                I, SHAWN ALBERT TABOR of Apohaqui, in the County of
Kings of the Province of New Brunswick, MAKE OATH AND SAY THAT:


1.    I am the Respondent herein and have personal knowledge of the
documents hereto attached as Exhibits found under Tabs A though to P
unless otherwise stated.

2.    The matter was last before the court on June 13th, 2016 at that
time an order was given orally from the bench by Judge Petrie and the
written court order prepared by David M. Lutz Q.C., the solicitor
acting on behalf of the applicant was filed on June 15th, 2016 after
the judge had modified and initialed it.

3.    On July 4th, 2016 I was notified that the matter was set down for a
hearing on January 17th, 2017 at 9:30 AM and that it is scheduled for
a half day.

4.    Pursuant to the order mentioned above I am opposing and making a
counterclaim against the Applicant's court ordered Amended Motion
filed on March 21, 2016  falsely claiming that I am $82.436.29 in
arrears after paying all that the CROWN demanded of me and a great
deal more in the form of child support since 2002.

5.    This affidavit and its exhibits is filed to support my Answer and
Counterclaim against the Moving Party/Applicant, ANNE BOURQUE
(formerly TABOR)

6.    Based on the above I am seeking an Order as follows:

a) Revoke the Order for Corollary Relief based on the incorporated
separation agreement purportedly created on November 6, 2003 and
finally divorce me from ANNE BOURQUE.

b) That the Court order the Family Services or whomever to have the
NBTA Pension Branch calculate how much $50,984.02 invested in the
pension plan of ANNE BOURQUE since November 7, 2003 is worth today and
have that sum finally be awarded to me.

c) That the court determines how much I have overpaid in child support
since my oldest son began living with me in my home and order that
ANNE BOURQUE reimburses me.

d) That the court request that the Attorney General demand that the
Law Society of New Brunswick answer the complaint DAVID RAYMOND AMOS
made against DAVID LUTZ in 2004 and initiate a complaint against CORY
TOOLE.

e) That the court award punitive damages to me in the form of relief
caused by the actions of the law firms of MOSHER CHEDORE and LUTZ
LONSTAFF

f) Such other relief as deemed appropriate by this Honourable Court.

New advisory panel set to begin work to fill 'urgent' N.B. judicial vacancy

A panel of seven New Brunswickers will begin meeting next month to vet lawyers who want to become judges and make recommendations to the federal Department of Justice on which of them should fill vacancies on the bench.

The executive director of the Law Society of New Brunswick says it's a critical step in fixing the "unacceptable" backlog in Saint John's family court, which has been short one judge for a year.

But Marc Richard doesn't expect anyone to be appointed from the estimated 25 to 30 applicants before the fall and he said it could take months, or even up to a year, to resolve the backlog of custody and support cases.

Four of the panel members appointed in June are from the legal community, while the other three are members of the general public. They include:

  • Chair Justice Margaret Larlee, a supernumerary judge of the New Brunswick Court of Appeal, who was the first woman appointed to the provincial appeal court in 1998 and to the New Brunswick Court of Queen's Bench in 1985. (Nominee of the chief justice of New Brunswick.)
  • Moncton lawyer Blair Fraser, who also lectures at the University of Moncton. (Nominee of the minister of justice and attorney general of New Brunswick.)
  • Pierre Castonguay, executive director of the New Brunswick Legal Aid Services Commission. (Nominee of the Law Society of New Brunswick.)
  • Saint John lawyer Cathy Lahey, who was appointed Queen's Counsel by the lieutenant-governor of New Brunswick in 2013. (Nominee of the Canadian Bar Association.)
  • Clarence LeBreton, a historian and longtime civil servant from Caraquet and chair of the board of L'Acadie Nouvelle, an independent French-language newspaper. (Nominee of the federal government.)
  • Normand Theriault from Madawaska County, who has 30 years of experience working with credit unions. (Nominee of the federal government.)
  • Bridget Ryan, a Sussex town councillor and school co-ordinator. (Nominee of the federal government.)

The volunteer panel will classify candidates as highly recommended, recommended or not recommended, said Ryan.

"Obviously, we're looking for their legal background and their skills that pertain to their job," she said. "But it's a little more than that.

"It's looking at what they've done in their communities, where they stand on different issues. Are they, you know, socially aware? Are they progressive thinkers? Are they fair when it comes to gender and nationality and multiculturalism and all of those things?

"I think that the people of New Brunswick should have that say. The legal system is for all of us. It's not just for the people who work in that field. It's for everybody. So I do think that it's important that residents have a say in this," she said.

Under Prime Minister Justin Trudeau's Liberal government, the judicial advisory committees (JACs) in each province are supposed to better represent Canada's diversity, and boost diversity on the bench.
The unpaid two-year terms of New Brunswick's previous JAC members expired in October 2015.

Wait times hit 'historic heights'


The family division of the Court of Queen's Bench in Saint John has been down to two judges from three since Justice Richard Petrie was transferred to Woodstock last summer.

The court has been unable to get a replacement, waiting for the federal justice minister to appoint the seven-member screening panel to review applications.

Earlier this summer, veteran Saint John family lawyer Kimberly McCurdy wrote to federal Justice Minister Jody Wilson-Raybould, making an "urgent plea" to fill the judicial vacancy.

"Urgent assistance is required," McCurdy wrote in the letter dated June 7, a copy of which was obtained by CBC News.

"Wait times are now at historic heights," she said, and "to suggest [the two sitting judges] would be exhausted is an understatement."

The pressure on the two existing judges is especially difficult because of the busy docket and the time it take to adequately hear child protection matters, the letter said.

"The long-term effect on the families in our community by ineffective delivery of justice can in no measure be healthy for our children," McCurdy wrote in the letter, whicih was copied to New Brunswick Justice Minister Denis Landry, the Saint John Law Society, the Law Society of New Brunswick and the Canadian Bar Association.

"Families are the foundation of our community. The judicial district of Saint John has a widening and unnecessary crack in that foundation which we urgently implore you to repair."

There is also a Court of Queen's Bench vacancy in Bathurst, according to the Canadian Bar Association for New Brunswick.

Saint John's family court has become so backlogged because of a judicial vacancy the Law Society of New Brunswick says lawyers are complaining of a crisis.

​​"The Saint John dockets are clogged and there is little meaningful or timely access to justice for family litigants," law society president George Filliter wrote in a letter to federal Justice Minister Jody Wilson-Raybould.

Wilson-Raybould has yet to appoint a new judicial advisory committee — a seven-member screening panel — for New Brunswick.

Across the country, new judicial advisory committees, known as JACs, have been set up to recommend the appointments of judges to superior courts, based on training and criteria that are supposed to improve overall diversity on the bench.

Without a committee in place, New Brunswick can't fill two judicial vacancies, including the one in Saint John and another in the trial division in Bathurst.

Vacancy hard on families


For almost a year, Saint John's family court has been operating with two judges when it should have three.

Divorce lawyers, whose cases also involve sensitive issues related to child custody, say they're having to wait a year or longer to get before a judge.

"To me, I don't think in the last 10 years that it's really been this far out," said lawyer Carley Parish.

Parish said the federal government's judicial reforms should be good in the long run, and court staff in Saint John are doing their best to manage the situation, but it's hard on families.

She said some parents are being bumped to make room for files involving children in the care of the Department of Social Development.

Those files have to be heard within certain time frames, and they're squeezing out other families, who are now being rescheduled into August 2018, Parish said.

"It's hard to explain to a client," she said. "It's hard to explain when ... you were expecting your trial and it's moved. And it's hard to explain when it's set down ... next year.

"These families need relief or they wouldn't be in the court system."

In October 2016, Justice Minister Jody Wilson-Raybould announced reforms to the judicial appointment process aimed at making it more transparent and more inclusive.

All JACs appointed under Prime Minister Stephen Harper lapsed.

It was announced that new committees would consist of three members of the general public and four members nominated by the Canadian Bar Association, the provincial law society, the provincial attorney-general and a chief justice.

In January 2017, Wilson-Raybould announced appointments to three judicial advisory committees.

That month, Fundy Royal MP Alaina Lockhart re-issued a call for nominations for three "general public representative" positions in New Brunswick.

Aiming for diversity

Lockhart said the federal government was looking to reflect the diversity of the community, including "Indigenous peoples, persons with disabilities and members of linguistic, ethnic and other minority communities, including those whose members' gender identity or sexual orientation differs from that of the majority."

Currently, all seven JAC positions in New Brunswick are vacant, putting the province at the back of the pack of 17 committees across the country, along with five other jurisdictions.

Manitoba, Saskatchewan, Nunavut, Northwest Territories and southwestern Ontario are in the same position, with no seats filled.

The Law Society of New Brunswick said it submitted three names in December. Marc Richard, the society's executive director, said he doesn't know what's taking so long.

Even if New Brunswick got its committee this week, it could be months before the members are ready to help appoint a judge, he said.
