital after he spread the word that the Crown had lost. The Plaintiff
does not know the judgment in the second trial under section 300. He does
know that in 2009 Byron Prior filed some of the Plaintiff’s documents in the
docket before he was imprisoned in a mental hospital until early 2010.
69. The Plaintiff states that it was not logical that Crown considered
Byron Prior’s actions on the legislative properties in NL criminal. The
Crown was arresting and prosecuting him in NL while the RCMP were issuing
him permits to do exactly the same thing in front of the House of Commons
for months at a time from the spring of 2006 to at least the spring 2011.
The Crown prosecutes and defends all criminal actions at a provincial and
federal level. If the Crown was sincere in its prosecution of Byron Prior it
should have arrested him on the grounds of the House of Commons in the
spring of 2006. Instead the Crown had the RCMP and a lawyer whom the
Plaintiff ran against in the election of the 38th Parliament investigate
Byron Prior’s concerns at the request of his MP (Later appointed a Senator)
and the Minister of Justice (Who his left seat in the 41st Parliament
midterm as Minister of Public Safety and was appointed to be a judge).

Watchdog slams RCMP’s efforts to fix serious harassment problems, calls for oversight shakeup
Bullying and harassment remain serious problems within the RCMP, and only major changes to the way the national police force is run will make a difference, says a national watchdog.
In a report today, the Civilian Review and Complaints Commission for the RCMP says the force lacks both the will and the capacity to address the challenges that afflict its workplaces.
The commission urges the federal government to usher in civilian governance or oversight for the paramilitary-style police force.
Public Safety Minister Ralph Goodale ordered the commission report to see if the RCMP had properly acted on commission recommendations made in 2013. At the time, the watchdog said the Mounties must take swift and effective action to reassure both members and the public.
The RCMP introduced new harassment policies and processes in 2014 aimed at promptly dealing with workplace conflict before it escalates.
The latest report, however, says the vast majority of complaints under the new policies involve allegations that managers abused their authority. These included accusations of abusive language, such as “you’re dirt,” “people here don’t like you” and “nobody wants to work with you.”
Others complained of being berated in public, punitive transfers or having leave arbitrarily denied.
“Organizational dysfunction in the RCMP has been well documented, and the commission’s current investigation confirmed that the problems of workplace bullying and harassment persist,” the report says.
The commission found that while senior leaders in the RCMP have made efforts to prevent harassment –particularly at the divisional level — these initiatives have been limited and ad hoc, and have not received the necessary support from headquarters.

Incidents of harassment — sometimes extending over months or years — can have serious professional consequences and can cause real emotional and physical harm, the watchdog adds. In turn, this may affect the operational effectiveness of the RCMP.
A key problem is that the RCMP’s definition of harassment is unduly narrow, and likely results in valid complaints being dismissed, the commission says. The policies are also overly complex and difficult to comprehend.
In addition, they place “inappropriate emphasis” on the responsibility of the complainant to confront his or her harasser, and on the duty of supervisors and managers to report harassment, the report says.
Unlike other policing organizations, the RCMP primarily appoints uniformed members to senior administrative positions like human resources and labour relations, rather than civilian experts, the report notes.
The commission recommends hiring more civilian expertise within the force. But it also calls for basic structural change, such as:
— a model that leaves administrative and financial matters to civilians, and operational issues to RCMP commanders;
— division of responsibility between a civilian commissioner and a uniformed chief of department, like the New York police; or
— a civilian board of management that would provide general direction to the RCMP and enhance public accountability.
“While RCMP senior leadership is not absolved of the responsibility to make more sustained and meaningful efforts to address workplace harassment going forward, lasting change will only come from fundamental reforms to RCMP governance,” the report concludes.
RCMP Commissioner Bob Paulson, who plans to step down at the end of next month, has grappled with the harassment issues plaguing the force throughout his tenure.
Last October, Paulson delivered an abject apology to hundreds of current and former female officers and employees who were subjected to alleged incidents of bullying, discrimination and harassment dating back as long as four decades.
He also announced the settlement of two class-action lawsuits stemming from the harassment allegations that have cast a long shadow over the police force.

On October 6, 2016, an historic settlement was reached in the systemic
harassment class actions brought against the Royal Canadian Mounted
Police by female RCMP employees. Under the proposed national
settlement, every single living current and former female regular
member, civilian member, and public service employee of the RCMP who
worked within the RCMP since 1974, and who experienced gender and/or
sexual orientation-based harassment and discrimination, will be
eligible to claim compensation, without fear of disclosing her
identity to the RCMP or of reprisals. The settlement is not effective

Crown’s motion to strike the statement of claim and confirming that

Kim Orr Barristers is prosecuting a class action against the Attorney
General of Canada involving allegations of gender- and
sexual-orientation-based discrimination, bullying and harassment of
female Royal Canadian Mounted Police (the "RCMP") employees. The
action has been commenced in Ontario on behalf of all current or
former female regular members, civilian members and public service
employees of the RCMP in Canada, excluding persons resident in Quebec.
The claim alleges that men and women were, and are, treated
differently within the RCMP, and that female RCMP employees have been
subject to systemic discrimination, bullying and harassment on the
basis of their gender and/or sexual orientation. It also alleges that
the RCMP has failed to investigate, adjudicate and resolve conduct and
complaints about these issues, despite repeated reports over the years
about the problems within the organization.
The plaintiff is a former senior-level RCMP member who alleges that
she suffered discrimination, bullying and harassment throughout her
26-year RCMP career. The plaintiff alleges that as a result of this
treatment, she, as well as the other class members, suffered serious
injuries physical and emotional injuries, including post-traumatic
stress disorder, diminished self-worth, depression, and anxiety. The
claim also alleges that as a result of these systemic issues, female
RCMP employees have been denied training and promotions, and have even
taken early retirement or have left the organization.
The action seeks general, punitive and special damages for the
defendant's alleged failure to fulfill its statutory, common law and
contractual duties to provide female RCMP employees with a work
environment free of gender- and sexual-orientation-based
discrimination, bullying and harassment. The action also seeks damages
on behalf of family members of female RCMP employees who are entitled
to assert a claim under provincial legislation.

of male employees
Current and former members allege they were physically intimidated,
denied promotions, belittled and bullied

The RCMP will soon face another class-action harassment lawsuit — this
time on behalf of male Mounties and civilian employees of the force.
Earlier this month, the federal government and the RCMP set aside $100
million to settle an estimated 1,000 cases of female employees being
harassed and bullied at work.
CBC News has learned that one of the law firms that represented those
women is preparing to bring another suit for men — which could
potentially be much bigger given that men make up roughly 80 per cent
of the RCMP's workforce.

'This is a way for everybody to heal': ex-Mountie on RCMP compensation
External body needed to probe workplace complaints, senior Mountie says
"We've spoken with hundreds of members, and we're contacted by new
members every day," said lawyer Megan McPhee of Kim Orr Barristers in
Toronto, who has been working on the case for years. "The stories are
very consistent. We're told that there is a culture of bullying and
harassment within the force, and one of the regular issues that we
hear is a fear of speaking out, a fear of reprisals."
Cpl. Michael Mansoor, who's due to be medically discharged in January,
says he was diagnosed with PTSD after what he alleges was years of
harassment at the hands of his colleagues and superiors.
He says it started in 2001, when he was posted to his hometown of
Richmond, B.C., where his brother was in conflict with the law. It
wasn't long before Mansoor said he found his duties restricted.
"I was banned from any work section in the detachment except for
general duty and traffic because they acknowledged that there might be
a conflict," said Mansoor.
Wrongly accused of sexual assault
Despite pleas for a transfer, he says his superiors stuck to the local
convention that a member must serve five years in the detachment
before being moved.
Documents obtained under the Access to Information Act suggest
officers were suspicious of his family ties. Eventually, Mansoor found
himself suspended with pay and under investigation for what he alleges
are two trumped-up internal disciplinary charges.
Furthermore, due to a clerical error, Mansoor was also initially
accused of sexual assault.
"There was a minor glitch with [Mansoor's] security suspension
document service this morning," reads an internal email about
Mansoor's disciplinary charges. "There is a reference to a 'sexual
assault'.... It was our conclusion that HQ Ottawa had screwed up the
paperwork. Seems likely that they took a previous form letter,
re-tooled it for [Mansoor's] case and did not remove a phrase that did
not apply in this case."
As for the two other allegations, they later proved unfounded.
Whisper campaign
Over time, Mansoor says the ongoing whisper campaign and harassment
made him ill.
"There comes actually a point where you start to look at yourself and
go, 'Am I bringing this on myself? Because surely it's not this
widespread in an organization,'" Mansoor said.

He left the force last year after 26 years in a job he says, for the
most part, he loved. He was making his way up the ranks and working
towards another promotion, he says, but that came to a halt near the
end of his career when management changed at the RCMP detachment in
Cornwall, Ont.
"[I] started covering my back. Started taking notes to make sure I was
not going to be hung out to dry," Desrochers said.
Years of meticulous notes document allegations of being micromanaged,
stripped of his responsibilities, belittled in front of colleagues for
taking initiative and denied opportunities to further develop his
career.
The worst incident, according to Desrochers, was when the inspector
refused to sign off on his application to serve in Kosovo due to
shortcomings with his performance. Yet Desrochers says all his boss
managed to come up with, after repeated requests for specifics, was a
late overtime claim.

"It takes a toll on you because you start questioning yourself...and
then you're not good," an emotional Desrochers told CBC News.
Desrochers welcomes the lawsuit.
"If nobody comes forward to say there's a problem, how are they going
to know there's a problem. Is it just me sitting here? No."
Belittled, physically intimidated
It's not just men in uniform who allege they've been harassed.
Garth Caron worked as a public servant from 2005 to 2015, doing
administrative work in detachments in Saskatchewan and Alberta. Caron
says his first experience with harassment was when a few Mounties took
issue with him being gay and subjected him to a number of pranks.
"I came in one morning to my workstation and I noticed a number of
female items on my desk — boxes of tampons and things like that — and
it kind of struck me as odd as to why they would have been left
there," he said.
At another detachment, Caron said a sergeant questioned his Métis
status, belittled him in front of colleagues and tried to physically
intimidate him. The union got involved and Caron says he agreed, while
under a great deal of duress, to retire before he was ready to leave
the workforce.
It's no secret the RCMP has a bullying problem. Commissioner Bob
Paulson has said so himself. In a 2012 interview with CBC News,
Paulson conceded that he too had been harassed at work.
"I think in the day, if you weren't sort of in line with your
officer's expectations or consistent with his or her vision of where
the organization was going, then you were pushed aside," he said. "And
it's a very uncomfortable feeling and a very destructive feeling, and
it doesn't speak to a transparent, ethical, organization."

OTTAWA — Liberal MPs ignored the opposition's concerns Wednesday and
voted in Mario Dion as the new ethics commissioner for a seven-year
term.
Questions from New Democrats about Dion's nomination dogged Prime
Minister Justin Trudeau in question period. The prime minister
defended a nomination process opposition MPs say was secretive and
partisan.

"The watchdogs don't work for Liberals. They work for all of
Parliament and we represent all Canadians," said NDP MP Murray Rankin.
Trudeau brushed off accusations the government failed to properly
consult with opposition leaders, saying the selection committee did
its due diligence to "arrive at the right choices" for new watchdogs.
The political zeal of prime minister's response didn't please NDP MP
Nathan Cullen, who suggested that Liberals are operating on a double
standard when it comes to ethics.
The prime minister said the government asked the opposition for help
with names, suggestions and proposals "months ago" to fill two
watchdog vacancies — lobbying and official languages. Trudeau did not
say if the government did the same when compiling a list of candidates
for the ethics commissioner role.
With the chamber on the cusp of holiday break, Trudeau took a shot at
the opposition saying, "You can't help but feel bad" for them. He said
job creation numbers and a growing economy are evidence of "positive
outcomes" that leave the opposition "with nothing to do but fling
accusations and throw mud."
Earlier, NDP Leader Jagmeet Singh said he was disappointed by Dion's
reluctance to promise the House of Commons' ethics committee that he
would complete two investigations that involve the prime minister and
finance minister.

Heated committee hearing
Dion's nomination was met with scrutiny on Tuesday when he appeared
before a committee hearing to face questions about his qualification
to be the next ethics commissioner.
He offered a summary of his 35-year career in the public service,
noting an 18-year stint at the department of justice, as well as a
four-year term as public sector integrity commissioner between 2011
and 2014.
Dion faced a barrage of questions from opposition MPs Peter Kent and
Nathan Cullen, who were most critical over his potential efficacy as
the new ethics commissioner.
Kent opened his remarks with a jab at the Liberal government, saying
Dion must be anticipating "a very busy time" because there could be
"much to investigate."

Kent asked Dion if he could reassure the committee that two
high-profile investigations — one looking into the prime minister's
vacation to the Aga Khan's private island in the Bahamas; the other
reviewing how new pension legislation could have affected the finance
minister's family company — would continue if he is appointed as the
next ethics commissioner.
Dion said he would consider the files as one of his "top priorities,"
but stopped short of promising if he would complete the
investigations, both initiated by outgoing ethics commissioner Mary
Dawson whose current term ends Jan. 8, 2018.
Kent asked Dion to talk about "a couple of black marks" linked to his
record.
In 2014, Auditor General Michael Ferguson tabled a report that
criticized Dion's office for "gross mismanagement" of two files
related to a whistleblower during his performance as public sector
integrity commissioner.
The government was forced to extend its deadline to search for a new
ethics watchdog, saying there wasn't a "pool of qualified candidates"
for the job.
Despite raising a suite of concerns during the hearing, Kent told
reporters that he intends to vote to confirm Dion's nomination as
ethics commissioner.

Dion said he decided to apply for the role in late-summer. In
mid-November, the government called him in for an interview. That
hour-long interview took place three weeks ago, he explained to the
committee.
One of the main concerns over the government's decision to nominate
Dion is over its failure to consult with opposition party leaders, as
required in the Parliament of Canada Act.
"We were given notice just last last week from the government and here
you are today with Parliament, perhaps, closing tomorrow," Cullen
said.
Dion was grilled by Cullen over an email he sent in 2011 when he was
the interim public sector integrity commissioner.
In the email, Dion gave a heads up to a Privy Council Office official
to brief former clerk Wayne Wouters about an issue that may come up in
a committee inquiry.
"I will be pleased to provide details to a PCO officer to ensure Wayne
is not blind-sided," Dion wrote in the Feb. 2, 2011 email. Cullen
asked Dion if he regretted the email.
Dion responded by saying he has no recollection of what the subject
was about. "I must have written hundreds of thousands of emails," he
said.
"Do you see my concern?" Cullen said. "That as an integrity
commissioner if you're giving somebody who might be falling under
investigation a heads up so that they're not blindsided, would fall
completely outside of your purview to do."

In his explanation, he also hedged that his memory is still unclear
about details.
The email was an opportunity to "give the clerk a chance to organize
and respond," Dion said. "But I don't recall who it was or what it
was."
Conacher: Liberals have 'jumped the shark' with Dion nomination
Democracy Watch, an Ottawa-based political accountability watchdog,
called the selection a "secretive, PMO-controlled, partisan process."
Duff Conacher of Democracy Watch said it's "outrageous" that the
government nominated someone with a "clear unethical record" to the
role as ethics watchdog.
He referred to the process in how Ontario makes judicial appointments
as a "world-leading model." In that process, selection committee
members — a majority of whom appointed by non-governmental
organizations — compile a merit-based public list for cabinet to
choose from.
The selection committee tasked with finding an ethics commissioner
nominee was stacked with members of the Privy Council Office and
Treasury Board, including Government House Leader Bardish Chagger's
chief of staff.
"I think the Liberals have jumped the shark with this appointment,"
Conacher told HuffPost Canada.
Confidence low over Liberal watchdog appointments
Dion replaces Mary Dawson, the first conflict of interest and ethics
commissioner, who had her term extended three times as the Liberals
sought a replacement. Trudeau who is personally under investigation by
Dawson for his Bahamian vacation, excused himself from the process as
well as his senior staff handing over the choice of the new
commissioner to the government house leader.
The Liberals also extended the term of the lobbying commissioner,
Karen Shepherd, three times, only nominating a new individual, Nancy
Bélanger, less than two weeks ago.
At the time, Trudeau also appointed a new official languages
commissioner, Raymond Théberge to replace Graham Fraser who retired
last December.

Earlier this year, the Grits had sought to replace Fraser with Ontario
MPP and Liberal cabinet minister Madeleine Meilleur.
But the partisan appointment outraged the Conservatives and NDP who
also remarked that they had not been consulted, as required by law.
Then NDP leader Thomas Mulcair noted that the commissioner's office
had received complaints about Trudeau using French to respond to an
anglophone Quebecer months prior and he accused the prime minister of
being in a "clear conflict of interest" and of naming someone from his
"inner circle."
Meilleur is a big Liberal donor who had cut a cheque to Trudeau's
leadership campaign, but it was her comments to parliamentarians that
sunk her nomination.
Under questioning from MPs and senators, Meilleur acknowledged that
she had spoken to Trudeau's chief of staff, Katie Telford, and his
principal secretary, Gerald Butts — two people she knew well from
their days at Queen's Park — about possible employment.
She had originally wanted to be a senator but said she quickly found
out that nobody wanted to appoint former politicians to an institution
Trudeau was trying to turn non-partisan. The Prime Minister's Office
insisted that none of the conversations dealt with the commissioner's
position specifically. But seemingly unsure her appointment would be
approved by the Senate, Meilleur declined the nomination in early
June.
There are still several parliamentary watchdog positions — well-paid
lengthy tenured jobs tasked with keeping the government, and, or,
parliamentarians accountable — that have yet to be filled.
Information Commissioner, Suzanne Legault had her term extended by six
months in June. Her replacement has not been named.
The Chief Electoral Officer, the person charged wielection in 20 months, has yet to be appointed. The outgoing head,
Marc Mayrand, retired a year ago.

The Canadian Judicial Council has completed its review of the conduct
of Manitoba Court of Queen's Bench Justice Vic Toews and says it won't
be investigating complaints against him further.
The council said Thursday that two complaints were reviewed by Justice
Christopher Hinkson, chief justice of the Supreme Court of British
Columbia, who found nothing that would warrant Toews' removal.
"Chief Justice Hinkson notes that the [federal ethics] commissioner
did not make any findings that put into question the integrity, good
faith or credibility of Justice Toews," the council said in a media
release.
"Upon a full review of all the relevant information, Chief Justice
Hinkson found an absence of any information that would suggest an
attempt to mislead or reveal conduct incojudicial office."
The review was launched following a complaint received in relation to
a report by the Conflict of Interest and Ethics Commissioner.
In April, Canada's ethics commissioner found the former Conservative
cabinet minister breached conflict of interest rules by doing
consulting work for two Manitoba First Nations after he left office.
Mary Dawson's report last spring said Toews advised a First Nations
group he had once fought in court when he was Treasury Board president
in the former federal Conservative government.
Dawson's report said Toews "acted for or on behalf of a party that was
seeking relief against a decision in which he had been involved as a
minister of the Crown."
The report said Toews also broke the rules requiring a two-year
cooling off period for providing consultancy services to the Norway
House Cree Nation through a company owned by his wife.

against Toews with the Canadian Judicial Council after his alleged

"The actions that were under scrutiny by the commissioner were not
ones that raised issues for the Canadian Judicial Council," Norman
Sabourin of the CJC said Thursday. "I am of the view that there was a
thorough review because it's an issue that was in the public domain
and it deserved a thorough review, which is what the council did."
Toews' lawyer said Thursday he is happy the matter is finished.
"I thought the [ethics] commissioner's process was badly, badly flawed
and unfair, and so I'm happy that everything's over," Robert Tapper
said.

that stage included no contingency for a handing over of civil
authority to a vetted Iraqi government and bureaucracy.
There was no detailed plan for Iraq being "liberated" and returned to
its people...nor a thought to an eventual exit plan. This was contrary
to the lessons of Vietnam but also to current military thought, that
folks like Colin Powell and "Stuffy" Leighton and others elucidated
upon."What's the mission" how long is the mission, what conditions are
to met before US troop can redeploy?
Prime Minister Jean Chretien and the PMO were even at the very
preliminary planning stages wary of Canadian involvement in an Iraq
operation....History would prove them correct. The political pressure
being applied on the PMO from the George W Bush administration was
onerous
American military assets were extremely overstretched, and Canadian
military assets even more so It was proposed by the PMO that Canadian
naval platforms would deploy to assist in naval quarantine operations
in the Gulf and that Canadian army assets would deploy in Afghanistan
thus permitting US army assets to redeploy for an Iraqi
operation....The PMO thought that "compromise would save Canadian
lives and liberal political capital.. and the priority of which
....not necessarily in that order. "

Some where in the streets and alleys tonight
Some where in the alleys of New Brunswick and Calgary are two uneducated
bums, another day closer to their demise. They are homeless, shiftless,
uneducated, loud, obnoxious and insane ...for these "people" death now
is
better than another day of life...they have made nothing of their
lives...and are nothing but a burden to their families, "friends" and
the....tax payer.
David Amos is reduced now to the status of bum, wandering about asking
people
for spare change, and scouring the streets for cigarette butts to smoke.
When he gets some change he does this sort of thing.
I managed to talk to a Lieutenant-Colonel Tony Weber is Acting Base
Commander
of Base Gagetown 506 422 2000 ext 1410. He and one of his Sgt Majors
even
looked at Barry Winter's blog for me
We seemed to get along as we discussed their vague knowledge of
politicians,
Afghanistan, other officers they claimed to have never heard of, the
CSE, our
missing emails and the words within Barry Winters blog. the Lt Col truly
seemed like an ok dude.
But the instant he said that Barry Winters malicious words were of no
embarrassment to him I got pissed all over again. Imagine if such shit
had
been published by a former officer about him or his family? I bet he
would have sued his bosses long ago if winters had not be locked
up immediately.
Anyway I told the Lt Col that I would see him in courtand hung up on the
snobby bastard and split before the RCMP attempted to corner me in
another
phone booth like they did for another one of Harper's former Minister
GOh Dear....how far has the "real deal" the "ethical whistle blower" has
fallen.
