Robert Gauvin, the government's only francophone MLA and minister, also distanced himself from Ted Flemming's comments

Flemming presses for relaxed bilingual hiring rules for paramedics as judicial review looms

Weakened rules would affect areas where there's low demand for second-language service

Health Minister Ted Flemming still wants to immediately implement bilingual hiring changes despite the looming judicial review. (CBC)

New Brunswick's health minister says he still wants changes to hiring requirements for paramedics implemented immediately — despite comments by a cabinet colleague that they could be delayed.

Deputy Premier Robert Gauvin said in a Dec. 21 interview that Medavie, the company that operates Ambulance New Brunswick, would try to stall the changes until after a judicial review later this month.

But a spokesperson for Ted Flemming said the minister still wants the changes, which would weaken bilingual requirements for some paramedic positions, put in effect immediately.
"Nothing has changed with respect to the management problem concerning the lack of bilingual paramedics," said Bruce Macfarlane. "There is a shortage of bilingual paramedics and we have to manage it."

Gauvin told Radio-Canada on the Friday before Christmas that he had spoken to Medavie CEO Bernard Lord and the changes are "not implemented as we speak … and they're trying to delay it as long as possible until the review."

Robert Gauvin, the government's only francophone MLA and minister, also distanced himself from Ted Flemming's comments last month. (CBC)

In an email Wednesday, Medavie spokesperson Chisholm Pothier would not comment on Gauvin's conversation with Lord, a former Progressive Conservative premier.

He said the company "will continue to respect our obligations" under the Official Languages Act. He did not say when Medavie would comply with the province's directive.

New requirements

On Dec. 18 Flemming asked Ambulance New Brunswick to "immediately implement" the recommendations in a 2018 ruling by labour arbitrator John McEvoy.

They include relaxed bilingual hiring requirements in areas of the province where the government believes there's low demand for second-language service.

In those areas, Ambulance New Brunswick is being told to temporarily fill positions with unilingual paramedics and no longer re-post the vacancies every eight weeks McEvoy's ruling will be the subject of a judicial review Jan. 24 to determine if the recommendations violate bilingualism obligations in the Official Languages Act and the Charter of Rights and Freedoms.

The previous Liberal government asked for the review because McEvoy's ruling appeared to contradict a 2017 consent order that settled a Moncton lawsuit.
Ambulances are never off the road because of language requirements.- Medavie spokesperson Chisholm Pothier
In the order, signed by Justice Zoël Dionne, the province acknowledged it is required to provide bilingual ambulance service in all parts of the province. Lawyers for both the province and Ambulance New Brunswick signed the order and agreed to follow it.

Gauvin predicted in his Dec. 21 interview that the judicial review will quash McEvoy's recommendations.

"I know in a couple of months it'll be sorted out in our favour," he said. "By that I mean those who support bilingualism."

Medavie to comply with Official Languages Act

Pothier said after Flemming's announcement that Medavie would have "discussions with government to fully understand yesterday's announcement and the letter it sent us."

He also said Medavie would fulfill the terms of its contract with the province, "including complying with New Brunswick's Official Languages Act." Pothier also disagreed with Flemming's rationale that relaxing bilingual hiring requirements would allow idle ambulances to get back on the road.

"Ambulances are never off the road because of language requirements," he said, explaining that Ambulance New Brunswick always calls in unilingual paramedics when a bilingual position can't be filled.

Health Minister Ted Flemming wants to weaken bilingual hiring requirements for temporary full-time paramedics in certain areas of the province. (CBC)

Flemming himself said in November that ambulance delays were "not a language issue … This is a labour supply problem." But on Dec. 18 he said relaxing the bilingual requirements would allow for faster response times to ambulance calls.

Ambulance New Brunswick is operated by Medavie but answers to a board of directors made up entirely of employees of the provincial government and the two regional health authorities.

Robert Gauvin questions future with PCs, 'came close' to quitting

Deputy premier nearly quit Wednesday morning after announcement by health minister

Robert Gauvin, the PC government's only francophone MLA and minister, distanced himself from Ted Flemming's comments Wednesday. (CBC)

The lone francophone cabinet minister in the Blaine Higgs Progressive Conservative government is warning that he's pondering his future within the party.

Shippagan-Lameque-Miscou MLA Robert Gauvin said he's going to reflect on his situation over the Christmas break after provocative comments about bilingualism by his cabinet colleague, Health Minister Ted Flemming.

Gauvin called Flemming's remarks "a punch to the gut" and said he thought about quitting on Wednesday morning.

"It came close," he told Radio-Canada.

And he said he still has to assess whether he has a place in the PC government.

"I know there's another party that gave 18 months," he said, referring to a promise by the People's Alliance to keep the PC minority government in power for that time. "I didn't give 18 months."

One vote short

Even with the Alliance backing the government, Gauvin's departure would leave the Tories one vote short of a majority.

On Tuesday, Flemming announced that he was directing Ambulance New Brunswick to weaken the bilingual requirements for temporary paramedic hirings in some areas of the province where there is less demand for second-language service.

That was a recommendation of a labour ruling earlier this year by arbitrator John McEvoy.

Flemming also confirmed the government will also allow a judicial review of McEvoy's ruling to continue, so the courts can determine if the recommendations comply with the Official Languages Act.

But he said he would keep them in place even if the court quashes the labour ruling, and would only undo them if a court ordered him to do so.

Blaine Higgs said comments regarding language laws made by his health minister Tuesday were offside. (CBC)

Gauvin attended Flemming's news conference, but told Radio-Canada he did not know what Flemming was going to say until two minutes before the event began.

He said he spoke to Higgs the next morning.

"I said if we were above the law that protects language issue, I was gone. Happily, I didn't have to convince him because he agreed. So we had work to do on communication."

Later Wednesday, Higgs told reporters that his government would respect the law and said the McEvoy implementation was an interim measure.

But he has not said clearly if he'd cancel the McEvoy implementation if the court quashes the arbitration decision.

"I don't want to pre-suppose what might happen with that, but I guess I'd say health care is a primary concern," he said. "We'd have to figure out how we'd deliver on that, because you can't let people not be served."

Gauvin feels alone

Higgs has also acknowledged that weakening hiring requirements in some regions doesn't comply with the province's Official Languages Act.

Medavie, the company that runs Ambulance New Brunswick, said Friday that ambulances are never removed from service if a bilingual paramedic can't be found to fill a spot. Instead, a unilingual replacement is found.

Gauvin, the son of Hatfield-era PC cabinet minister Jean Gauvin, said he feels alone at times, constantly having to explain francophone concerns "to people who don't understand those nuances."

The first-term MLA said he isn't looking for a long career in politics and will use his position of influence to protect languages, but he added he can leave anytime if he decides he's not accomplishing that.

"There will be discussions," he said. "There'll be other issues that come up. What will my role be? I'm not just there to be a symbol."
Gauvin predicted the Court of Queen's Bench, which will hear the McEvoy review Jan. 24, will rule that the regional-based hiring requirements violates the law.

"I know in a couple of months it'll be sorted out in our favour," he said. "By that I mean those who support bilingualism."

Medavie has not said clearly how or when it will implement Flemming's directive. Flemming's letter to the company asked for it to be put in effect immediately.

Medavie spokesperson Chisholm Pothier said earlier in the week the company would be "having discussions with government to fully understand yesterday's announcement and the letter it sent us ...

We will fulfill our obligations under our contract, including complying with New Brunswick's Official Languages Act."

Gauvin said he spoke to Medavie CEO Bernard Lord, a former PC premier, and said Lord told him Medavie is "trying to delay it as long as possible until the review."

Bilingualism has been the law in this Province for half a century.
Why is it that now it is affecting paramedics?
Has this been an unlawful practice all this time?
How many instances of personal injury has resulted from services not being available in French all this time.

I think it is this creeping scope of bilingualism's impact that most people find so disturbing.

@David R. Amos Methinks he informed us again in no uncertain terms N'esy Pas?

Gauvin suggested Wednesday that he might not have remained a PC

"For me to stay in the party, those laws have to be respected, and we
will respect them," he said.

Flemming's rhetoric on bilingual paramedics doesn't reflect province's position, says Higgs

The premier called for a calmer discussion of language issues Wednesday

Blaine Higgs said comments regarding language laws made by his health minister Tuesday were offside. (CBC)

Premier Blaine Higgs has distanced himself from his own health minister's blustery comments on language laws, court rulings and the Charter of Rights and Freedoms.

Higgs says Tuesday's pointed comments by Ted Flemming needlessly inflamed the language debate and do not reflect the Progressive Conservative government's position.

Flemming vowed to implement changes to paramedic hiring practices regardless of what the Official Languages Act says and regardless of how the courts rule.

But speaking to reporters in Caraquet on Wednesday, Higgs said Flemming's comments were offside.

"We are a society based on the rule of the law, and when we get a decision, as a society we'll respect that decision," Higgs said. "That's how we have law and order here in our province in our country … We have a language law here that I respect and that we'll continue to enforce. That's not debatable."

Health Minister Ted Flemming said Tuesday he planned to keep the new measure in place until the courts tell him otherwise. (CBC)

And the premier called for a calmer discussion of language issues — while acknowledging that his cabinet colleague's provocative remarks were far from calming.

"It doesn't help to have emotions get raised and get out of hand," he said, adding he hadn't spoken to Flemming since Tuesday's announcement but "I will want to have a discussion of how this all came about and how it took this sort of turn."

Flemming announced Tuesday that the province was directing Ambulance New Brunswick to weaken its bilingual hiring requirements for temporary paramedic positions in areas of the province where there's little demand for second-language service.
It's a move that appears to violate legal and constitutional requirements for bilingual service in all areas of the province.

But Flemming repeatedly brushed off those concerns, declaring them "some academic discussion of the legal nuances."

He said he would stick with the hiring changes — proposed in a labour board arbitration ruling earlier this year — even if that ruling is struck down in a judicial review of its constitutionality.

"I have every intention of not changing anything here," he said, vowing not to budge unless a court ordered him to.

Comments cause alarm

On Wednesday, however, Higgs repeatedly referred to the changes as "an interim step" designed to address staffing shortages until bilingual positions can be filled.

Deputy premier Robert Gauvin, the government's only francophone MLA and minister, also distanced himself from Flemming's rhetoric.

"I can understand after yesterday's press conference that there was a message that was poorly communicated," Gauvin said. "If I had known ahead of time, the message wouldn't have come out like that, because we're not above the law."

Tuesday's news conference also saw Flemming, a former attorney-general with four decades of legal experience, brush off a 2017 consent order, signed by a judge, that requires the province to provide bilingual ambulance service everywhere in the province.

Flemming referred to the order, which the previous government agreed to, as "nothing."

Robert Gauvin, the government's only francophone MLA and minister, also distanced himself from Ted Flemming's comments Wednesday. (CBC)

The health minister's combative tone and the substance of his announcement alarmed francophone groups. The Acadian Society of New Brunswick said the PC government had "crossed a red line" on language rights with the change to hiring practices.

And retired law professor Michel Doucet, the lawyer for Danny and Murielle Sonier in the case that led to the 2017 order, said the Soniers will ask a judge to force the province to comply with it.

The province settled a lawsuit by the Soniers over a lack of bilingual service by agreeing to the order, which says the province must offer service in both languages everywhere.

"The minister is telling us this order does not have any legal value," Doucet said. "We will need to have that matter clarified by the courts."

Higgs changes his mind

The labour ruling by arbitrator John McEvoy, which advocates weaker bilingualism requirements in some regions, appears to contradict the 2017 court order in the Sonier case, which says the law must apply everywhere.

The previous Liberal government asked for a judicial review of the McEvoy ruling to clarify if it goes against the Sonier order.

Higgs promised last month to cancel that review and simply "fix" the ambulance system, but acknowledged Wednesday he'd been persuaded to change his mind.

"Initially I didn't think it was necessary for the government to go and challenge the case," he said.

"When I sought further legal assistance and advice, and when I talked to our MLA in Shippagan [Gauvin], as well as the language commissioner, it seemed like we needed to get resolution."

The premier said he expected that Tuesday's announcement by Flemming would be "a good news story" of the review going ahead, coupled with an interim decision to implement the McEvoy ruling. "It's unfortunate it turned away from that."

Gauvin suggested Wednesday that he might not have remained a PC without Higgs's clarification.
"For me to stay in the party, those laws have to be respected, and we will respect them," he said.

Medavie reacts

In a statement on Wednesday, a spokesperson for Medavie, the company that operates Ambulance New Brunswick, stopped short of saying the organization would implement Flemming's directive.

"This is a government decision," Chisholm Pothier said in an email. "We will be having discussions with government to fully understand yesterday's announcement and the letter it sent us.

"As we have always done we will fulfill our obligations under our contract, including complying with New Brunswick's Official Languages Act."

>
> [21]           In Del Zotto v. Minister of National Revenue, [2000] 4
> F.C. 321, 257 N.R. 96, this court did find that there would be a
> reasonable apprehension of bias where a judge, who while he was a
> lawyer, had recorded time on a matter involving the same person who
> was before that judge. However, this case can be distinguished as
> Justice Webb did not have any time recorded on any files involving Mr.
> Amos while he was a lawyer with Patterson Palmer or Patterson Law.
>
> [22]           Mr. Amos also included with his submissions a CD. He
> stated in his affidavit dated June 26, 2017 that there is a “true copy

> He has also indicated that he has “provided a true copy of the CD
> entitled 139 to many American and Canadian law enforcement authorities
> and not one of the police forces or officers of the court are willing
> to investigate it”. Since he has indicated that this is an “American
> police surveillance wiretap”, this is a matter for the American law

>
> [23]           As a result, there is no conflict or reasonable

>
> [24]           Mr. Amos alleged that Justice Near’s past professional

> [25]           Insofar as it is possible to glean the basis for Mr.

>
> [26]           The issue on the cross-appeal is as follows: Did the

> in its entirety without leave to amend and in determining that Mr.
> Amos’ allegation that the RCMP barred him from the New Brunswick
> legislature in 2004 was capable of supporting a cause of action?
>
> IV.              Analysis
>
> A.                 Standard of Review
>
> [27]           Following the Judge’s decision to set aside the
> Prothonotary’s Order, this Court revisited the standard of review to
> be applied to discretionary decisions of prothonotaries and decisions
> made by judges on appeals of prothonotaries’ decisions in Hospira
> Healthcare Corp. v. Kennedy Institute of Rheumatology, 2016 FCA 215,
> 402 D.L.R. (4th) 497 [Hospira]. In Hospira, a five-member panel of
> this Court replaced the Aqua-Gem standard of review with that
> articulated in Housen v. Nikolaisen, 2002 SCC 33, [2002] 2 S.C.R. 235
> [Housen]. As a result, it is no longer appropriate for the Federal
> Court to conduct a de novo review of a discretionary order made by a
> prothonotary in regard to questions vital to the final issue of the
> case. Rather, a Federal Court judge can only intervene on appeal if
> the prothonotary made an error of law or a palpable and overriding
> error in determining a question of fact or question of mixed fact and
> law (Hospira at para. 79). Further, this Court can only interfere with

> if the judge made an error of law or palpable and overriding error in
> determining a question of fact or question of mixed fact and law
> (Hospira at paras. 82-83).
>
> [28]           In the case at bar, the Judge substituted his own

> [29]           The Prothontoary’s Order accepted the following

> (…)
>
>
> 21.       The few paragraphs that directly address the Defendant

>
>
> [30]           The Judge determined that he could not strike the Claim
> on the same jurisdictional basis as the Prothonotary. The Judge noted
> that the Federal Court has jurisdiction over claims based on the
> liability of Federal Crown servants like the RCMP and that the actors

>
>
> [31]           The Judge noted that the 2004 event could support a

> a) The public officer must have engaged in deliberate and unlawful

>
> [32]           The Judge determined that Mr. Amos disclosed sufficient

>
> [33]           This Court’s discussion of the sufficiency of pleadings
> in Merchant Law Group v. Canada (Revenue Agency), 2010 FCA 184, 321
> D.L.R (4th) 301 is particularly apt:
>
> …When pleading bad faith or abuse of power, it is not enough to
> assert, baldly, conclusory phrases such as “deliberately or
> negligently,” “callous disregard,” or “by fraud and theft did steal”.
> “The bare assertion of a conclusion upon which the court is called
> upon to pronounce is not an allegation of material fact”. Making bald,
> conclusory allegations without any evidentiary foundation is an abuse
> of process…
>
> To this, I would add that the tort of misfeasance in public office
> requires a particular state of mind of a public officer in carrying
> out the impunged action, i.e., deliberate conduct which the public
> officer knows to be inconsistent with the obligations of his or her
> office. For this tort, particularization of the allegations is
> mandatory. Rule 181 specifically requires particularization of
> allegations of “breach of trust,” “wilful default,” “state of mind of
> a person,” “malice” or “fraudulent intention.”
> (at paras. 34-35, citations omitted).
>
> [34]           Applying the Housen standard of review to the
> Prothonotary’s Order, we are of the view that the Judge interfered
> absent a legal or palpable and overriding error.
>
> [35]           The Prothonotary determined that Mr. Amos’ Claim
> disclosed no reasonable claim and was fundamentally vexatious on the
> basis of jurisdictional concerns and the absence of material facts to
> ground a cause of action. Paragraph 14 of the Claim, which addresses
> the 2004 event, pleads no material facts as to how the RCMP officer
> engaged in deliberate and unlawful conduct, knew that his or her
> conduct was unlawful and likely to harm Mr. Amos, and acted in bad
> faith. While the Claim alleges elsewhere that Mr. Amos was barred from
> the New Brunswick legislature for political and/or malicious reasons,
> these allegations are not particularized and are directed against
> non-federal actors, such as the Sergeant-at-Arms of the Legislative
> Assembly of New Brunswick and the Fredericton Police Force. As such,
> the Judge erred in determining that Mr. Amos’ allegation that the RCMP
> barred him from the New Brunswick legislature in 2004 was capable of
> supporting a cause of action.
>
> [36]           In our view, the Claim is made up entirely of bare
> allegations, devoid of any detail, such that it discloses no
> reasonable cause of action within the jurisdiction of the Federal
> Courts. Therefore, the Judge erred in interfering to set aside the
> Prothonotary’s Order striking the claim in its entirety. Further, we
> find that the Prothonotary made no error in denying leave to amend.
> The deficiencies in Mr. Amos’ pleadings are so extensive such that
> amendment could not cure them (see Collins at para. 26).
>
> V.                 Conclusion
> [37]           For the foregoing reasons, we would allow the Crown’s

  1. I have been casting spells for many years and I have helped many people, I might be able to help you too. I am honest, and I genuinely care for all the clients who choose me to cast a spell for them.

If you have any questions about Love, Money, curse, protection, bad luck, divorce, court cases, or about me please call or email me. I really want you to feel comfortable before moving forward with any spells, or other services. I will take the time to explain things to you and provide you with honest advice, to what is best for your situation. I will not pressure you into having a spell cast, I will leave that decision up to you, and when or if you decide to move forward, I might be able to help you.
I will respect your Privacy. I will not seek to obtain any of your personal information beyond what you might voluntarily offer and all information you might give me including emails, phone numbers and photos will remain private and confidential.
I perform my Rituals only at night between the hours of 0.00 - 0.59 (South African time) lasting 1 hour but of course, this depends on the nature of the ritual, some rituals might take hours and can also become necessary to be performed at specials places like; flowing streams, cemeteries and other places dictated by the gods.
I do not want anyone to be under any illusions about my spells and its numerous rituals. Real and effective Voodoo is no child's play, it is expensive because, after the rituals, I will have to destroy all the materials involved by fire and the ashes scattered over a flowing stream or river.
You will get what you seek. But please understand this might take a lot of time and that individual results may vary. contact +27663492930, greatogudugu@gmail.com
