The Opposition Liberals have moved to force a vote in the legislature next Friday on the contentious issue of shale gas development.

Liberal Leader Brian Gallant has introduced an amendment to the Progressive Conservative government's throne speech motion calling on the PCs "to continue the moratorium on hydraulic fracturing in all parts of the province."

MLAs will have to vote on that amendment Nov. 30 before voting on the main throne speech motion itself. The latter vote will determine if the PC minority government can govern with the confidence of the legislature.



Three MLAs from the People's Alliance have promised to vote to keep the PCs in power by supporting them in all confidence votes. But the party's members are less willing to support legislation that would lift a moratorium on shale gas.

Gallant told the legislature in his official response to the throne speech that the PCs don't have a mandate to allow fracking.

"There absolutely has to be a clear majority of the people of this legislature that would allow for that moratorium to be lifted in any shape or form," he said.

Liberals accused of playing political games


PC Premier Blaine Higgs has already promised legislation to create local exemptions to the Liberal moratorium in areas of the province where there is support for development.

But Gallant noted Thursday that the law passed by his government gave cabinet the power to impose a moratorium with a simple order.

That means the law also gives the new Higgs cabinet the power to "unilaterally remove or modify" the moratorium without a vote in the legislature, he said.

Higgs told reporters he would go back and check on that.

"I guess I should go and read the legislative process and what the bill actually was and how it was worded," he said.

Higgs said the Liberals are playing political games that contradict their promise to collaborate with the government in a legislature where no party has a majority.

"You hear all the flowery words from a week ago, but boy, the tone's starting to change now," Higgs said.

Alliance votes


Gallant introduced the amendment one day after Fredericton-York Alliance MLA Rick Desaulniers said he was "not going to vote in favour of shale gas, period."

The other two Alliance members, leader Kris Austin and Miramichi MLA Michelle Conroy, also said they were hesitant about supporting legislation to allow local exemptions.

Without support from the Alliance, Higgs and the other 21 PC MLAs would not be able to pass legislation alone in the 49-member house.

Austin said, however, that he won't necessarily support the Liberal throne speech amendment, either.
"I don't want to put barriers up for areas that want to proceed, like Sussex," he said. "That's a local issue for them and that's something they've elected a local MLA to address."

He also said if the amendment is considered a confidence vote, he and his two fellow Alliance MLAs would honour their promise to prop up the Higgs government.

"We're not going to collapse the government for some sort of trick that the opposition's trying to put forward," he said.

"It seems like the opposition wants another election. It baffles me. We're trying to do everything we can to avoid another election and instead get things done in government."

No mention in throne speech


Gallant said Thursday he did not consider the amendment to be a confidence matter.

Memramcook-Tantramar Green MLA Megan Mitton said she would vote for the Liberal motion and, given the comments by Desaulniers on Wednesday, "it's my impression that there would be the votes to pass that motion."

She said the Green Party is working on legislation to write the moratorium into law because the throne speech amendment wouldn't be binding and is "more of a symbolic suggestion."

Gallant told reporters that it was "bizarre" that Tuesday's PC throne speech, laying out the new government's agenda, didn't explicitly mention its plans to revive shale gas.

Austin said on Tuesday he had urged the Tories to not include a direct reference in the speech.
"At this stage of the game in a minority situation, we don't want to be tackling issues that are highly controversial," he said.

Gallant said that's further proof of a secret deal creating what he repeatedly called "an Alliance-Conservative government."

Higgs said he chose to make the throne speech more of a "philosophical process" than the usual laundry list of promises.

"We're not going to try to cover everything," he said. "I wasn't trying to make it a controversial document. In fact, just the opposite."
Even so, he hasn't shied away from his plan to allow fracking in areas that support it.

Asked if he would lift or change the moratorium by cabinet order if it turned out he didn't need legislation, Higgs said he would "commit to reading that piece of legislation so that I'm very clear on what it requires and doesn't require, and we'll talk about it after that."

But he said he still wanted to have a vote in the legislature.

"That is what I think is the right thing to do, and that will be my goal," Higgs said. "So if it has a different capability in the actual document, that isn't what I intend to do at this stage."

I cant recall any complaints about Corridor and Potash Corp utilizing hydraulic fracturing in the Sussex area since 2007. It wasn't until the American company SWN Resources became interested in New Brunswick that there were any protests at all. They obviously were operating in an area where they were not welcome

N.B. bilingualism debate flares as parties' battle for power unfolds



SAINT JOHN, N.B. — A resolution from an Acadian seaside town council has fired a warning shot across the bow of the New Brunswick Tories, as the municipal councillors try to rally wider francophone support condemning any minority government propped up by the People's Alliance party.

The resolution on the bilingualism issue from Cap Pele councillor, Hector Doiron, was addressed to both the Progressive Conservatives, with 22 seats, and the Liberals, with 21, as they continued Wednesday to struggle over which party will form a minority government following the tight Sept. 24 election.

However, the People's Alliance, with three seats, has only confirmed an informal, verbal commitment to support the Tories for a year and a half — putting leader Blaine Higgs in the crosshairs of francophone concerns.

The right-leaning alliance has called for an end to linguistic duality in some government services, such as school busing, and has urged the abolishment of the office of the official languages commissioner.

The Liberals have said they won't hold talks with People's Alliance Leader Kris Austin, even as Premier Brian Gallant has pursued a coalition with the Green Party, which also won three seats.

Any form of coalition with the small, populist party drew strong words in Doiron's resolution, as his document argued even an informal deal should be regarded as an assault on Acadian rights.

"The People's Alliance Party has no legitimacy in attacking fundamental rights of the Acadian and francophone community of New Brunswick and in having a platform that does not respect the country's supreme law, The Constitutional Act of 1982," says the document, written in French.

Meanwhile, comments from former Supreme Court of Canada judge Michel Bastarache that a significant slice of anglophone New Brunswickers had voted "to abolish bilingualism" made headlines on Wednesday in the province.

Bastarache argued before the Senate committee on official languages that the People's Alliance was "created to oppose bilingualism, to oppose francophone schools and francophone hospitals."

People's Alliance issued a news release responding to the municipal leaders' critique, saying the party's policies were being portrayed incorrectly, and referring to the Cap Pele councillor as a Liberal partisan.

"The People's Alliance from day one has said we respect bilingualism and the rights of both official language groups to receive service in their language of choice anywhere in the province," said the release.

"As most are aware, (school) transportation based on language has not been legally designated as an acquired right."

Still, the municipal council's resolution may reappear at an upcoming annual meeting of the francophone association of municipalities, representing 50 of the province 104 municipalities, said the group's director, Frederick Dion, in an interview.

"It (the Cap Pele resolution) is not clear. It's more like a statement at this point. ... It's not impossible that the resolution or another form of it could be presented to the members," he said.

The association also published a resolution last week urging parties not to form a coalition with the People's Alliance.

Meanwhile, Higgs said Wednesday his party believes in co-operating with all members of the legislature, and is merely seeking assurances the smaller parties won't move to bring down his government.

He said the resolution from Cap Pele goes too far because his party has made clear it will maintain its support for bilingualism, as laid out in the party's constitution.

"We've been very clear that our party constitution and our party principles aren't changing," he said.
"I think it's an overreaction. We saw it during the election process. It's a serious overreaction against me. I found that most disturbing. I found it almost a personal attack on myself."

Gallant has said he'll go forward with a throne speech on Oct. 23, even as recounts are unfolding this week in three ridings with close results — one held by the Tories, one by the Liberals and the third by the Greens.

Recounts started Wednesday in Saint John Harbour, where there was a narrow Liberal win, and Memramcook-Tantramar, where the Green candidate defeated a Liberal rival by 11 votes.

A lawyer for the Progressive Conservative candidate in the Saint John district has alleged that about 40 electors voted twice in the riding, which was won by the Liberals by a 10-vote margin.

The recounts in both ridings were expected to continue Thursday, while a third vote recount has been ordered for Thursday in the riding of Oromocto-Lincoln-Fredericton, a seat the Tories won by 93 votes.

New Brunswick's Tory leader says a four-year agreement with one of the smaller political parties would help create stability in a province stuck with a deadlocked result from last week's election.

The Tories, led by Blaine Higgs, won 22 seats in the legislature — one more than the Liberals. Neither party has enough seats for a majority. However, Liberal Premier Brian Gallant has said he intends to continue governing as both leaders try to gain support from the third parties holding the balance of power.

On Monday, Higgs met with the Green Leader David Coon and emerged to say the parties share some common policy areas, such as improving the openness of government.

He also said the Greens are interested in a four-year agreement like the one in British Columbia between the NDP and the Green party, which states the agreement is in effect "until the next fixed-date election."

Though the B.C. agreement doesn't guarantee the support of the Greens, it sets out a series of guidelines on how the two parties will work together, and it requires the minority government to hold a referendum on proportional representation.

Higgs said the document is "maybe more thorough" than something his party would sign, but added he'll see where talks go with the Green leader.

Coon issued a brief statement Monday, saying the "ongoing discussions" with Higgs and Gallant will continue this week.

"Both agreed with me that we need to find a way to bring a stable government for the people of New Brunswick in this minority government situation," Coon's statement said. "I and my caucus will continue to work to achieve this."

The right-of-centre People's Alliance and the Green party scooped up three seats apiece on Sept. 24.
The People's Alliance has already said it would help prop up a minority Tory government for up to 18 months, even though a formal deal or coalition has not been struck.

As for the Greens, they have yet to make any commitments, official or otherwise.

Higgs told reporters that he likes the idea of the longer-term agreement being floated by the Greens, and he said it was something People's Alliance Leader Kris Austin might consider as well.

"We're using the template that was struck out West ... maybe it's more thorough than something we need to have," Higgs said after his meeting with Coon.

"Ideally, that agreement is a four-year document. And I think if we can find a four-year commitment, and I think Mr. Austin would also be open to that, because we want stability here in the province, and that's what we're striving for."

Higgs also said it's important for the province's financial stability to work out a longer-term arrangement that will ensure bond raters don't downgrade the province's credit rating due to political uncertainty.

"If they think we're going into an election, that's just one more item bond raters look at ... and then we're deeper in the hole," he said.

Austin said in a telephone interview that while his party also wishes to create stability in government, "at the same time we want to have our autonomy as a party to continue to fight for things we've been fighting for all along."

He said he is hesitant to say he'd favour a four-year agreement without looking into the possibility in greater detail.

Higgs was recently downplaying his party's relationship with the People's Alliance, describing it as an informal, verbal agreement.

However, Austin said that he will expect talks with a Progressive Conservative government prior to offering support on the throne speech and financial bills.

"I would expect to have some kind of discussions or negotiations leading into it," he said.

On Friday, Gallant said he would try to form a minority government with the Green Party and will recall the legislature for a throne speech by Oct. 23.

Gallant said the Liberals will not form a coalition with the People's Alliance, saying there are "fundamental values" the Liberals don't share with the smaller party, particularly their language policies.

The two parties vying to be the power brokers in New Brunswick’s minority parliament could scarcely be more different when it comes to policies and leadership styles.

The vote on Monday saw surprise gains for the People’s Alliance Party, a party on the right of the spectrum that has questioned policies such as ensuring francophones have the right to separate school bus services.


Its leader, Kris Austin, has a populist style, and was in an exuberant mood on Monday evening.

“This is what victory looks like folks,” he told new constituents in Fredericton-Grand Lakes, with his party elected or leading in three seats of the 49-seat legislature, late on Monday night.

“The People’s Alliance tapped into that frustration with the governing elites. They call themselves the People’s Alliance for a reason. They’re the people’s party,” said Don Wright, a political scientist at the University of New Brunswick in Fredericton.


The party favours dropping the moratorium on fracking, bringing in electoral recall and dropping corporate subsidies.

Meanwhile, David Coon, the Green leader who was handily re-elected in Fredericton South, adopted his familiar low-key, critical stance as his party expanded to three seats in the legislature.



His acceptance speech seemed to cast his new rival in a harsh light, perhaps signalling the message he’ll be delivering about his new rival in the months to come.

“The people of Fredericton South voted for hope, not fear. They voted for kindness. … They voted for change, not the status quo. And you voted for goodwill and not for anger,” he said, as the Greens had been declared elected in three ridings – two with large francophone populations.

In an interview late Monday night, he said Austin’s party is willing to strip away services to francophones in emergency medical services, and advance environmental policies that lead to carbon pollution.

“It seems willing to take people’s rights away when it comes to the Acadians and francophones of this province. … They also seem prepared to open up and support fracking to exploit shale gas in the face or risk to our water supply and climate change,” he said.

“They’re pretty fundamental differences.”

Austin said there are some differences between the two smaller parties, but noted that both have called for an end to the spraying of glyphosate on forests and more free votes of members of the legislature.

“There’s some common ground there, but we’ll see how it works going forward,” he said.

Both leaders have had a long, hard grind to their electoral success.

Coon took over leadership of the party in 2012, and won the party’s first seat in 2014, after a career as an environmentalist who critiqued large industry’s close ties with government in exploiting the province’s natural resources.


Austin lost his bid for a seat by fewer than 30 votes during the 2014 election, and has spent four years gradually building the party around the province.

Neither of the two small parties won five seats, which is what’s required for official party status.

However, Wright said both politicians are pondering what potential alliances they might form to advance their agendas.

The political scientist said it’s likely the Liberals would first approach the Green party for their support as they try to form a minority government, adding that Greens are more ideologically compatible with the Liberals than the People’s Alliance.

“It’s going to make for interesting bedfellows in a minority government,” Wright said.

He said the difference between the Greens and the Progressive Conservatives over a carbon tax and other environmental issues could be too large a gulf – pushing the Tories toward the People’s Alliance.

Erin Crandall, a political scientist at Acadia University, said which ever party forms government will have to work with the two parties, and it will make for a different kind of governing from the norm in the province – which hasn’t had a minority government in almost a century.

“It’s really interesting because you have the People’s Alliance and the Greens, which are kind of parties that don’t necessarily kind of side easily with the two parties that are governing,” she said.

 “Nobody wants an election right away, and it might mean less legislation is being passed. … But the legislation that is passed will have at least two parties support.

FREDERICTON -- The New Brunswick provincial election campaign is officially underway.

Chief Electoral Officer Kimberly Poffenroth signed the writs yesterday to set the wheels in motion for the vote set for Sept. 24.

The economy, energy, trade, and health care are expected to be among the major issues debated door to door as candidates vie for the 49 seats in the provincial legislature.

The campaigning has been underway for some time, but now all the campaign signs will go up, and more promises made.

Liberal Premier Brian Gallant makes a campaign announcement today in Moncton, while Progressive Conservative Leader Blaine Higgs makes an announcement in Tracyville, near Fredericton.

The leaders of the Green and People's Alliance parties are campaigning in the Fredericton area, while the New Democrats launch their campaign in front of the provincial legislature.

At dissolution the Liberals had 24 seats, the Progressive Conservatives 22, there was one Green and one Independent, and one vacant seat.

I got a few late stories that I want to bring up.
They had a protest at the Legislature on Wednesday
and I would say about 400 people showed up. I made my
own little investigation in the crowd and I soon found
out that many people from the Northern Part of the
Province knew about my protest.
These Acadians read about my protest in L’Acadie
Nouvelle! A few weeks earlier, I found out that the
English Population from the Miramichi area didn’t know
about my fight so this shows me that it’s so important
to have the media covering your issues.
During the protest, I felt like I was in a police
state. There were cops are over the place. I
approached three of them and said - My God? We need
violence, bricks going through windows, people being
shot and tear gas!!!
This is the only way that the Government will
listen.
One cop said - If I have to use my gun? I know
exactly where my first bullet is going to go!! Pretty
scary…lol….
Speaking of violence?
That guy from the Sackville area who went to
Toronto with his vehicle full of guns! Very scary
Stuff!!!
What did I tell you people in the past? Someone is
going to crack up one of these days and I know for a
fact the area targeted is going to be the Legislature.

There’s always undercovers cops around but only
when the House is in session.
As God as my witness I hope nothing happens but
it’s just a matter of time till someone is push over
the edge.
I guess a guy name David Amos was shown the door
yesterday at the Legislature. This guy is running as
an Independent candidate in the riding of Fundy Royal.
I met the guy over the net and he has a beef with our
political bureaucrats.
I admire people fighting for what they believe in
but you can’t get carried away. I guess in this case?
He wanted to speak from the Gallery and that’s a big
faux pas!

I warned him that I was a very fierce political animal. I also made it
clear to Sgt. Vaillancourt that I have many very justifiable reasons
not to trust any cop anymore. I will do as I said and sue the Crown
Corp known as the RCMP in the Court of the Queen's Bench in
Fredericton unless somebody doesn't act with the scope of their
employment ASAP. However I must do as I promised and file my first
complaint against the Crown in Federal Court first. In the "mean" time
perhaps some local cop in New Brunswick should simply do his job and
investigate all the material I have given to them over the years. They
really stop their bullshit about jusridiction and mandate in order to
protect their personal interests. Do they not understand that I can
sue them as individuals? There is nothing wrong with exposing the
truth about my allegations of criminal conduct in support of public
corruption for the benefit of all Canadians. Just act non paritsan and
let the politcal card fall where they may. Lawyers and politicains are
infinitely replacable and all falsly claim to be ethical as they pick
our pockets. I would love to hear my name mentioned in a very public
forum even if it was slandered. Before the Yankee elections on
November 7th would be nice EH? Politicians cops and lawyers should
look to their own personal interests and then uphold the law and the
public trust placed in their positions. After all that is their job
not mine N'est Pas?
I do not have to do anything any cop or lawyer may wish to suggest
anymore. Not all Maritimers are dumb defeatists as Stevey Boy Harper
has suggested in the past. At least I am one dumb pigheaded Maritimer
who knows the differnce between my rights under the Charter and the
government's wrongs practiced against them. I also know when somebody
has falied their oath to uphold the law and protect the public
interests and I certainly know how to hold them accountable in a legal
and ethical fashion. To say you will sue someone is not a threat. It
is merely a promise. Most lawyers employ such words everyday and they
practice law for a fee.
I have taken no oath to obey other then one to my wife and an unspoken
one to my seed.. Thus I obey only my own consience and I stress test
my own integrity every day in the best interests of my Clan. It is
them whom I serve and protect without a fee because it is my duty to
do so just as cops and other public servants etc are gainfully
employed to protect us all under oath and rule of law. My family has
suffered enough over the past five years. Tis high time I sought
monetary relief from our bad acting governemnts in order to bring them
home to Canada to live in peace and escape further Yankee malice.
Anyone can check my work. Much of it still remains on file in the
public record of many Yankee courts and one Canadian one. I am certain
that anyone would agree that my Clan has had amazing patience thus
far. I say nay never no more. I have been a student of enough Canadian
law to get a good grip on the scene. It is time to put what I learned
to good use for the benefit of my Clan. EH?

I know for a fact it was my calls to Parliament etc in response to the
following words that made the RCMP start to do their job and call me
back.

OTTAWA - Wayne Easter, the former solicitor-general who presided
during the Arar ordeal, appeared to contradict earlier testimony from
RCMP head Giuliano Zacardelli today when he answered questions at a
commons committee.
Responding to Justice Dennis O’Connor’s report on the Arar case at the
public safety and national security committee, Easter said he was
never told the RCMP had passed on false information to the United
States and was never told the RCMP tried to correct it, as claimed by
Zacardelli.
“I was not informed that the RCMP had provided inaccurate information
to the U.S.,” Easter told the MPs.
When Zacardelli met with the committee in September he was asked when
he informed his minister about the RCMP’s error, and he replied that
he could not recall specifically but that “briefings and timelines
started to be prepared for him as the matter came up, and we started
providing that information.”
But Easter emphatically told the committee that that information never
reached him. In preparation for today’s appearance Easter said he
reviewed documents, briefing notes and material he had received during
his tenure on the Arar case and met with his staff in order to have a
clear timeline of what he knew and when.
In two briefing notes from October and November of 2002, Easter said,
“There was no reference to errors in information, no reference to
false information, nor was there any reference to any corrective
efforts having been made by the RCMP with respect to any of the
information which may have been shared.”
The same was true in briefings given in June and July of the following
year, Easter testified.
Giving further evidence he was in the dark abut the erroneous
information passed on to the U.S., Easter said the issue was never
raised with him by his American counterpart Attorney General John
Ashcroft. Presumably when American investigators learned they had
false information on Arar, Ashcroft would have been briefed on that
information, Easter said, and he believes Ashcroft would have shared
that with him.
“Attorney General Ashcroft…would have undoubtedly raised that point
with me,” Easter said.Asked whether he would have acted differently
had he known earlier that Arar had no terrorist links, Easter said he
didn’t want to answer hypothetical questions.
Maher Arar, a Canadian citizen, was arrested in the United States in
2002, and sent to his native Syria where he was imprisoned for a year
and endured torture before being released without charge.
The committee is planning to recall Zacardelli to clarify his initial
testimony and he will likely be asked about the contradictions
provided today by his former political boss.

Claude Landry is a native of Tracadie and it is also where he has always lived.

He is one of eight children of Bernadette and Émile Landry. He
graduated from the Polyvalente W.-Arthur-Losier in 1973. He later
obtained a degree in health sciences from the University of Moncton in
1976 and a doctorate in dental surgery from the University of Montreal
in 1982. He practiced dentistry in Tracadie from 1982 to 1991 and in
Neguac from 1991 to 2001.

Claude Landry began his political career in 1992 when he became City
Councillor of the City of Tracadie-Sheila. He later became Minister
Elvy Robichaud’s Chief of Staff from 2001 to 2006, before being
elected MLA in the riding of Tracadie-Sheila in 2006 and again in
2010.

Claude has served on the Standing Committee on Estimates and Fiscal
Policy and the Standing Committee on Law Amendments. He has also been
a spokesperson for the Official Opposition in areas related to
education. During his career, he served on the Tracadie Historical
Museum Board of Directors and the Tracadie Hospital Safeguard
Committee, as well as being Chef de Mission for the Jeux de l’Acadie
in Grand Falls. He was also a member of La Colombe Funeral
Cooperative.

Today, Claude Landry mainly looks after his mother doing the work of a
caregiver. He understands the concerns of families and seniors who
need home care. He enjoys walking during the summer and snowshoeing
during the winter. It is in Claude’s nature to help the people of his
community and he wishes today to continue to invest more for the
advancement of his region.

    Plus I have to disagree, I don't think Mr. Coon is doing a good
job. I personally don't agree with everything he says because he has
no scientific proof or his proof is too biast and one sided. But with
that said when he does bring good unbiast proof I do agree with some
of the things he says, but not all.
