The Canadian government blocked a visit by Carles Puigdemont days before the former Catalan president was to travel to the country at the invitation of a group advocating Quebec independence, his lawyer said on Monday.

Puigdemont had been scheduled to speak in Quebec earlier this month on his experiences as a leader of the Catalonian independence movement – including his spearheading of the region’s 2017 unilateral referendum on separation from Spain. His schedule was to include a visit to the province’s national assembly.

But days before he was due to land in Montreal on 2 April, the Canadian government revoked Puigdemont’s electronic travel authorization (ETA), a document issued to those traveling from countries from which Canada does not have visa requirements. Enacted in 2016, the ETA program was designed in part to weed out potential security threats.
Puigdemont is wanted by the Spanish authorities over the role his government played in trying to break away from the rest of the country in 2017.
 “This guy is not a criminal or a member of a terrorist group. He was the democratically elected president of Catalonia, who happened to have organized a referendum like we’ve had here in Quebec,” said Stéphane Handfield, Puigdemont’s lawyer. On Monday, Handfield filed a motion in federal court contesting the cancellation of Puigdemont’s ETA.
A spokesperson for Immigration, Refugees and Citizenship Canada said the ministry would not comment on individual cases. “Applicants are asked a series of question on issues including health and criminal history. On occasion if the department becomes aware of information that is inconsistent with that provided by the applicant, it will cancel the ETA,” the spokesperson said. “It is not a political process.”
Nevertheless, Quebec sovereignty is a touchy issue for the Canadian government. The province has often elected the separatist Parti Québécois party, which held referendums on sovereignty in 1980 and 1995. Though the PQ lost both, separatism remains a going concern; nearly a quarter of Québécois still consider themselves “sovereignists”, according to a recent poll.
Many among them still despise former prime minister Pierre Trudeau for his staunch anti-separatist stance, and have about as much regard for his son, the current prime minister, Justin Trudeau.
“By blocking the democratically elected president of Catalonia, Canada is showing how it is hostile to Quebec’s right of self-determination,” said Maxime Laporte, president of the Société Saint-Jean-Baptiste, the pro-sovereignty group that invited Puigdemont to speak. “In Quebec’s name, the Canadian government is telling us who is welcome and who isn’t.”
In recent years, Quebec’s independence movement has suffered the ravages of old age and apathy, but the travel ban prompted some to ask if the Canadian government had unwittingly helped the cause. “If they had just let him in, there would have been far less reaction,” Handfield says. “I think the government is now wishing it hadn’t done this.”
Puigdemont was president of Catalonia from January 2016 to October 2017, but fled to Belgium after the Madrid government responded to his administration’s declaration of independence by sacking him and taking control of the region.
Other members of his government – including his vice-president, Oriol Junqueras – stayed behind and are now on trial at the supreme court in Madrid.
In July last year, a Spanish judge dropped the international arrest warrants for Puigdemont and other fugitive members of his government.
The dropping of the international warrant means Puigdemont and five former colleagues – currently in Belgium, Scotland and Switzerland – no longer face extradition proceedings. But domestic warrants remain in force, meaning the six will be arrested should they return to Spain.
It emerged on Monday that Puigdemont and two of his former ministers are to be excluded from standing in next month’s European elections after Spain’s central electoral board upheld an appeal from two rightwing parties.

I have been following this story in the news as well and am sorry to
hear about the difficulties of Mr. & Mrs. Wright in moving to Nova
Scotia.

MONTREAL -- The exiled former president of Spain's Catalonia region is
fighting a Canadian government decision to refuse him entry into the
country to attend an event hosted by a Quebec nationalist group.

Carles Puigdemont, who fled Spain in 2017 to avoid prosecution after
his regional government held an unauthorized referendum on
independence, has hired Montreal immigration lawyer Stephane Handfield
to plead his case.

Handfield filed a motion Monday in Federal Court seeking judicial
review of the Immigration Department decision.

He said the Catalan separatist, who lives in exile in Belgium,
received an Electronic Travel Authorization from Canada. But on March
31, two days before his scheduled arrival in Quebec, the government
revoked the permit without giving a reason, Handfield said.

"It's as if we're saying he is undesirable in Canada," Handfield said
in an interview. "That he is akin to a terrorist or a member of
organized crime."

Maxime Laporte, president of the Societe Saint-Jean-Baptiste, the
nationalist group that had invited Puigdemont, accused the federal
government of denying Quebecers the right to hear the Catalan
separatist politician's "liberating speech."

Mathieu Genest, spokesman for Immigration Minister Ahmed Hussen, said
in an email that the government cannot comment on specific cases.

But he said reasons that someone can be found to be inadmissible to
Canada include "criminality, having a serious health problem (and)
having lied in their application or during an interview."

The news Monday that Puigdemont had been denied entry into Canada was
criticized by sovereigntist political parties in Quebec as well as by
the federal New Democrats.

NDP Leader Jagmeet Singh told reporters in Ottawa he saw no reason why
Puigdemont wouldn't be allowed into Canada. "It's worrying," he said.
Parti Quebecois deputy leader Veronique Hivon called the decision
unacceptable.

Handfield's motion asks the Federal Court to review the decision to
"cancel the Electronic Travel Authorization" of his client. The lawyer
said he is seeking a written response from the federal government
outlining its motives for refusing Puigdemont entry into Canada.

The former Catalan president is considered a fugitive by the Spanish
government. The 2017 referendum led to an independence declaration,
but no action was taken to implement it, and no countries recognized
the new Catalan republic.

A little less than half of voters in the region of 7.5 million support
pro-independence parties, results of the last regional election show.

Also on Monday, Spanish political party officials said the country's
Electoral Board has ruled that Puigdemont and two other Catalan
separatists who fled abroad to escape arrest can't stand as candidates
in next month's European Parliament elections.

The former president of Catalonia, Carles Puigdemont, has been
prevented from travelling to Canada for a series of events in Quebec
sponsored by the nationalist St. Jean Baptiste Society.

Mr. Puigdemont has been living in exile in Waterloo, Belgium, since
October, 2017, when he fled Barcelona along with a group of cabinet
ministers in the wake of a failed attempt to declare the region
independent. They are wanted in Spain on charges of rebellion,
sedition and using public funds to hold a referendum on independence
that Madrid said was illegal. Spain has tried to extradite Mr.
Puigdemont twice without success and it has now withdrawn a European
arrest warrant. However, he faces immediate arrest if he returns to
the country.

The ex-president had been invited by the St. Jean Baptiste Society for
a four-day visit to Quebec starting on April 2. He was slated to hold
meetings with Members of the National Assembly and attend several
events at universities and community organizations across the
province. He applied for an electronic travel authorization (ETA) at
the end of March and was promptly approved by Canadian immigration
officials. However, the ETA was revoked on April 1 without an
explanation and Mr. Puigdemont had to cancel his plane ticket.

Canada requires ETAs for travellers from countries such as Spain that
are visa-exempt, which means visitors don’t need a visa to come to
Canada. It’s usually a straight-forward online process that takes a
few minutes to complete and the ETA is valid for seven years.
Applicants are asked a few questions about their health, criminal
background and travel plans.

“We don’t understand that decision,” said Gonzalo Boye, a Madrid-based
lawyer who represents Mr. Puigdemont. “Especially coming from a
country that is so friendly with and so understandable with the
situation of Catalonia.” Mr. Boye added that Mr. Puigdemont has hired
Montreal lawyer Stéphane Handfield to challenge the decision.

St. Jean Baptiste Society president Maxime Laporte said in a statement
that “It was absolutely shameful that Canada has once again been
complicit to Spanish authoritarianism.” He called on the federal
government to reverse the decision and added that Ottawa “had no
authority, and no legitimacy, to refuse Quebeckers the right to warmly
invite international leaders that inspire them.”

Mathieu Genest, a spokesman for immigration minister Ahmed Hussen,
said he could not comment on specific cases. But he said “reasons
someone can be found to be inadmissible [by a visa officer] include
criminality, having a serious health problem, having lied in their
application or during an interview.” The applicant is sent a letter
outlining why the ETA was refused, he added, and the traveller can
supply additional information to clear up the issues.

In a recent interview with The Globe and Mail at his home in Waterloo,
Mr. Puigdemont praised Quebec separatists and said he hoped to visit
the province one day as an independent country. “There has been for a
long time a great sympathy and friendship between the sovereignty
movement in Catalonia and the sovereignty movement in Quebec,” Mr.
Puigdemont said. “And especially now we have received the support of
the independence movement in Quebec. We would like to thank them
enormously.” He also praised the Canadian government for allowing two
referendums on Quebec sovereignty. Canada “shows us that there is a
democratic way of recognizing each other and how to respect the
result.”

Mr. Boye said Mr. Puigdemont will reschedule the trip if the ETA is
granted. “There are no hard feelings,” he said. “We cannot blame a
country for something that a civil servant has done.”

Mr. Puigdemont got more bad news on Monday when Spain’s electoral
commission barred him and two other exiled cabinet ministers from
running for election to the European Parliament next month. The board
said Mr. Puigdemont and the others couldn’t become members of the
European Parliament from Spain because they were not registered as
Spanish citizens living abroad. Mr. Boye said Mr. Puigdemont will
challenge the ruling.

The decision came a day after elections in Spain that left the
Socialists with the most seats in parliament but needing the support
of other parties to form a government.

The Canadian government blocked a visit by Carles Puigdemont days
before the former Catalan president was to travel to the country at
the invitation of a group advocating Quebec independence, his lawyer
said on Monday.

Puigdemont had been scheduled to speak in Quebec earlier this month on
his experiences as a leader of the Catalonian independence movement –
including his spearheading of the region’s 2017 unilateral referendum
on separation from Spain. His schedule was to include a visit to the
province’s national assembly.

Carles Puigdemont to be excluded from European elections

But days before he was due to land in Montreal on 2 April, the
Canadian government revoked Puigdemont’s electronic travel
authorization (ETA), a document issued to those traveling from
countries from which Canada does not have visa requirements.

Enacted in 2016, the ETA program was designed in part to weed out
potential security threats.

Puigdemont is wanted by the Spanish authorities over the role his
government played in trying to break away from the rest of the country
in 2017.

 “This guy is not a criminal or a member of a terrorist group. He was
the democratically elected president of Catalonia, who happened to
have organized a referendum like we’ve had here in Quebec,” said
Stéphane Handfield, Puigdemont’s lawyer. On Monday, Handfield filed a
motion in federal court contesting the cancellation of Puigdemont’s
ETA.

A spokesperson for Immigration, Refugees and Citizenship Canada said
the ministry would not comment on individual cases. “Applicants are
asked a series of question on issues including health and criminal
history. On occasion if the department becomes aware of information
that is inconsistent with that provided by the applicant, it will
cancel the ETA,” the spokesperson said. “It is not a political
process.”

Nevertheless, Quebec sovereignty is a touchy issue for the Canadian
government. The province has often elected the separatist Parti
Québécois party, which held referendums on sovereignty in 1980 and
1995. Though the PQ lost both, separatism remains a going concern;
nearly a quarter of Québécois still consider themselves
“sovereignists”, according to a recent poll.

Many among them still despise former prime minister Pierre Trudeau for
his staunch anti-separatist stance, and have about as much regard for
his son, the current prime minister, Justin Trudeau.

“By blocking the democratically elected president of Catalonia, Canada
is showing how it is hostile to Quebec’s right of self-determination,”
said Maxime Laporte, president of the Société Saint-Jean-Baptiste, the
pro-sovereignty group that invited Puigdemont to speak. “In Quebec’s
name, the Canadian government is telling us who is welcome and who
isn’t.”

In recent years, Quebec’s independence movement has suffered the
ravages of old age and apathy, but the travel ban prompted some to ask
if the Canadian government had unwittingly helped the cause. “If they
had just let him in, there would have been far less reaction,”
Handfield says. “I think the government is now wishing it hadn’t done
this.”

Puigdemont was president of Catalonia from January 2016 to October
2017, but fled to Belgium after the Madrid government responded to his
administration’s declaration of independence by sacking him and taking
control of the region.
Other members of his government – including his vice-president, Oriol
Junqueras – stayed behind and are now on trial at the supreme court in
Madrid.

In July last year, a Spanish judge dropped the international arrest
warrants for Puigdemont and other fugitive members of his government.

The dropping of the international warrant means Puigdemont and five
former colleagues – currently in Belgium, Scotland and Switzerland –
no longer face extradition proceedings. But domestic warrants remain
in force, meaning the six will be arrested should they return to
Spain.

It emerged on Monday that Puigdemont and two of his former ministers
are to be excluded from standing in next month’s European elections
after Spain’s central electoral board upheld an appeal from two
rightwing parties.

Canada’s and Canadians free ride is over. Canada can no longer hide
behind Amerka’s and NATO’s skirts.

When I was still in Canadian Forces then Prime Minister Jean Chretien
actually committed the Canadian Army to deploy in the second campaign
in Iraq, the Coalition of the Willing. This was against or contrary to
the wisdom or advice of those of us Canadian officers that were
involved in the initial planning phases of that operation. There were
significant concern in our planning cell, and NDHQ about of the dearth
of concern for operational guidance, direction, and forces for
operations after the initial occupation of Iraq. At the “last minute”
Prime Minister Chretien and the Liberal government changed its mind.
The Canadian government told our amerkan cousins that we would not
deploy combat troops for the Iraq campaign, but would deploy a
Canadian Battle Group to Afghanistan, enabling our amerkan cousins to
redeploy troops from there to Iraq. The PMO’s thinking that it was
less costly to deploy Canadian Forces to Afghanistan than Iraq. But
alas no one seems to remind the Liberals of Prime Minister Chretien’s
then grossly incorrect assumption. Notwithstanding Jean Chretien’s
incompetence and stupidity, the Canadian Army was heroic,
professional, punched well above it’s weight, and the PPCLI Battle
Group, is credited with “saving Afghanistan” during the Panjway
campaign of 2006.

What Justin Trudeau and the Liberals don’t tell you now, is that then
Liberal Prime Minister Jean Chretien committed, and deployed the
Canadian army to Canada’s longest “war” without the advice, consent,
support, or vote of the Canadian Parliament.

December 14, 2015)

The Plaintiff seeks an appeal de novo, by way of motion pursuant to
the Federal Courts Rules (SOR/98-106), from an Order made on November
12, 2015, in which Prothonotary Morneau struck the Statement of Claim
in its entirety.

At the outset of the hearing, the Plaintiff brought to my attention a
letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal).  In that letter
he stated:

As for your past President, Mr. Bell, may I suggest that you check the
work of Frank McKenna before I sue your entire law firm including you.
You are your brother’s keeper.

Frank McKenna is the former Premier of New Brunswick and a former
colleague of mine at the law firm of McInnes Cooper. In addition to
expressing an intention to sue me, the Plaintiff refers to a number of
people in his Motion Record who he appears to contend may be witnesses
or potential parties to be added. Those individuals who are known to
me personally, include, but are not limited to the former Prime
Minister of Canada, The Right Honourable Stephen Harper; former
Attorney General of Canada and now a Justice of the Manitoba Court of
Queen’s Bench, Vic Toews; former member of Parliament Rob Moore;
former Director of Policing Services, the late Grant Garneau; former
Chief of the Fredericton Police Force, Barry McKnight; former Staff
Sergeant Danny Copp; my former colleagues on the New Brunswick Court
of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted
Police.

In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so.


AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion.  There
is no order as to costs.
